RE: 701 Salem Street Waiver of Site Plan Review Special Permit
Dear Mr. Xenakis:
On Tuesday,July 23,2003,the Planning Board voted on the following motion:
Mr. Nardella motioned to find that, on the basis of the Applicant's written request dated July 10,
2003, modified written request dated July 22, 2003,and the floor Plan Titled J& M Pizza drawn by
R.J. Kalustian and dated January 23, 2003, in accordance with Section 8.3(2)(c) of the Zoning
Bylaw, that change in use will not have a significant impact within the site or in relation to adiacent
Properties and streets; on pedestrian and vehicular traffic, public. services and infrastructure;
environmental, unique and historic resources; abutting properties; or community needs, and hereby
GRANT a waiver of site plan review. 2" by Mr. Schwarz. Discussion: None. Motion carried 4-0
(Chair Alberto Angles,Vice Chair George White,Clerk Felipe Schwarz Rick Nardella).
Since this waiver was granted specifically based on the written requests and documentation cited in Mr.
Nardella's motion to grant the waiver,the written requests are attached to this notice. Failure to comply
with the conditions volunteered in your request would void the waiver.

To: Members of the Planning Board
Re: 701-707 Salem Street,North Andover, MA
As the owners of the J&M Country Stores at the property above,we request a waiver of
site plan review for the change in use at the property based on the following facts:
- All employees of the plaza will park in the rear parking lot.
- All delivery trucks belonging to the pizza shop will park in the rear parking lot.
- All delivers to the plaza will be made to the rear of the stores.
- There will not be seating inside the pizza shop.
- The pizza shops hours will be approximately from 11:00 am to 9:00 pm.
- No additional dumpsters will be required for this occupant.
- No additional lighting will be required for this occupant.
We feel that a waiver is appropriate based upon the above conditions. In addition there is
no significant impact to traffic flow and the surrounding neighborhood. The addition of a
pizza shop will further enhance the services provided to the community.

This letter is to formally request a waiver of a Site Plan Review for the
commercial property at 701-707 Salem Street. As you may already know,Virginia Inc.,
dlWa J&M Pizm,is seeking to open a take-out only business in the space formerly
occupied by the Champion Factory. The space is approximately 1000 square feet.
We are not seeking to modify the buffing in any way. There will be no
additional trash receptacles and the exterior iliummation will remain exactly the saute.
Because the plans for this bumess do not include any seating,we fiwther expect that
parking will not be a problem
A pizza store will be busiest during evening hours,at a time when other business
in the budding are either closed or slow. Accordingly,we believe that the new use will
not have a significant impact on the property.
We would appreciate the opportunity to address this issue with the members of
the Planning Board. Please consider this letter a request to appear before the full Board
at the earliest possible tin. I appreciate your assistance thus far and look forward to
hang back from you.
