Introduction Clearwire one of a limited number of companies licensed by the Federal Communications Commission to provide wireless communication services to not only the residents and businesses of the Town of North Andover, but also throughout the Greater New England region and the United States. On the basis of these licenses, Clearwire is mandated by the Federal Communications Commission to actively construct and operate a seamless wireless telecommunications network in various markets throughout the country, including the Commonwealth of Massachusetts and in particular the Town of North Andover and the greater surrounding area. Clearwire offers wireless broadband networks thatrovide entire communities with robust, high- speed, g speed, residential and commercial internet applications that are affordable and combine the best features of cellular, cable modem,DSL and Wi-Fi networks into a single service offering. As part of a multi-year network build-out plan, Clearwire's 4G service, called CLEARTM,will bring together an unprecedented combination of speed and mobility and will be available in markets ranging from major metropolitan areas to small cities and their surrounding areas in the United States and Europe. Since Clearwire launched their innovative wireless service, they believe they are the largest operator of next generation wireless broadband networks in the world. Clearwire operates their wireless network in 47 markets in the United States and currently owns or has access to wireless licenses li covering a population of 15.3 million people. They also operate select markets in Europe, where their networks cover approximately 2.9 million people. Clearwire's primary focus is expanding the geographic coverage of their wireless broadband markets in the United States. They are currently engaged in the development, construction and deployment of networks in the United States that will cover 75 million people, with an additional 45 million people being covered by long lead time site development work. Clearwire's current development activities will enable them to offer services to as many as 120 million people by the end of 2010. The Proiect Clearwire is licensed by the Federal Communications Commission (hereinafter "FCC") to provide wireless broadband communication services by building a network of communication sites using World Interoperability for Microwave Access (WiMAX) technology. This technology, also referred to as IEEE 802.16, utilizes digital transmission to improve the quality and number of available services including, without limitation, Voice and Data Services such as Internet and email access, voice over IP and other data applications. In order to build out its network and meet customer demand for Wireless Broadband Services, Clearwire must have in place a system of 'cell sites' to serve portable wireless communication handsets and mobile telephones. A typical cell site, such as the one proposed, consists of three panel antennas with associated wireless"back-haul" antennas mounted to a building,tower, church or other structure. The antennas are connected to radio operating equipment housed at or near the structure. To maintain effective, reliable and uninterrupted service, there must be a continuous series of cell sites located within close proximity to each other so as to overlap in a system comparable to a honeycomb pattern. If there is no cell site available to accept/receive the signal, network service to the mobile telephone/data service will terminate involuntarily. Accordingly,the overlap of coverage is necessary for the signal to transfer from one cell site to another cell site seamlessly and without involuntary termination. A number of factors determine the distance between cell sites, including, but not limited to,topography,physical obstructions, foliage, antenna height and line-of-sight. The Facility Based on the radio frequency studies, reports and computer models prepared in connection with this project, it is Applicant's assertion that there is inadequate network service available to its customers due to a coverage gap within the Town of North Andover in the surrounding area of Turnpike Street. Also based on the radio frequency studies, reports and computer models prepared in connection with this project, Applicant would be able to alleviate this significant gap in coverage by locating its antennas at an approximate height of sixty (60) feet AGL on the above referenced property as proposed. Without a wireless service facility located at or near 203 Turnpike Street, the substantial gap coverage will continue to adversely impact the service that Applicant is able to provide to the residents and business around Turnpike Street and to individuals traveling through these areas. As further detailed in the accompanying site plan,Applicant is proposing to co-locate three (3)panel antennas inside of a stealth chimney, one (1) wireless back-haul antenna at approximately sixty (60) feet, one (1) equipment cabinet and corresponding equipment at the existing wireless service facility owned and operated by the North Andover Office Condominium Trust at 203 Turnpike Street. All of Applicants proposed equipment would be entirely within the existing wireless service facility. After installation, Applicant's wireless service facility will be unmanned and will only require twice monthly visits for maintenance. The only utilities required to operate this facility are standard 120- volt electrical power as well as telephone service. Both of these utility services are presently installed at the existing facility. Applicant's proposed wireless service