Proposed Wireless Facility at 723 Osgood Street(Stevens Estate),North Andover,MA Dear Members of the Board: On behalf of Omnipoint Communications, Inc., a wholly owned subsidiary of T- Mobile, we respectfully seek a Special Permit for the construction of a personal wireless service facility at the above referenced location pursuant to Section 8.9 Wireless Service Facilities and any other relief deemed by the Town to be required under applicable provisions of the Town of North Andover By Laws. This letter is submitted in support of the attached application, together with various other supporting materials enclosed herewith. Company Information i Omnipoint Communications, Inc. (OCT) is a wholly owned subsidiary of T-Mobile USA. OCI is the named licensee for FCC awarded Personal Communication Services for all of New England and is registered to conduct business in each New England state. OCI's communication service is built upon the use of the GSM operating system, one of the world's leading and most often employed operating systems. OCI was the first company to inaugurate a true PCS network in New York,the largest single telecommunications market in the world, on November 14, 1996. OCI merged in March of 2000 with Voicestream Wireless, a leading FCC licensed GSM wireless company servicing the west coast and central portions of the nation. The license coverage area created through this merger, as well as additional mergers and license acquisitions made the company truly a national wireless carrier with the largest license covered population of all PCS carriers. More recently, Voicestream became a part of the Deutsche Telekom family of companies bringing to its customers a new level of integrated communications services on an international scale. Now known as T-Mobile, the company will continue to be the lead operating entity for these services delivery and for the development of the associated GSM network within the United States. We currently have a network of over 1800 sites in New England. The proposed installation is part of a proposed improvement of our existing PCS service footprint in this area. The company looks forward to providing superior wireless communications service to the businesses and residents of Town of North Andover. Description of Proposed Installation The Applicant is proposing to install three(3)panel antennas concealed within the existing monopole. Coaxial cable will connect the antennas to three (3) equipment cabinets enclosed within Sprint's lease area at the base of the facility. The existing stockade fence will be expanded to accommodate the proposed base station equipment, and will measure approximately 9' x 22'. Pursuant to the FCC mandate requiring E911 capabilities, one (1) 15" GSM antenna as well as one (1) 7" GPS antenna will also be installed on the monopole. The installation requires only electric and telephone utilities and, once completed, will require an average of one to two monthly maintenance visits by qualified company technicians. No water, sewer or other municipal services are required. Please also note that no permanent back up generator is included as part of the installation. Submission Requirements Section 8.9.5(d)(i)Application Filing Requirements i) General Filing Requirements (1) Name, address and telephone number of the Applicant and co-applicants as well as any agents for the Applicant or co-applicants. A<24-hour emergency telephone contact number shall be included for use during construction as well as operation of the wireless communication facility. The Applicant requesting the Special Permit is Omnipoint Communications, Inc., a Wholly owned subsidiary of T-Mobile with an address of 15 Commerce Way, Suite B, Norton, MA 02766. (2) Co-applicants may include the landowner of the subject property, license carriers and tenants for the proposed wireless service facility. 2 The Applicant, Omnipoint Communications Inc. a whollyowned subsidiary of T- Pp Po az'Y Mobile, has received authorization from Sprint to collocate on the existing monopole. Sprint has acknowledged and agreed that a Special Permit for the proposed facility is necessary, in addition to the Town's consent, prior to the construction of the facility. The Applicant respectfully requests that as we are awaiting official Town consent, that the Board accept this application and begin the site plan review process of the proposed installation, providing that the Town's Consent will be a condition for granting of the Special Permit. Please see the enclosed letter of authorization from Sprint acknowledging our collocation on the monopole. (3) Every application for a wireless service facility Special Permit shall include at least one licensed carrier and the owner of the land as an applicant or a co- applicant. Enclosed please find the Applicant's FCC license to provide service in the Town of North Andover. (4) Original signatures for the applicant and all co-applicants applying for the Special Permit. If an agent represents the applicant or co-applicant, an original signature authorizing the agent to represent the applicant andlor co-applicant is required. Photo