Dear Mr. Long:
The North Andover Planning Board held a public hearing on June
29, 1993 in the Senior Center behind the Town Building upon the
application of Dr. Sudarshan Chatterjee, 42 Jay Road, North
Andover, requesting site plan approval under Section 8.3 of the
North Andover Zoning Bylaw. The legal notice was published in the
North Andover Citizen on June 3 and June 10, 1993 and all parties
of interest were properly notified. The following members were
present: John Simons, Acting Chairman, Joseph, Mahoney, Clerk,
Richard Rowen, John Draper and George Perna, Associate Member.
The petitioner was requesting site plan approval for the
construction of a parking area consisting of greater that five (5)
parking spaces. The premises affected is located at 23-240 Sutton
Street in an Industrial-S (I-S) Zoning District.
Mr. Draper read the legal notice to open the public hearing.
Mr. James Bourgeois, Thomas Neve Associates, gave the Board an
overview of the site. The Board was asked to look at 323 Sutton
Street and 240 Sutton Street at the same time.
1. All storm drainage drains to catch basins, no storm run-
off
2 . Granite curb radius _onto Sutton Street
3 . Low ground signs - in and out
4 . 17 spaces for medical office - 2 spaces required for
residence 5 spaces would be required if there was a
general office use of the existing home
Mr. Bourgeois to confirm that no residential -zones abut
property.
Landscape Plan:
1. Existing screening to be complemented
2 . Plant maple trees along Charles Street
3 . Minimal screening along adjacent parcel because of I-S
Zone.

Mr. Draper questioned if there was a need for granite curbing
along the entire front of Sutton Street.
Landscaping as shown along Charles Street must be changed
and/or removed as per owner of Charles Street. Pave or grass the
area along Charles Street.
Curb should be extended around corner of Charles Street, with
granite curbing across the front.
240 Sutton Street to be used for parking lot and landscaping,
no further plans for the use of the existing residence.
Dr. Chatterjee will own both parcels, however a certain number
of spaces will be designated and an easement granted for use of
spaces by 232 Sutton Street solely.
John Leeman had questions regarding drainage calculations and
property boundary.
On a motion by Mr. Draper, seconded by Mr. Perna the Board
voted to continue the public hearing on 232 Sutton Street and 240
Sutton Street.
Ms. Bradley to draft a decision by the next meeting.
On July 20, 1993 the Planning Board held a regular meeting.
The following members were present: Richard Nardella, Chairman,
Joseph Mahoney, Clerk, Richard Rowen and John Draper. John Simons
was absent.
(Mr. Mahoney sat in on all meetings and will vote because only
four members were present. )
Mr. James Bourgeois, Thomas E. Neve Associates, told the Board
that the parking exceeded the requirements of the Zoning Bylaw. A
walkway out to Charles Street to be eliminated. The applicant to
take care of landscaping along Charles Street. (A letter is needed
from Mr. Matses first. ) This will be added to the decision.
Granite curbing is shown along Sutton Street.
Ms. Bradley said that a 6' grass strip with plantings not
provided around the entire site.
Mr. Draper said that the landscape looks okay. He wanted
trees as per Zoning Bylaw along adjacent Nicolosi property.
Mr. Nardella asked if there were any permanent chain link
fence. Mr. Bourgeois asked, no - chain link put up by Matses, no
permanent fence planned.

Mr. Nardella asked how many parking spaces there would be.
On a motion by Mr. Rowen, seconded by Mr. Draper the Board
moved to close the public hearing on 232 Sutton Street.
On a motion by Mr. Draper, seconded by Mr. Rowen the Board
moved to close the public hearing on 240 Sutton Street.
On a motion by Mr. Rowen, seconded by Mr. Draper the Board
voted to approve the modification on 232 Sutton Street as modified.
On a motion by Mr. Draper, seconded by Mr. Rowen the Board
voted to approve 240 Sutton.
Attached are those conditions.

Site Plan Review Conditional Approval
The Planning Board makes the following findings regarding this
Site Plan Review for the construction of the parking area as
required by Section 8. 3 of the North Andover Zoning Bylaws:
FINDINGS OF FACT:
1. The proposed use and site design for this lot are
appropriate, as the site is zoned Industrial - S.
2 . Adequate vehicular and pedestrian access into the site has
been provided with the adherence to the approved plans.
3 . The plan as shown and revised, meets the
requirements of section 8.4 of the Zoning Bylaws, with the
addition of the enclosed conditions.
4 . The site drainage system is designed in accordance with the
Town Bylaw requirements.
5. The applicant has met the requirements of the Town for Site
Plan Review as stated in Section 8.3 of the Zoning Bylaw.
6. Adequate and appropriate facilities will be provided for the
proper operation of the proposed use.
Finally, the Planning Board finds that this modification
generally complies with the Town of North Andover Zoning Bylaw
requirements as listed in section 8. 35 but requires conditions in
order to be fully in compliance.
Therefore, in order to fully comply with the approval necessary
to construct the facility as specified in the Site Plan Review
application before us, the Planning Board hereby grants an
approval to the applicant provided the following conditions are
met:
SPECIAL CONDITIONS:
1. Prior to any construction:
a. The final plans must be reviewed by the Town Planner.
These plans must be revised as follows:
i. Along the north east boundary of the property,
along the Nicolosi property line, there must be
planted at least one tree for every thirty (30)
linear feet. These trees must be at least 3.5
inches in diameter at a height of at least four
feet above the ground at the time of planting and