facility will be installed, erected, utilized and maintained in compliance with all applicable local, state and federal regulations, including, but not limited to: the radio frequency emissions regulations set forth in the 1996 Federal Communications Act, applicable regulations administered by the Federal Aviation Administration (FAA), Federal Communications Commission (FCC), Massachusetts Aeronautics Commission and the Massachusetts Department of Public Health. Once in service, it is the responsibility of Applicant to make RF field measurements to ensure the facility's compliance with FCC guidelines. When combined with all other existing wireless service facilities at 203 Turnpike Street, the RF emission from Applicant's proposed antennae would neither exceed State and Federal limits nor "interfere" with the other existing wireless service facilities at the site location. Conclusion Based on the above, and the other information provided in this application, Applicant believes that it satisfies the objectives and requirements set forth in the Town of North Andover's Zoning and Wireless Service Facilities Bylaw,to the extent applicable. Applicant seeks to co-locate antennas on an existing wireless service facility, which facility currently meets all requirements of the Zoning Bylaw; Applicant's wireless service facility will enable Applicant to provide a substantial benefit to the Town of North Andover, and particularly the area surrounding 203 Turnpike Street, in the form of its wireless broadband network services; Applicant's wireless service facility would have minimal noise, traffic and environmental impacts; and failure to grant the Special Permit will result in substantial harm to Applicant in the form of large gaps in coverage in the Town of North Andover, particularly in the area surrounding 203 Turnpike Street, as well as Applicant's failure to meet its FCC license mandate to build and operate wireless communications systems that provide adequate wireless services to the general public. As a result, Applicant respectfully requests that the Planning Board grant Applicant's request for a Special Permit for a wireless service facility at 203 Turnpike Street. All of Applicants proposed equipment would be co-located within an existing wireless service facility. There are no subdivision plans or change to gross floor-area ratio or use at the property. The proposed co-location will have minimal or no impact on traffic, waste, noise and parking. After installation, Applicant's facility will be passive; it will be unmanned and will only require twice monthly visits for maintenance. The only utilities required to operate the proposed facility are standard 120-volt electrical power as well as telephone service, both of which are presently installed at the existing facility. For these reasons, Applicant's proposed co-location at 203 Turnpike Street will have minimal impact on the general health, safety and welfare. Therefore, Applicant respectfully requests a waiver of the Site Plan Review provision of the Town of North Andover Zoning Bylaw. RF ENGINEERING AFFIDAVIT Site ID: MA-BOS7090 Site Address: 203 Turnpike Street,North Andover,MA 01845 The undersigned hereby state the following in support of the application by Clear Wireless LLC (hereinafter known as"Clearwire")to co-locate at approximately sixty(60)feet above ground level(AGL)on the existing building and install related equipment on the rooftop at the property located at 203 Turnpike Street,North Andover,MA 01845(hereinafter the"Site"). 1. I am a Radio Frequency Engineer employed by Clearwire, with an office located at 200 5th Ave, Waltham,MA. 2. My primary responsibilities include radio frequency design and planning in the Commonwealth of Massachusetts,including such areas as North Andover and surrounding communities. 3. I have thoroughly reviewed the radio frequency engineering studies,reports and computer models prepared by Clearwire with respect to the Site. 4. Without a wireless transmission facility located at or near the Site, the substantial gap coverage will continue to adversely impact the service that Clearwire is able to provide to the residents and business around Turnpike Street and to individuals traveling through this area. 11. The proposed wireless broadband communications equipment shall be in compliance with the FCC Guidelines for Evaluating the Environmental Effects of Radio Frequency Radiation. It is the responsibility of Clearwire to make RF field measurements once this site will be in service in compliance with FCC guidelines. 12. The proposed wireless communications equipment will be installed, erected,maintained and used in compliance with all applicable Federal,State and local regulations,including,but not limited to: the radio frequency emissions regulations set forth in the 1996 Federal Communications Act, applicable regulations administered by the Federal Aviation Administration (FAA), Federal Communications Commission (FCC), Massachusetts Aeronautics Commission and the Massachusetts Department of Public Health. 13. The RF emission from these proposed site antennae would not exceed the State and Federal standards,when combined with all other existing PWSA facilities at Turnpike Street,and the new antennae would not "interfere" with the other existing PWS structures from other carriers at the site location. 14. Based upon the best radio frequency technology available at this time, it is my professional opinion that the proposed Site is at the minimum height that is needed to ensure adequate service to area residents and businesses within the geographic area described above.