reproductions of signatures will not be accepted. All other filing requirements in the Zoning Bylaw and the Rules and Regulations as applicable must be complied with. Attached please find the Special Permit Application which contains original signatures from the Applicant and the property owner as well as authorization from the Applicant allowing Wellman Associates, Inc. to represent them through the Special Permit process. ii) Location Filing Requirements (1) Identify the subject property by including the name of the nearest road or roads, street address, and Assessors Map and Parcel number of subject property. The subject property is located on the Stevens Estate property with an address of 723 Osgood Street. The subject property is identified at the North Andover Assessor's office as Map 35, Parcel 23. The closest property line is approximately 600 feet from the existing facility. (2) Identify the Zoning District designation for the subject parcel. Submit a copy of the Town zoning map with parcel identified. The subject parcel is located in both Residential District I and Residential District 2. The proposed installation will be located in the Residential 1 District. Enclosed, please find a map depicting the applicant's existing facilities within the Town of North Andover and within one mile of its corporate limits. The Applicant respectfully requests a waiver from the requirement of showing all existing personal wireless service facilities as the Applicant is not privy to the locations of competing carriers' facilities. (5) GPS all equivalent system locating by latitude and longitude wireless service facilities The proposed wireless service facility GPS location is 42°42'-28.56" North Latitude and 71'-06'-51.03"West Longitude. iii) Siting Filing Requirements. A one-inch-equals-40 feet plan prepared by a Registered Professional Engineer in the Commonwealth of Massachusetts showing the following: For clarity purposes and in an effort to fit the plan on one page, the plan has been designed with a scale of a one-inch equals 200 feet.The Applicant respectfully requests a waiver from the one-inch-equals 40 feet scale. (1) Property lines for the subject property. Please see the enclosed site plans prepared by Coler& Colantonio,Inc. Engineers and Scientists. (2) Property lines of all properties within 300 feet of the proposed location. Please see the enclosed site plans prepared by Coler&Colantonio,Inc. Engineers and Scientists. Please note that there are no properties within 300 feet of the existing monopole and proposed compound. (3) Tree cover on the subject property, by dominant species and average height. The Applicant respectfully requests a waiver from this requirement as the subject property consists of approximately 153 acres of land. Please see the enclosed site plan I 4 prepared by Coler & Colantonio, Inc. Engineers and Scientists demonstrating the average tree height surrounding the existing pole and compound. (4) Outline of all existing buildings, including purpose (e.g. residential buildings, garages, accessory structures, etc.) on subject property and all properties adjacent to the subject property. Please see the enclosed site plans prepared by Coler&Colantonio, Inc. Engineers and Scientists. Please note that the Applicant is not proposing a shelter. (6) Proposed security barrier, indication type and extent as well as point of controlled entry. The proposed installation requires that the existing compound be expanded within the lease area and enclosed in a stockade fence to match the existing fencing. (7) Location of all roads, public and private, on the subject property and on all adjacent properties within 300 feet including driveways proposed to serve the wireless service facility. Enclosed, please find site plans prepared by Coler & Colantonio, Inc. Engineers and Scientists. Please note that there are no other properties within 300 feet of the existing pole. (8) Distances, at grade,from the proposed wireless service facility to each building on the vicinityplan. This standard is not applicable as there are no buildings within 300 feet of the proposed installation. Please see the enclosed site plan prepared by Coler & Colantonio, Inc. Engineers and Scientists. (9) Contours at each 2 feet AMSL for the subject property and all adjacent properties within 300 feet. The Applicant respectfully requests a waiver from this standard. The proposed facility will be located inside the existing monopole and within the existing lease area. The appearance of the exterior of the existing pole will not be altered. (10) All proposed changes to the preexistent property, including grading, vegetation removal and temporary or permanent roads and driveways. 