2006 at 7:30 PM in the Town Hall top floor meeting room,120 Main Street,North Andover,Massachusetts
upon the application of Louis P.Minicucci,Jr.,Trustee,Essex Realty Trust,231 Sutton Street,North
Andover,MA for premiss at:223 Pteasant Street(Map 85 Parcel 47),North Andover requesting a
Special Permit from Section 4,Paragraphs 4.122.14.b,4.122.14.c,3,&4.122.14.c.4 of the Zoning Bylaw in
order to convert a single family dwelling to a two family dolling. Said premise affected is Property with
frontage on the West side of Pleasant Street within the R-4 zoning district. Legal notices were sent to all
names on the abutter's list and were published in the Eagle-Tribune,a raper of general circulation in
the Town of North Andover,on November 21&28,2005. The public bearing was opened on December
13,2005 and was continued without further evidence to August 8,2006.
The following voting members were present: Ellen P.McIntyre,Joseph D.LaGrasse,Richard 1.Byers,
Albert P.Manzi,III,and Richard M Vaillancourt.
The following non-voting members were present: Albert P.Manzi,III,Thomas D.Ippolito,and Daniel S.
Braese.
Upon a motion by Richard J.Byers and 2 d by Richard M.Vaillawovrt,the Board voted to GRANT the
applicant's form letter of August 8,2006 requesting that the Special Permit petition be WITHDRAWN

Special Permit Application-Responses to Points 1-6
1. This particular Special Permit Request is for conversion of a single family
residential structure into a two family residential structure. This conversion
requires no exterior modifications.
2. The site in question, 223 Pleasant Street abuts a commercial property with
frontage on Chickering Road (Route 125). The neighborhood is a mix of single
and multi-family residences, including the shuttered Greenery nursing home and
businesses. The existing house is approximately 2,000 square feet on two floors
and lends itself to conversion into an upstairs and a downstairs living unit, each
with two separate entrances and two off street parking spaces apiece.
3. There will be no nuisance or hazard created as there will be no exterior
modifications to the structure and no enlargement. There is adequate off street
parking to support the two units of housing so there will be no street parking and
hence no hazard to pedestrians.
4. The two housing units will have forced hot air and air conditioning, laundry
facilities in the units and will be fully applianced. In addition there is a large back
yard for the prospective tenants. The housing is also close to essential services
such as food shopping,restaurants and gas stations.
5. The conversion of this single family home into a two family structure is in
keeping with the spirit of the bylaw. We are not proposing to raze the structure
and replace it with a monstrosity inconsistent with the neighborhood. In fact there
will be no exterior changes and the use and character of the building are
consistent with the neighborhood. As noted before the neighborhood is fully built
out with dense development on small lots including single family, multi family
and business uses. This parcel is the last house on Pleasant Street before the
MaCaloons Plaza. The commercial plaza is the direct abutter to the rear and right
side of the property.
6. No unique criteria apply to this Special Permit application.
