For the project to comply we request a variance under section 7,table 2 of the Zoning Bylaws due to the following circumstances: A: The particular use of this structure will not change from the existing single family residence. B: The shape,soil conditions and topography of the land dictate that this is the only location where the deck can be placed. There is a conservation boundary directly behind the house preventing further expansion in that direction. At the southern corner of the house is the driveway leading to underneath garage,and the north side is where the chimney,air conditioning,venting and other fixtures are located and would need to be moved. C: Placing the deck in any other location would substantially change the scope of the project,making it financially impossible to complete. D: The requested relief will be desirable in that the house has always had a similarly sized deck,which has simply been expanded and moved. The project is without substantial detriment to the public good. E: The requested relief does not nullify or otherwise substantially derogate from the intent and purpose of the Ordinance.