5 Please see the enclosed site plans prepared by Coler&Colantonio,Inc. (I1) Representations, dimensioned and to scale, of the proposed mount, antennas, equipment shelters, cable runs, parking areas and any other construction or development attendant to the wireless service facility. (12) Lines representing the sight line showing viewpoint(point from which view is taken and visible point(point being viewed)from `Sight Lines"subsection below. The Applicant respectfully requests a waiver from this standard. The proposed facility will be located within the existing monopole and the associated base station equipment will be concealed within a stockade fenced in compound adjacent to other carriers' existing shelters. (13)Location of all wetlands on the subject property and within 100'of the proposed facility as approved by the Conservation Commission. iv)Sight lines and photographs as described below: (1) Sight line representation. A sight line representation shall be drawn from any public road within 300 feet and the closest fagade of each residential building (viewpoint) within 300 feet to the highest point (visible point) of the wireless service facility. Each sight lane shall be depicted in profile, drawn at one-inch equals 40 feet scale. The profiles shall show all intervening trees and buildings. In the event there is only one (or more) residential building within 300 feet there shall be at least two sight lines from the closest habitable structures or public roads, if any. The Applicant respectfully requests a waiver from this standard as there are no public roads within 300 feet of the proposed installation. The proposed installation will be located within the existing monopole, and the associate base station equipment will be concealed behind a stockade fence which will match the existing fence. (2) Preexistent (before condition)photographs. Each site shall be illustrated by one four-inch by six-inch color photograph of what can currently be seen from any public roads and residential buildings if the proposed wireless service facility is built. Enclosed, please find photographs of existing conditions of the wireless facility. Please note that our antennas will be installed within an existing pole and the exterior of the monopole will not be altered. 6 (3) Proposed (after condition) photographs. Each of the preexistent condition photographs shall have the proposed wireless service facility superimposed on it to show what will be seen from public roads and residential buildings if the proposed wireless service facility is built. The Applicant respectfully requests a waiver from this requirement as they believe it is not applicable to their proposed installation which will be located within an existing wireless facility and no changes will be made to the exterior of the pole. (4) Siting elevations or views at grade from the north, south, east and west for a 50- foot radius around the proposed wireless service facility plus from all preexistent public and private roads that serve the subject property. Elevations shall be at either on-quarter inch equal one foot or one-eight inch equals one foot scale and show the following: The Applicant respectfully requests a waiver from this standard. The proposed installation will be located within the existing monopole and concealed behind stockade fencing. (a)Antennas, mounts and equipment shelter(s), with total elevation dimensions and average ground level(AGL) of the highest point. All future proposed antennas, mounts and equipment shelters if any must be shown in order to be included in the Special Permit. Please see the enclosed site plans prepared by Coler& Colantonio, Inc. Engineers and Scientists. (b) Security barrier. If the security barrier will block views of the wireless service facility, the barrier drawing shall be cut away to show the view behind the barrier. Please see the enclosed site plans prepared by Coler& Colantonio, Inc. Engineers and Scientists. The proposed installation requires the antennas to be mounted within the existing monopole. The associated base station equipment will be enclosed within the proposed compound with one access point for all carriers which will be secured with a chain and combination lock. (c)Any and all structures on the subject property. Please see the enclosed site plans prepared by Coler& Colantonio, Inc. Engineers and Scientists. (d) Preexistent trees and shrubs at current height and proposed trees and shrubs at the proposed height at time of installation, with approximate elevations dimensioned. 7 The Applicant respectfully requests a waiver from this requirement as they believe it is not applicable to their proposed installation which will be located within an existing wireless facility. No changes will be made to the exterior of the pole and any removal of trees will be minimal and within the lease area. (e) Grade changes, or cuts and fall, to be shown as original grade and new grade line, with two foot contours AMSL The requirement is not applicable as the proposed installation will not require any grade changes or cuts and fill. v) Design Filing Requirements (1)Equipment brochures for the proposed wireless service facility such as manufacturer's specifications or trade journal reprints shall be provided for the antennas, mounts, equipment shelters, cables as well as cable runs, and security barrier, if any. Enclosed please find equipment brochures for the Applicant's proposed antennas and equipment cabinets. (2) Materials of the proposed wireless service facility specified by