The Massachusetts Department of Environmental Protection, has confirmed that the contamination was the direct and proximate result of a leak from an underground tank on the property of Peter and Kerry Breen located at 770 Boxford Street,North Andover, which seeped into the local water table. It is alleged that the North Andover Fire Department stood by as the underground tank was dug up and removed. Nevertheless,in spite of its knowledge of this removal, the fire department could have, but did not, ascertain that the Breens had obtained D.E.P. permission to remove the tank. Further, they were aware that the work was done bythe Breen and not by an approved and licensed hazardous materials removal company. It is therefore alleged that the Town of North Andover is at least partially responsible for the contamination of the Tone's water. Kindly turn this letter over to legal counsel for the Town of North Andover so that I may deal with them directly. B.
