Declaration,and the cost of such removal shall be the obligation of the Owners of Lots Z,3
and 4.
In the event that the Owners of Lots 2,3 and 4or
( any of them)shall desire to access Lot 2
and/or Lot 3 directly from Great Pond Road across a portion of the Lot 1 Easement Area,the
Owners of Lots 2,3 and 4(or any of them)shall request permission from the Owner of Lot 1 for
such use, and the Owner of Lot 1 shall have the right to grant or withhold consent to such use at
her absolute discretion,without recourse by the Owners of Lots 2,3 and 4.
' The Owners of Lots 2,3 and 4 shall pay all real estate taxes on the Lot 1 Easement Area.The
Owner of Lot 1 shall maintain the Lot 1 Easement Area.
' The Land Use and Landscape Easement(and all the provisions thereof as set forth in this
heirs,devisees,executors,administrators,assigns and successors Declaration)shall run with the land and be binding upon the Owners of Lots 2,3 and 4 and their

' replace utility pipes, wires and conduits to serve Lot 4. Lot 3 is subject to the perpetual easement
and right of the Owner of Lot 4 shown on the Site Plan to use the"Utility Easement”in the
northeast corner of Lot 3 as shown on the Site Plan to install, use,maintain,repair and replace
' utility pipes, wires and conduits to serve Lot 4.
B. Common Driveway Easement
' 1. Driveway Easement. The Owner of Lot l and the Owner of Lots 2,3 and 4
hereby establish the perpetual,non-exclusive right and easement to pass and
repass by vehicular traffic or otherwise and to install and maintain utilities within
the land area shown on the Sketch Plan recorded herewith and entitled"Utility
and Access Easements"incidental to the use of, and appurtenant to Lots 2,3 and
4 shown on the Site Plan. A pervious driveway shall provide access to Lot 2 as
' shown on the Site Pian,and a separate pervious driveway shall provide access to
Lots 3 and 4 as shown on the Site Plan.
' 2. Maintenance. The Owners of Lots 2,3 and 4 shall maintain the driveways in
good order and repair and shall be responsible for the removal of ice and snow
("Maintenance Obligations"). The snow shall be plowed to the outside edge of
' the driveways. The Owner of Lot 2 shall be solely responsible for all expenses
associated with the Maintenance Obligations for the pervious driveway providing
access to Lot 2.The Owner of Lot 3 shall be responsible for one third of all
' expenses associated with the Maintenance Obligations for the pervious driveway
providing access to Lots 3 and 4,and the Owner of Lot 4 shall be responsible for
two thirds of all expenses associated with the Maintenance Obligations for the
pervious driveway providing access to Lots 3 and 4.
' C. Miscellaneous
(a) The Owner of Lot 1 and the Owner of Lots 2,3 and 4 intend that the
provisions of this instrument shall run with the land;
(b) This instrument is intended to take effect as an instrument under seal and
shall be construed and interpreted in accordance with the laws of the
Commonwealth of Massachusetts.
' (c) Bindin ffect. The provisions of this Declaration shall run with the land
and bind said Lots 1,2,3 and 4,and shall remain in force for a period of
thirty(30)years from the date this Declaration is recorded;and thereafter
for further periods of not more than twenty(20)years at a time if extended
in accordance with law,but this provision shall not apply to the easements
1 created hereby which shall be perpetual.

Special Permit Application
Great Pond Road—Lot 3
North Andover, Massachusetts

Project t Summary
' The subject property, consisting of approximately 93,661 ±square feet (2.17 Ac), is part of a
partially constructed 4-lot subdivision located on the southerly sideline of Great Pond Road in
the vicinity of #777. Work conducted on the subdivision to date includes construction of a
crushed stone common driveway with a box culvert, wetland replication area, utility installation
and vegetation clearing in the house location. Extent of completed site work, obtained through
an As-built survey conducted in 2002, is shown on the accompanying plan and substantially
' conforms to the design specifications. Work done within the Conservation Commission's
jurisdiction has been completed in compliance with the Order of Conditions, with the exception
of construction of the individual lots. The site is also located within the Town of North Andover
' Watershed Protection District and further contains identified wetland resource areas. As such,
any work conducted within the District on this site requires the issuance of a Watershed Special
Permit.
The North Andover Planning Board previously issued a Watershed Special Permit (see
attached) for house construction at Lot 3 Great Pond Road in September of 1999 to the original
owner, SJJ Trust. That permit has since expired without the house and driveway being
constructed. Consequently, the new owner, Charles and Susan Papalia , is seeking to reapply
for the Watershed Special permit in order to complete the house and driveway.
The Watershed Protection District contains a non-disturbance zone and non-discharge zone
conducted in the vicinity of wetland resource areas. For this lot, the non-disturbance zone
setback distance is a 100-foot buffer zone from wetland resource areas and the non-discharge
' zone is a 325-foot buffer zone from Lake Cochichewick. The proposed driveway and utilities
designed to service the home will require work within the non-discharge zone. Lots 3 and 4 will
share a common driveway. The single family home design will result in very little new
' impervious area, will retain approximately 85% of the site in a natural state, and locates the
house more than 100 feet from identified resource areas. Dual goals of preserving site
characteristics and long-term protection of resource areas will be accomplished by incorporating
a crushed stone driveway designed to blend in with existing contours, avoidance of mature tree
removal, use of extended setbacks from identified resource areas and natural vegetation into
the project design. The proposed home will be serviced by municipal sewer and water utilities,
thereby avoiding grading disturbances that would otherwise be created by septic system
installation. Further, surface water quality will be protected through the following features: use
of erosion controls along existing wetland resource area boundaries, recharging the roof runoff
back into the ground and constructing the driveway out of pervious materials (primarily crushed
' stone, with the exception of porous concrete pavement at the home).