generic type and specific treatment(e.g. anodized aluminum stained wood,painted fiberglass, alloys, etc.) these shall be provided for the antennas, mounts, equipment shelters, cables as well as cable runs, and security barrier, if any. The antennas are constructed of aluminum and the equipment cabinets are constructed of steel and will be installed inside the proposed equipment compound enclosed with a stockade fence matching that of the existing fence. (3) Colors of the proposed wireless service facility represented by a color board showing actual colors proposed. Colors shall be provided for the antenna mounts, equipment shelters, cables as well as cable runs, and security barrier, if any. The Applicant respectfully requests a waiver of this requirement. The Applicant does not propose to change any of the exterior colors of the existing monopole. The proposed stockade fence will be of a natural wood color to match the existing fence. (4) Dimensions of the wireless service facility specified for all three directions: height, width and breadth. These shall be provided for the antennas, mounts, equipment shelters and security barrier, if any. Enclosed please find site plans prepared by Coler & Colantonio, Inc. Engineers and Scientists. (S)Appearance shown by at least two photographic superimpositions of the wireless service id fac aty within the subject property. The photographic superimposition's shall be provided for the antennas, mounts equipment shelters, cables as well as cable runs, and security barrier, if any,for the total height, width and breadth. The Applicant respectfully requests a waiver of this requirement. The proposed installation will be concealed within the existing pole and there will be no visible alterations to the exterior of the pole,nor increase in height. (6) Landscape plan including preexistent trees and shrubs and those proposed to be added, identified by size of specimen at installation and species. The Applicant is not proposing any landscaping; therefore respectfully requests a waiver of this requirement. Please see the enclosed site plans prepared by Coler & Colantonio, Inc. Engineers and Scientists. (7) During the public hearing process the applicant shall schedule with the Planning Board a balloon or crane test at the proposed site, at the expense of the applicant, to illustrate the height of the proposed facility. The Applicant respectfully requests a waiverfrom this requirement. The proposed installation will be concealed within the existing monopole and there will be no increase in height. (8)If lighting on the site is required by the FAA, the applicant shall submit a manufacturers computer generated point-to point printout, indicating the horizontal foot-candle levels at grade, within the property to be developed and twenty-five (25)feet beyond property lines. The printout shall indicate the locations and types of luminaries proposed. This requirement is not applicable as the Applicant will not be increasing the height of the pole. The existing monopole currently has lighting as required by the FAA. vi)Noise Filing Requirements (1) the applicant shall provide a statement listing the preexistent and maximum future projected measurements of noise from the proposed wireless service facilities, measured in decibels Ldn (common logarithmic scale, accounting for greater sensitivity at night),for the following: (a)Preexistent or ambient: the measures of preexistent noise (b) Preexistent plus proposed wireless service facilities: maximum estimate of noise from the proposed wireless service facility plus the preexistent noise environment. 9 (c) Such statement shall be certified and signed by an acoustical engineer, stating that noise measurements are accurate and meet DEP requirements and Section 8.9(4)(e). Enclosed, please find an acoustical noise impact assessment of the proposed facility prepared by Marc R. Chretien,P.E., of MRC Engineering, Inc. dated June 12,2006. vii)Radiofrequency Radiation (RFR)Filing Requirements (1)All telecommunications facilities shall be operated only at Federal Communications Commission (FCC) designated frequencies,power levels and standards, including FCC designated frequencies,power levels and standards, including FCC Radio Frequency Emissions standards. The applicant shall provide certification demonstrating that the maximum allowable frequencies; power levels will not be exceeded. Certifications shall include technical specifications, a written explanation of those specifications, and, if necessary, field verification. The Permit Granting Authority may condition any Special Permit granted under this section upon a periodic submittal of certification of compliance with said standards. (2) In order to determine compliance with applicable FCC regulations, the applicant shall provide a statement listing the preexistent and maximum future projected measurements of RFRftom the proposed wireless service facility, including all co-locators,for the following situations: (a) Preexistent or ambient; the measurement of preexistent RFR (b) Preexistent plus proposed wireless service facility plus the preexistent RFR