shall be of a species that is approved by the Tree
Warden.
b. The Town Planner and/or the Tree Warden must be
contacted prior to any cutting and/or removal
vegetation on-site. The Planner and/or Tree Warden
will walk the site with the applicant to identify any
trees and/or vegetation that may be preserved.
C. A bond in the amount of $5000.00 shall be posted for
the purpose of insuring that a final As-Built plan
showing location of all on site utilities, structures,
curb cuts, parking spaces and drainage facilities be
submitted and to insure that the Landscaping is
completed as shown on the Plan. This bond shall be in
the form of a check made out to the Town of North
Andover. This check will then be deposited into an
interest bearing escrow account. (FORM G is available
in the Planning Office)
2 . Prior to FORM U verification (Building Permit Issuance) :
a. This decision shall be recorded at the Essex North
Registry of Deeds and a recorded copy delivered to the
Planning Staff.
b. A copy of the recorded easement referred to in
Condition 8 must be submitted to the Planning Office.
C. The applicant shall place erosion control measures on
site as directed by the Town Planner.
d. The North Andover Division of Public Works shall
approve all plans. Any changes to the plans approved by
the Planning Board shall be reviewed by the Town
Planner. Any changes which the Town Planner may deem as
major shall be approved by the Planning Board.
3 . The site shall be reviewed by the Planning Staff. Any
screening as may be reasonably required by the Planning
Staff and/or Tree Warden will be added at the applicant's
expense.
4. A final _ as-built showing the location of all on site
utilities, structures, curb cuts, parking spaces and
drainage facilities must be submitted to and approved by the
Division of Public Works.
5. All artificial lighting used to illuminate the site shall be
approved by the Planning Staff. All lighting shall have
underground wiring and shall be so arranged that all direct
rays from such lighting falls entirely within the site and

shall be shielded or recessed so as not to shine upon
abutting properties or streets.
The site shall be reviewed by the Planning Staff. Any
changes to the approved lighting plan as may be reasonably
required by the Planning Staff shall be made at the owners
expense
6. Granite curbing must be constructed along Sutton Street as
shown on the referenced plan.
7. Any Plants, Trees or Shrubs that have been incorporated
into the Landscaping Plan approved in this decision, that
die within one year from the date of this approval, shall be
replaced by the owner.
8. At least four (4) and one half spaces created in the parking
lot must be provided to the adjacent lot, noted as Parcel 6
on the referenced plans, through a permanent easement.
These spaces must be clearly marked and be reserved solely
for use by the adjacent medical office.
Two (2) parking spaces must be reserved for use by the
existing residence and marked as such.
This conditional approval does not include approval for any
parking spaces that may be needed in the future for use of
the residential structure as an office. Any change in use
will require additional review by the Planning Board.
9. Access to the adjacent parcel of land will be provided
across this parcel as part of a permanent easement granted
by Parcel 5 to Parcel 6.
10. The owner of the adjacent building will be required to
maintain the parking spaces that have been granted to
him/her. This includes the plowing and removal of snow and
ice as needed.
11. The contractor shall contact Dig Safe at least 72 hours
prior to commencing any excavation.
12 . Gas, Telephone, Cable and Electric utilities shall be
installed as specified by the respective utility companies.
13 . All catch basins shall be protected and maintained with hay
bales to prevent siltation into the drain lines during
construction.
14. No open burning shall be done except as is permitted during
burning season under the Fire Department regulations.

15. No underground fuel storage shall be installed except as may
be allowed by Town Regulations.
16. The provisions of this conditional approval shall apply to
and be binding upon the applicant, it's employees and all
successors and assigns in interest or control.
17. Any revisions to this development must be submitted to the
Town Planner for review. This conditional approval is for
the construction of a parking lot only. Any change in the
use of the existing house from residential to any other use
will require subsequent review by the Planning Board.

Dear Mr. Long:
The North Andover Planning Board held a public hearing on
November 30, 1993 in the Senior Center behind the Town Building
upon the application of Dr. Sudarshan Chatterjee, 42 Jay Road,
North Andover, MA. , requesting Site Plan Review approval for
238/240 Sutton Street, under Section 8.3 of the North Andover
Zoning Bylaw. The legal notice duly advertised in the Lawrence
Eagle Tribune on November 15 and November 22, 1993 and all parties
in interest were properly notified. The following members were
present: Richard Nardella, Chairman, Joseph Mahoney, Clerk,
Richard Rowen and John Daghlian, Associate Member. John Simons and
John Draper were absent.
The petitioner was requesting Site Plan Review approval to
allow the conversion of a residential structure to be used as
professional offices.
Mr. Mahoney read the legal notice to open the public hearing.
The following information was provided to the Board:
professional office building use for a cardiologist to
run patient street tests.
- no exterior change other than handicap ramp
landscaping plan to soften appearance of parking lot
interior unoccupied attic area/ no plans to use it
Zoning Bylaw differentiates between clinics and professional
offices, (i.e. dentist) and it will be a 2 person operation. The
question is the intensity of use. There will be two small suites,
less than 1, 000 sq. ft.

Mr. Nicetta stated that there were a number of problems.
1. change of use issue and non-conformance to Mass State
Building Code
2 . Is it a medical center? If so, it falls under State
Building Inspector's jurisdiction
3 . ZBA determination on the use is necessary which will
affect the number of parking spaces required.
Mr. Kenneth Crouch questioned snow removal efforts and the
ability to maintain the parking spaces.
On December 7, 1993, the Planning Board held a regular
meeting. The following members were present: Richard Nardella,
Chairman, Joseph Mahoney, