TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS BOARD OF APPEALS NOTICE OF DECISION Property: 2-4 Johnson St Center Realty Trust Date: October 21, 1996 2-4 Johnson St Petition: 034-96 North Andover MA 01845 Date of Hearing: 10/8/96 The Board of Appeals held a regular meeting on Tuesday evening, October 8, 1996 upon the petition of 2-4 Johnson Street requesting a Special Permit under Section 9, Paragraph 9.2 of the Zoning By Laws as to permit the extending of additional space to the restaurant capacity in a preexisting non-conforming structure. The following members were present and voting: William Sullivan, Raymond Vivenzio, John Pallone, Joseph Faris, and Ellen McIntyre. The hearing was advertised in the North Andover Citizen on 9/24 & 10/1/96, all abutter were notified my regular mail. Upon a motion by Joseph Faris seconded by Raymond Vivenzio, the Board voted to GRANT the Special Permit for extending of additional space to the restaurant capacity in a pre-existing non-conforming structure. Voting members in favor of the petition were: William Sullivan, Raymond Vivenzio, John Pallone, Joseph Faris, & Ellen McIntyre. The Board finds that the applicant has satisfied the provisions of Section 9, Paragraph 9.2 of the Zoning Bylaw and that such change, extension or alteration shall not be substantially more detrimental than the existing non-conforming structure to the neighborhood. Note: The granting of the Variance and Special Permit as requested by the applicant does not necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local, state and federal building codes and regulations, prior to the issuance of a building permit as required by the Building Commissioner. Deed recorded in the Registry of Deeds in Book Z Page Land Court Certificate No. Book Page The principal points upon which I base my application are as follows : (must be stated in detail) The Top of the Scales Restaurant would like to have an additional dining room constructed on top of the existing garage. The building footprint would be unchanged. The proposed plan includes a new roof,a new emergency stairway in back,and a renovated face of the existing garage,which would continue to be used only for storage. The proposed renovation is intended to greatly improve the appearance of this historic building. The design has been approved by the Old Center Historic District Commision.