environment. (c) Certification, signed by a engineer, stating that RFR measurements are accurate and meet FCC Guidelines as specified in the Radiofrequency Radiation Standards subsection of this Bylaw. Enclosed please find a statement prepared by Kamal Johari, RF Engineer for T Mobile. (3) Applicant must submit a copy of the letter from the Massachusetts Department of Public Health approving the site for this facility as required by 105CMR 122.000 requires that the Department of Public Health approve all sites for wireless facilities with respect to emissions. This standard is no longer applicable. Enclosed, please find a statement from the Commonwealth of Massachusetts, Department of Health entitled New Policy Regarding Radiofrequency Facility Installation Approval. viii)Federal Environmental Filing Requirements I 10 (1)At the time of application filing, an Environmental Assessment(EA) that meets FCC requirements shall be submitted to the Town for each wireless service facility site that requires such an EA to be submitted to the FCC (2) The applicant shall list location, type and amount (including radiation trace elements) of any materials proposed for use within the wireless service facility that are considered hazardous by federal, state or local government Enclosed,please find an Environmental Assessment of the existing facility. 8.3.5.(e)(ii) SURVEY OF LOT/PARCEL: A boundary survey conforming to the requirements of the Essex County Registry of Deeds Office. The survey shall be dated and include any revision made to the survey or site plan. Any change in the survey shall be recorded before site plan approval may be granted. The Applicant respectfully requests a waiver from this requirement as the subject parcel consists of over 153 acres of land and the existing facility is centrally located on the parcel, hundreds of feet from any adjacent lot lines. The Applicant believes that this requirement is not applicable as the proposed installation will be a collocation within the existing wireless service facility as well as within the existing lease area. Additionally, in support of our request for a Special Permit, please find the following enclosed information: 1) Special Permit Application; 2) List of Requested Waivers 3) Certified abutters list; 4) Application Fee in the amount of Four Hundred Dollars($400.00), and Five Dollars and Eighty-Eight cents($13.88)for ground space (84 square feet @$.07 per square foot); 5) Consultant review fee of$2,000 to be placed in an escrow account; 6) Coverage plots of the depicting the Applicant's existing coverage and proposed coverage from the facility; and 7) Affidavit of Radio Frequency Engineer. In the event there is only one (or more) residential building within 300 feet there shall be at least two sight lines from the closest habitable structures or public roads, if any. The Applicant respectfully requests a waiver from this standard as there are no public roads within 300 feet of the proposed installation. The proposed installation will be located within the existing monopole, and the associate base station equipment will be concealed behind a stockade fence which will match the existing fence. 8.9.5(d)(iv)(3) Proposed(after condition)photographs. Each of the preexistent condition photographs shall have the proposed wireless service facility superimposed on it to show what will be seen from public roads and residential buildings if the proposed wireless service facility is built. The Applicant respectfully requests a waiver from this requirement as they believe it is not applicable to their proposed installation which will be located within an existing wireless facility and no changes will be made to the exterior of the pole. 8.9.5(d)(iv)(4) Siting elevations or views at-grade from the north, south, east and westfor a 50 foot radius around the proposed wireless service facility plus from all preexistent public and private roads that serve the subject property. Elevations shall be at either on- quarter inch equal one foot or one-eight inch equals one foot scale and show the following: The Applicant respectfully requests a waiver from this standard. The proposed installation will be located within the existing monopole and concealed behind stockade fencing. 8.9.5(d)(iv)(4)(d) Preexistent trees and shrubs at current height and proposed trees and shrubs at the proposed height at time of installation with approximate elevations dimensioned. The Applicant respectfully requests a waiver from this requirement as they believe it is not applicable to their proposed installation which will be located within an existing wireless facility. No changes will be made to the exterior of the pole and any removal of trees will be minimal and within the lease area. 8.9.5.(d)(v)(3) Colors of the proposed wireless service facility represented by a color board showing actual colors proposed. Colors shall be provided for the antenna mounts, equipment shelters, cables as well as cable runs, and security barrier, if any. 2 The Applicant respectfully requests a waiver of this requirement. The Applicant does not propose to change any of the exterior colors of the existing monopole. The proposed stockade fence will be of a natural wood color to match the existing fence. 