Upon a motion by Richard J.Byers and 2°d by John M.Pallone,the Board voted to GRANT a Special
Permit from Section 4,Paragraph 4.121.17 in order to allow a Family Suite to be constructed at 197 Carta
Field Road per Special Permit Plan,Lot 13,#197 Carta Field Road,North Andover,Massachusetts,Date:
September 15,2004,Prepared for Tara Leigh Development LLC, 121 Carter Field Road,North Andover,
Massachusetts,By: John F.Zahoruiko,P.E.#20563,262 South Bradford Street,North Andover,
Massachusetts;and Family Suite Plan,Lot 13,#197 Carter Field Road,September 15,2004,Tara Leigh
Development,LLC,with the following conditions:
1. The Family Suite shall not be occupied by anyone except brothers,sisters,maternal parents,
paternal parents,grandparents,or children of the residing owners of the dwelling unit;
2. The Special Permit shall expire at the time that the parents cease to occupy the family suite;
3. The Special Permit shall expire at the time the premises are conveyed to any person,
partnership,trust,corporation or other entity;
4. The applicant by acceptance of the Certificate of Occupancy issued pursuant to the Special
Permit,grants the Building Inspector,or his lawful designee,the right to inspect the
premises annually.

Dear Zoning Board of Appeals:
1. The particular use proposed for the land or structure
We are requesting a Special Permit for a Family Suite pursuant to Section 4.121.17 of the Zoning
Bylaws. This suite will be added to the existing structure, compliant with all dimensional requirements
and architecturally integrated into the structure and neighborhood.
2. The specific site is an appropriate location for such use, structure or condition.
The use will be architecturally integrated into the existing, newly-constructed home and neighborhood
by the same designer as all of the other homes on the street. The completed structure will remain within
the same size range as other homes in the neighborhood; the lot has gentle grades and no extraordinary
site alterations are required. All dimensional requirements and setbacks will be complied with. All
proposed changes occur to the side and rear of the existing new structure.
3. There will be no nuisance or serious hazard to vehicles or pedestrians.
The structure is located at the very end of a cul-de-sac, and is comfortably set back from the street,
compliant with zoning. The use has excellent vehicular access and visibility, and sidewalk access at the
driveway. The existing home is currently under construction, and completion of the proposed use at
this time would minimize construction intrusion for the neighborhood.
4. Adequate facilities will be provided for the proper operation of the proposed use.
The facility has full services currently including water, sewer,underground cables. Vehicular access is
direct over paved driveway to Carter Field Road;the structure currently has a three-car garage and
outside driveway parking for 4 more vehicles.
5. The use is in harmony with the purpose of the zoning by-law.
The zoning bylaw has intended the R1 zone for residential use, presumably to encourage family
atmosphere in a secure, friendly surrounding. The purpose of this request is to provide an extended,
multi-generational family unit a home in which to live comfortably, supportively together in a safe family
neighborhood environment.
6. Specific reference and response to the criteria required by the particular special permit for which
this application is made.
The proposed use is allowed by Special Permit granted by the Zoning Board of Appeals pursuant to
Section 4.121.17. The proposed use will be attached to the existing dwelling, will be occupied by the
parents of the owner/occupants,the Special Permit will be recorded at the North Essex Registry of
Deeds, and can be inspected annually by the Building Inspector. The use will be architecturally
integrated into the existing new home and neighborhood, will consist of approximately 850 sf of finished
living space (below the specified 1200 sf maximum), and will represent less than 18% of the gross living
area of the principal unit.
