NAME: William &Sheryl Appleton DATE: 11/12/98 ADDRESS: 815 Johnson St. PETITION: 041-98 North Andover, MA 01845 HEARINGS: 10/13/98,& 11/10/98 The Board of Appeals held a regular meeting on Tuesday evening, November 10, 1998, upon the application of William &Sheryl Appleton,815 Johnson St., North Andover, M& requesting a Variance from the requirements of Section 7, paragraph 7.3,of Table 2,within the R-2 Zoning District,for relief of front setback, and for a Variance from the requirements of Section 9, paragraph 9.2(3), relative to an increase in area of non-conforming use more than 25%of the original use and for a Special Permit from the requirements of Section 4.121 of paragraph 17 to construct a family suite in an existing carriage house. The following members were present: William J. Sullivan, Walter F. Soule, Raymond,Vivenzio, Scott Karpinski, George Earley. The hearing was advertised in the Lawrence Tribune on 9/29/98& 10/6/98 and all abutters were notified by regular mail. Upon a motion made by Walter F. Soule, and seconded by Raymond Vivenzio,the Board voted to GRANT a Special Permit from relief of Section 9, paragraph 9.2(3)for relief of an increase in area of non-conforming use of 1305 sq. ft. which is more than 25%or the original use of the existing dwelling of 3126 sq.ft., and to GRANT a Special Permit from the requirements of Section 4.121,paragraph 17,to construct a family suite(with restrictions as stated in the bylaw)in an existing carriage house, and that the family suite will not be more detrimental to the area. Voting in favor: William J Sullivan,Walter F. Soule, Raymond Vivenzio, Scott Karpinski, George Earley. Upon a motion made by Raymond Vivenzio and seconded by Walter F. Soule,the Board voted to GRANT a Variance from the requirements from Section 7, paragraph 7.3 for relief of front setback of.9 feet-(9 tenth of a foot) to allow a family suite in an existing carriage house on a pre-existing structure on a non-conforming lot. Voting in favor: William J. Sullivan,Walter F. Soule, Raymond Vivenzio, Scott Karpinski and George Earley. The petitioner has satisfied the provision of Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide by all applicable local, state and federal and building codes and regulations, prior to the issuance of a building permit as requested by the Building Commission. I am an only child and my parents currently reside in Northampton, Massachusetts. My parents are getting along in years and my mother has chronic hepatitis. She has periods when she needs assistance that is becoming difficult for my father to provide. It would be very comforting for them and us if they could live with us so that we could help care for my mother. We feel fortunate that we have the space to accommodate their needs.