8.9.5.(d)(v)(5) Appearance shown by at least two photographic superimpositions of the wireless service facility within the subject property. The photographic superimposition's shall be provided for the antennas, mounts equipment shelters, cables as well as cable runs, and security barrier, if any,for the total height, width and breadth. The Applicant respectfully requests a waiver of this requirement. The proposed installation will be concealed within the existing pole and there will be no visible alterations to the exterior of the pole,nor increase in height. 8.9.5.(d)(y)(6) Landscape plan including preexistent trees and shrubs and those proposed to be added, identified by size of specimen at installation and species. The facility will include installing stealth antennae placed at 77-feet(RAD Center), T-Mobile will construct a facility which includes three (3) antennae and related BTS equipment in the Town of North Andover,Massachusetts(hereinafter"site"): 1. I am a Radio Frequency Engineer for T-Mobile, responsible for radio frequency design in Massachusetts. 2. The list of my qualifications attached to this affidavit is true,accurate,and complete in all material respects. 3. I have thoroughly reviewed the radio frequency engineering studies, reports, and computer model prepared by T-Mobile with respect to this site. I used a propagation modeling software by Aircom named Asset. This software calculates frequency strength over distance taking into account Geographical and Topographical land features and is finely tuned with live measured data. 4. T-Mobile is a communications venture committed to providing wireless personal communication services using personal communications service(hereinafter"PCS")technology. PCS technology is a new generation of wireless service that uses digital transmission to improve the services available. 5. In order to meet its obligations,under the FCC license,T-Mobile must have in place a system of"cell sites" to serve portable wireless communication handsets and mobile telephones. These cell sites consist of antennas(mounted on a pole,building or other structure)connected through coaxial cable lines to a cabinet located near the antenna. The antenna relay's information between mobile telephones and radio hardware located in the equipment cabinets. The equipment is then connected to ordinary phone lines from which the call can be routed anywhere in the world. 6. Cell sites are an integral part of T Mobile's network.To maintain effective,uninterrupted service to a mobile telephone user traveling in a given area,there must be a continuous interconnected series of cells, which overlap in a grid pattern. Additionally, each cell site must be located within a limited area so that it can properly interact with the surrounding cell sites and, thereby, provide reliable coverage throughout the cell. 7. In compliance with its FCC licenses,T-Mobile is actively building its PCS network to provide service in Massachusetts. In order to meet its goal of providing seamless uninterrupted service,T-Mobile must continue to acquire interests in sites for additional facilities,and is applying for and obtaining local governmental approvals to construct the transmission sites, in order to eliminate "gaps" in service coverage. Any delays at this point in time severely curtail T-Mobile's ability to satisfy both the mandated time requirements,and to achieve a market position that will allow it to compete for customers. 8. As set forth below,T-Mobile is proposing to locate a wireless communications facility on an existing structure by attaching three(3)antennas at a height of 77-feet(77-feet RAD Center). i 9. The Town of North Andover is critical to the overall engineering and technical plan of T-Mobile's network. This site will connect to adjacent existing and proposed sites in communities surrounding North Andover and will provide coverage to the businesses and residents of North Andover. 10. Presently a gap exists in the coverage within this area of North Andover. This "gap" in coverage impacts those who travel in this area of North Andover. Furthermore,the"gap" undermines other nearby facilities preventing them from maximizing the coverage to the area as a whole. 11. This site is especially suitable for T-Mobile's proposed wireless telecommunications facility. This site conforms to the narrow search specified by T-Mobile's service area computer model. Unlike other parcels of land in the area,the site has unique radio frequency characteristics,due to the topography of the site,the height and its location. 12. Without a wireless transmission facility located at or near the site,T-Mobile will be unable to handle the number of customers using its network in this area. By positioning a site at Sprint Stevens Estate,in North Andover,T-Mobile will be better able to provide seamless coverage to the citizens of North Andover and the commuters traveling on the main roads through and around this area.This will especially help with T-Mobile's ability to meet the strict mandated E911 emergency location service requirements set forth by the FCC. 13. The radio frequency exposure levels generated by the proposed facility are substantially below the applicable health and safety standards established by the Federal Communications Commission. 