results provided by the ToProtection,as well as test
Tone's experts, These documents indicate that the contamination,
which includes MTBE,was the direct and proximate result of a leak from an underground
tank on your property which seeped into the local water table.
Please turn this letter over to your homeowners,insurer as well as any other
insurer covering your property and business, so that I may deal with them directly.

Dear Sir/Madam:
This office represents Joaquin and Dionne Torre,owners of 742 Boxford.Street,
North Andover, in the matter of ground water contamination under their property. The
Massachusetts Department of Environmental Protection,has confirmed that the
contamination was the direct and proximate result of a leak from an underground tank on
the property of Peter and Kerry Breen located at 770 Boxford Street,North Andover,
which seeped into the local water table.
It is alleged that the North Andover Fire Department stood by as the underground
tank was dug up and removed. Nevertheless,in spite of its knowledge of this removal,
the fire department could have,but did not, ascertain that the Breens had obtained D.E.P.
permission to remove the tank. Further,they were aware that the work was done bythe
Breen and not by an approved and licensed hazardous materials removal company. It is
therefore alleged that the Town of North Andover is at least partially responsible for the
contamination of the Tone's water.
Kindly turn this letter over to legal counsel for the Town of North Andover so that
I may deal with them directly.

Boxford Street,North Andover,has been affected by underground water contamination
allegedly originating from Peter and Kerry Breen's property at 770 Boxford Street,North
Andover, MA 01845. Specifically,MTBE has been found in tests of my clients' well
water.
The purpose of this letter is to request that I be provided an update on the status of
the D.E.P.'s investigation and action concerning the Breens' contamination of the water
table below their land and in the area surrounding their land.