The proposed driveway design was reviewed by Chief Dolan and Lieutenant Melinikas of the
North Andover Fire Department during the initial phase of the project (see attached memo,
dated 5/21/99). This review resulted in several minor additions to the plan to improve the
access and fire protection of the home. A fire protection sprinkler system and a stone street
address marker, among other features will be installed as part of the North Andover Fire
Department's recommendations. The common driveway width of 12 feet is minimized to the
extent acceptable to the Fire Department. All fire protection features approved at the time of
the Fire Department's review have been retained in the current project design.
Therefore, based on the information described herein and as shown on the accompanying plan
and documents, it is Hayes Engineering, Inc.'s opinion that the project in lot 3 can be granted
the Special Permit requested without any significant adverse impacts to the Town of North

resource areas as shown on the approved Watershed Special Plan. Said plan shall be submitted to the Town
Planner for review to verify that the setback limits under the special permit have been met.
4) Prior to verification of a Certificate of Occupancy:
a) No pesticides, fertilizers or chemicals shall be used in lawn care or maintenance. TheaPP licant shall

PART I - GENERAL
' QUALITY ASSURANCE
1 A. The applicant and contractors shall be responsible for reviewing, and taking steps to meet, all
requirements contained in the Order of Conditions issued by the Conservation Commission
for this project.
' B. Follow siltation control methods as outlined below, shown on the plan and as directed by
Engineer.
' C. Operations will be restricted to areas of work indicated on drawings (and clearly marked on
site) and area which must be entered for construction of temporary or permanent facilities.
D. Siltation controls shall be checked frequently and maintained in functioning condition
throughout the duration of activities so as to prevent encroachment upon adjacent resource
areas. If siltation control materials are washed away during construction, contact the
' Conservation Commission and Engineer, and remove materials and silt accumulations from
fouled areas as directed.
' E. Conservation Commission has authority to limit surface area of erodible earth material
exposed by clearing and grubbing, excavation, borrow and fill operations, and to direct
immediate permanent or temporary pollution control measures to prevent contamination of
wetlands, including construction of temporary berms, sediment basins, sediment traps, slope
drains and use of temporary mulches, mats or other control devices or methods as
necessary to control erosion.
' F. Temporary stockpiles of soil shall be located in an upland area (not to exceed the limit of
construction as demarcated by siltation fencing shown on the plan) and be surrounded with
an erosion control barrier to prevent sediments from encroaching upon adjacent resource
' areas.
PART 2 — EROSION CONTROL BARRIERS

' 2. When standard strength filter fabric is used, the fabric shall be reinforced by wire
fence. Wire fence reinforcement for filter fences shall be a minimum of 36 inches in
height, a minimum of 14 gauge and a maximum mesh spacing of 6 inches.
B. INSTALLATION
1. Location
' Install erosion controls prior to commencement of clearing and construction activities
along limits of work area as specified on plan, surrounding bases of all deposits of stored
fill material outside of disturbed area, and where directed by the Conservation
' Commission. Siltation control materials shall be installed and maintained at all catch
basins during roadway construction so as to prevent sediments from entering into the
drainage system
' 2. Barrier Installment
A. Hay Bales
' Hay bales, if specified, will be embedded in the soil a minimum of 4 inches. Hold
old
bales in place with two 2-inch by 2-inch by 3.5-foot stakes so that each bale is