14. Based upon the best radio frequency technology available to T-Mobile at this time, it is my professional opinion that the proposed project is at the minimum height needed to ensure adequate PCS service to area residents and businesses in accordance with our system specifications. Purpose I have reviewed the information pertinent to the proposed installation in a monopole located at 723 Osgood Street, North Andover, In order to determine regulatory compliance, theoretical calculations of maximal radio frequency fields have been prepared. In addition,radio frequency measurements in the vicinity of the proposed facility and surrounding area have been obtained. The physical conditions are that T-Mobile panel antennas are proposed to be mounted at a centerline of 77 feet above ground level in a monopole. The calculated and measured values of power density are presented as a percent of current Maximum Permissible Exposures (%MPE), as adopted by the Federal Communications Commission and the Massachusetts Department of Public Health,with 100%signifying an acceptable amount. Summary The measured existing ambient radio frequency field levels indicate the maximum level to be negligible since there are no know RF transmitter in the area. The theoretical radio frequency field calculation data for the addition of the proposed T-Mobile transmissions, indicate a maximal potential increase above the ambient radio frequency levels at ground level to be much less than one-tenth of one percent of the current radio frequency exposure standards. This result means that the site will still be well within Federal and State limits for radio frequency exposure after the T-Mobile telecommunications antennas are installed. Based on my experience with personal wireless service facilities, and the theoretical radio frequency fields I have calculated and measured, it is my professional opinion that this facility would continue to comply with all regulatory limits for radio frequency exposure to members of the public. Measurement Protocol RF field measurements were obtained on June 13, 2006, using accepted scientific procedures as outlined by ANSI/IEEE, American National Standard, recommended practice for the measurement of potential electromagnetic fields. The temperature was 81 degrees Fahrenheit with overcast skies. The measuring equipment included a Narda model 8715 Electromagnetic Radiation Meter with model B8742D Broadband Isotropic Probe. The probe utilized measures a mixed frequency environment due to its broadband or wide frequency range. The Narda model B8742D probe provides a meter read out in%MPE(percent FCC 1997 Maximum Permissible Exposure) for members of the general public within the frequency band of 300kHz to 3GHz. The measurements were obtained from locations measuring approximately 200, 500, and 1,000 feet from the proposed antenna installation. Measurements were taken from the ground plane up to a height of six feet above ground level. Additionally, the highest reading during the spatial average measurements was recorded as the"peak"reading.The results are in the attached table. "For this RF exposure analysis,the readings were multiplied by 1.24 to be conservative. Theoretical RF Field Calculation These calculations are based on "worst case" estimates. That is, the estimates assume 100%use of all transmitters simultaneously. Additionally,the calculations make the assumption that the surrounding area is a flat plain. The resultant values are therefore conservative in that they over predict actual resultant power densities. The calculations are based on the following information: Effective Radiated Power(ERP), Antenna height, Antenna vertical radiation patterns, and Antenna pattern signal loss and gain. The theoretical power density calculations for T-Mobile are listed in the attachment for each three degree increment of depression angle; 90 degrees being straight down at the base of the monopole, and 0 degrees being straight out from the antenna. The values have been calculated for a height of six feet above ground level in accordance with regulatory rational. The summation of the theoretical percent Maximum Permissible Exposure calculations for T-Mobile are depicted in figure 2 plotted against linear distance from the base of the monopole. In addition to the six foot height, and depicted for reference only, values have been plotted for a height of sixteen feet above ground level for comparison with a typical two-story building. RF Exposure Limits and Guidelines The RF exposure limits adopted by the FCC are a combination of the standards published by the American National Standards Institute(ANSI) and the National Council on Radiation Protection and Measurement(NCRP). Also applicable are those published by the Massachusetts Department of Public Health. At frequencies licensed to