A. USE OF PROPOSED STRUCTURE: The Applicant presently leases this parcel of land from the Lawrence Airport Commission and there were two (2) airplane hangars on the property which were recently razed. The Applicant proposes to construct one (1) larger hangar in order to provide indoor storage of airplanes. Many of these airplanes are currently parked outdoors in open areas. B. CIRCUMSTANCES RELATING TO SOIL SHAPE TOPOGRAPHY ETC. The Applicant's site consists of land which is leased from the City of Lawrence through the Lawrence Airport Commission. The Applicant's site comprises only a small portion (26,787 sq. ft.) of the entire lot of over 520 acres on which the airport is situated. This arrangement of leasing land and constructing buildings is common on airport property while being somewhat unique in the zoning district in which the airport is located. Building location must adhere to regulations regarding airport runways, control tower, and other essential structures. Also, the only areas abutting the leased parcel are within the airport lot itself and the proposed building will be located hundreds of feet from any abutter to the airport. C. SUBSTANTIAL HARDSHIP. The City of Lawrence, through its airport commission, is faced with a limited amount of remaining leaseable land on the airport that is suitable for aviation uses. For over fifty (50) years, the airport has been leasing sections of the airport property to various tenants. The leased areas have been built upon with no restrictions applied to any setback from the building to the lease line. Only recently has the application of minimum yard requirements been applied to lease lines the same as they would be applied to boundary lines. Without the requested variance, the City of Lawrence would be unable to provide for the indoor storage of aircraft. Those airplanes would be subject to the effects of weather, exposure, vandalism and increased security concerns. As owner of the property, the City would suffer a substantial hardship if the requested variance was not granted. D. FACTS SUPPORTING FINDING OF DESIRABLE RELIEF AND NO DETRIMENT TO PUBLIC GOOD: As set forth elsewhere herein, the requested relief is both desirable and in the public interest. The relief will allow the Applicant to secure airplanes in indoor facilities, protecting them both from the effects of weather and security risks. The proposed building will not be visible from or be located in the vicinity of property located outside of the airport and, will have no negative impact on the airport (which supports this application) or the area surrounding the Airport. The existence of extensive set back distances and open space between the proposed buildings and any dissimilar use or structure will insure that there will be no negative impact from the requested relief. E. FACTS SUPPORTING FINDING OF NO SUBSTANTIAL DEROGATION OF INTENT OF ZONING BY-LAW. It must be assumed. that the Zoning By-Law's set back requirements were intended primarily to prevent the sitting of structures in close proximity to structures or incompatible uses located on abutting lots. That concern simply does not exist in this situation. As shown on the submitted plan, the leased area boundary on which the proposed building will be built is located in proximity to, but a safe distance from, an existing Airport taxiway and runway. Locating the proposed building even near the edge of this boundary will have no ill effect on the uses or structures abutting that boundary of the leased parcel. The dimensions of the leased area have been set to provide the airport with a needed facility on leaseable land located a safe distance from existing buildings and an existing active taxiway. A. USE OF PROPOSED STRUCTURE: The Applicant presently leases this parcel of land from the Lawrence Airport Commission and there were two (2)airplane hangars on the property which were recently razed. The Applicant proposes to construct one (1) larger hangar in order to provide indoor storage of airplanes. Many of these airplanes are currently parked outdoors in open areas. B. CIRCUMSTANCES RELATING TO SOIL SHAPE TOPOGRAPHY ETC. The Applicant's site consists of land which is leased from the City of Lawrence through the Lawrence Airport Commission. The Applicant's site comprises only a small portion (26,787 sq. ft.) of the entire lot of over 520 acres on which the airport is situated. This arrangement of leasing land and constructing buildings is common on airport property while being somewhat unique in the zoning district in which the airport is located. Building location must adhere to regulations regarding airport runways, control tower, and other essential structures. Also, the only areas abutting the leased parcel are within the airport lot itself and the proposed building will be located hundreds of feet from any abutter to the airport. C. SUBSTANTIAL HARDSHIP. The City of Lawrence, through its airport commission, is faced with a limited amount of remaining leaseable land on the airport that is suitable for aviation uses. For over fifty (50) years, the airport has been leasing sections of the airport property to various tenants. The leased areas have been built upon with no restrictions applied to any setback from the building to the lease line. Only recently has the application of minimum yard requirements been applied to lease lines the same as they would be applied to boundary lines. Without the requested variance, the City of Lawrence would be unable to provide for the indoor storage of aircraft. Those airplanes would be subject to the