butted tightly against adjoining bale, thereby precluding short-circuiting of erosion
' check. The first stake in each bale shall be driven toward the previously-laid bale
to push the bales together.
' B. Filter Fences
I. Excavate trench along post line 6 inches wide and 6 inches deep on the upslope
' side of the barrier.
2. Space posts a maximum of 10 feet apart and drive them a minimum of 12 inches
' into the ground. The posts should not be greater than 36 inches above the ground.
3. Fasten wire mesh support fence securely to upslope side of the posts using heavy-
duty wire staples at least 1-inch long, tie wires or hog rings. Wire shall extend into
trench a minimum of 2 inches, and shall not extend above the ground more than 36
inches.
' 4. Staple, wire or tie the standard strength filter fabric to the wire fence. The fabric
shall extend 8 inches into the trench and shall not extend more than 36 inches
above the ground. Do not staple filter fabric to existing trees.
' 5. When extra-strength filter fabric or burlap and closer post spacing is used, wire
mesh support may be eliminated, in which case the filter fabric is stapled, wired or
' tied directly to the posts with all other provisions of item 4 applying.
6. Backfill trench and compact soil over filter fabric.
' 7. Provide wildlife passage corridor with baffle for every 100' of fence installation.
Passage shall be 18" wide between stakes, and baffle shall be installed parallel to
fence, offset 18" from fence line, and overlapping passage by 48" on either side of
' break.
' PART 3 — POLLUTION CONTROL MEASURES
A. Discharge silt-laden water from excavations onto filter fabric mat and/or baled hay or
' straw sediment traps to ensure that only sediment-free water is returned to wetland
areas. Sediment traps, if needed, should be constructed by standard methods. Siltation
control materials shall be installed and maintained at all catch basins during roadway
construction so as to prevent sediments from entering into the drainage system.
B. Do not place soil backfill material adjacent to resource areas without proper siltation
controls or otherwise preventing the soil from washing away by high water or runoff.
C. Do not dump any materials into any streams, wetlands, surface waters or unspecified
locations.
' D. Do not dispose of trees, brush, debris, paints, chemicals asphalt products, concrete
curing compounds, fuels, lubricants, insecticides,wash water from concrete trucks or

hydroseeders, or any other pollutant into any streams, wetlands, surface waters or
' natural or man-made channels leading thereto, or unspecified locations.
E. No disturbance or alteration of any kind allowed between the specified limit of work and
' the wetlands.
F. Prevent any operation of equipment outside the designated limit of work (erosion control
' barrier).
G. Prevent indiscriminate, arbitrary or capricious operation of equipment in surface waters.
PART 4—STABILIZATION TECHNIQUES
' A. Protecting and Minimizing Exposed Areas
Building construction activities will leave bare earth open to erosion. Steps shall be taken
' to minimize this area of exposure by preserving existing vegetation and providing soil
stabilization. Equipment and trucks shall be routed only over the existing driveway and
workers shall minimize foot traffic in vegetated areas adjacent to the work area as much
' as possible. During site work, utilization of stabilization techniques are necessary for
controlling erosion on exposed areas, including grading, seeding and otherwise
stabilizing the areas.
' B. Sediment And Erosion Control
Prior to any construction occurring adjacent to identified resource areas (shown on the
' plan and/or marked in the field, proper erosion and siltation barriers will be installed so
that throughout and until completion of construction, those areas will be afforded
maximum protection. Temporary stockpiles of soil shall be surrounded with an erosion
control barrier to prevent sediments from exiting the subject property. All erosion control
barriers are to be maintained and periodically inspected until areas of bare soil are
stabilized to ensure that they are in functioning condition. Mirafi (or equivalent fabric)
' fencing shall be installed upgradient of wetlands as shown on the above-mentioned plan.
Any accumulations of sediments present along erosion control barriers shall be removed
as soon as possible after deposition in order to ensure the effectiveness of all
' sedimentation controls.
C. Vegetational Covers
' 1. Temporary Vegetational Cover
Any area proposed for removal of vegetation where soil will be exposed for more than 10
'
days
shall be mulched or otherwise treated to prevent erosion. On sediment-producing
areas in the buffer zone, where the period of exposure will be more than 30 days, the
' following procedures should be followed for a cover of annual rye. When bare soils are
not completely graded and vegetated by September 30 of any year, winter rye shall be
planted as specified in table and mulched with three (3) inches of hay or straw.

To reduce damages from the potential incidence of sedimentation and runoff to other
properties, and to avoid erosion on the site itself, a permanent type cover shall be
established in disturbed areas located adjacent to resource areas immediately,upon
completion of grading. Seeding herbaceous cover is usually the most economical and
practical way to stabilize any large area. For this site, all disturbed areas will be seeded
during the period of August 1 to October 1; or in spring by May 15 with a commercial
' lawn mixture utilizing standard landscape methods and as recommended by the seed
manufacturer. Grass sod or landscape plantings may be used instead of seed, if
preferred.
' The following procedures are suggested to establish a stable, permanent cover.
a. Shape and smooth the surface to the desired grade.
' b. Lime according to soil test pH 6.5.
C. Fertilize, if necessary, according to soil test.
d. Work up a seedbed 3" to 6 deep, incorporating the lime into the soil.
' e. Cultipack or roll the soil surface before and after seeding when slope conditions
permit.

Switchgrass seed requires a chilling period of three (3) weeks or longer at
' common household refrigerator temperatures, except when seeded in late fall or
winter. Regular mowing should not be practiced. Very slow growing the first

Cape and the Islands only. May be killed by severe winters, and should not be