personal wireless services providers by the FCC,the values of the aforementioned standards are comparable. The RF exposure limits are divided into two categories: Controlled/Occupational areas(those restricted to access by RF workers only) and Uncontrolled/Public areas(those areas unrestricted for public access). Listed below are the applicable RF exposure limits for uncontrolled(public)areas as they pertain to the operating frequency bands of the personal wireless services industry. Frequency Bands Maximum Permissible Exposures_ 300-1500 MHz f/ 1.5 in. uW/cm 1500-100,000 MHz 1000 UW/CM2 Conclusion The measured existing ambient RF field levels indicate the maximum level to be much less than the current Federal and State maximum permissible exposure limits. The theoretical RF field data calculations for the addition of the proposed T-Mobile transmission indicate a maximal potential increase above ambient RF levels at ground level to be much less than one-tenth of one percent of the current RF exposure standards. This result means the site will still be well within Federal and State limits for RF exposure after the T-Mobile telecommunications antennas are installed. The number and duration of calls passing through personal wireless services facilities cannot be accurately predicted. Thus, in order to estimate the highest RF fields possible from operation of these installations, the maximal amount of usage was considered. Even in this "worst case" scenario the resultant increase in RF field levels were far below established levels considered to be safe. Based on my years of experience with personal wireless service facilities, and the theoretical RF fields I have calculated and measured, it is my professional opinion that this facility would continue to comply with all regulatory limits for RF exposure to members of the public. The proposed T -Mobile installation consists of three (3) Ericsson RBS 2106 outdoor high-capacity equipment cabinets. These are free-standing equipment enclosures with a self-contained environmental control system. During standard operating conditions, the maximum acoustical noise levels of this equipment are created by the air - conditioner compressor and fan which are built into the cabinet and mounted on the inside of the cabinet door. The frequency of this type of acoustical noise is approximately 30-60 cycles per second (Hz). Technical specifications from Ericsson indicate that the maximum acoustical noise level of a single RBS 2106 cabinet, at a distance of 3 meters (9.8 feet) from the front, side, and rear of the cabinet is 55 dB(A), 45 dB(A), and 46 dB(A) respectively. The proposed power/telco demarcation cabinet and battery back-up cabinet do not produce any discemable noise. In addition, the proposed T -Mobile panel antennas do not produce noise during operation. 5. The existing equipment compound currently has two (2) equipment shelters that are operated by other wireless carriers. It will be assumed, for the purpose of this affidavit, that the air conditioning units on those shelters have a similar acoustic output as the proposed T Mobile Ericsson radio base station cabinets (55 dB(A)). 6. Using the Ericsson equipment acoustical noise data, I have estimated the proposed maximum acoustical noise level at the fence line of the existing equipment compound and at the nearest structure to the southeast. The estimated proposed maximum equipment noise level, including the existing equipment shelters, measured at the compound fence will be approximately 58 dB(A) for three (3) front -facing cabinets operating simultaneously. This noise level takes into account that the existing stockade fence will attenuate the sound by approximately 2 dB(A). It is essentially a worst-case estimate of the maximum acoustical noise levels on a level plane and is equivalent to that of a person breathing normally. Typical ambient nighttime noise level in a rural residential neighborhood is approximately 37 dB(A). The introduction of a noise source of 30 dB(A) will increase the typical ambient nighttime noise level by approximately 1 dB(A). Based on published information conceming sound levels and human physiology, the estimated maximum increase of 1 dB(A) in nighttime acoustical noise levels at the nearest structure would be barely perceptible by the human ear. 7. The North Andover Zoning By -Law Section 8.9 (4)(e)(iv) states that 'ground -mounted equipment for wireless service facilities shall not generate acoustic noise in excess of 50 dB(A) at the security barrier' (existing equipment compound). Therefore, based on the above information, the proposed installation will not conform to the requirements of the Town of North Andover zoning By -Law as the proposed noise level will exceed 50 dB(A) at the equipment enclosure. However, given that the existing equipment enclosure is located in a densely wooded area approximately 350 feet from the nearest building and approximately 728 feet from the nearest property line, it is my professional opinion that a more meaningful location to estimate the predicted maximum acoustical noise level would be the closest building.