effects of weather, exposure, vandalism and increased security concerns. As owner of the property, the City would suffer a substantial hardship if the requested variance was not granted. D. FACTS SUPPORTING FINDING OF DESIRABLE RELIEF AND NO DETRIMENT TO PUBLIC GOOD: As set forth elsewhere herein, the requested relief is both desirable and in the public interest. The relief will allow the Applicant to secure airplanes in indoor facilities, protecting them both from the effects of weather and security risks. The proposed building will not be visible from or be located in the vicinity of property located outside of the airport and, will have no negative impact on the airport (which supports this application) or the area surrounding the Airport. The existence of extensive set back distances and open space between the proposed buildings and any dissimilar use or structure will insure that there will be no negative impact from the requested relief. E. FACTS SUPPORTING FINDING OF NO SUBSTANTIAL DEROGATION OF INTENT OF ZONING BY-LAW. It must be assumed that the Zoning By-Law's set back requirements were intended primarily to prevent the sitting of structures in close proximity to structures or incompatible uses located on abutting lots. That concern simply does not exist in this situation. As shown on the submitted plan, the leased area boundary on which the proposed building will be built is located in proximity to, but a safe distance from, an existing Airport taxiway and runway. Locating the proposed building even near the edge of this boundary will have no ill effect on the uses or structures abutting that boundary of the leased parcel. The dimensions of the leased area have been set to provide the airport with a needed facility on leaseable land located a safe distance from existing buildings and an existing active taxiway. This OOC permits the airport to continue implementation of the Vegetative Management Plan as approved. The NACC noted that although monitoring reports were submitted during the clearing activities and herbicide application, reports detailing ongoing monitoring of the success of these activities and invasive and nuisance species monitoring have not been received(required by Condition#78 of the OOC). After reviewing the matter with the environmental monitor from Stantec, the NACC agreed that the submission of data sheets and photographs would meet the monitoring requirement. Materials from monitoring in 2007 and 2008 should be submitted to the Conservation Department no later than March 18, 2009. It is also noted,that this year's monitoring should report the success of the re-establishment of indigenous wetland plant species within disturbed areas as required by Condition#32. In addition, the environmental monitor reported that wetland markers required by Condition#53 of the OOC have not been installed. Also, the only areas abutting the leased parcel are within the airport lot itself and the proposed building will be located hundreds of feet from any abutter to the airport. C. SUBSTANTIAL HARDSHIP. The City of Lawrence,through its airport commission, is faced with a limited amount of remaining leaseable land on the airport that is suitable for aviation uses. For over fifty(50) years,the airport has been leasing sections of the airport property to various tenants. The leased areas have been built upon with no restrictions applied to any setback from the building to the lease line. Only recently has the application of minimum yard requirements been applied to lease lines the same as they would be applied to boundary lines. Without the requested variance,the City of Lawrence would be unable to provide for the indoor storage of aircraft. Those airplanes would be subject to the effects of weather, exposure, vandalism and increased security concerns. As owner of the property, the City'-would suffer a substantial hardship if the requested variance was not granted. D. FACTS SUPPORTING FINDING OF DESIRABLE RELIEF AND NO DETREMENT TO PUBLIC GOOD: As set forth elsewhere herein, the requested relief is both desirable and in the public interest. The relief will allow the Petitioner to secure airplanes in indoor facilities, protecting them both from the effects of weather and security risks. The proposed building will not be visible from or be located in the vicinity of property located outside of the airport and, will have no negative impact on the airport (which supports this application) or the area surrounding the Airport. The existence of extensive set back distances and open space between the proposed buildings and any dissimilar use or structure will insure that there will be no negative impact from the requested relief. E. FACTS SUPPORTING FINDING OF NO SUBSTANTIAL DEROGATION OF INTENT OF ZONING BY-LAW. It must be assumed that the Zoning By-Law's set back requirements were intended primarily to prevent the sitting of structures in close proximity to structures or incompatible uses located on abutting lots. That concern simply does not exist in this situation. As shown on the submitted plan, the leased area boundary on which the proposed building will be built is located in proximity to, but a safe distance from, an existing Airport taxiway and runway. Locating the proposed building even near the edge of this boundary will have no ill effect on the uses or structures abutting that boundary of the leased parcel. The dimensions of the leased area have been set to provide the airport with a needed facility on leaseable land located a safe distance from existing buildings and an existing active taxiway.
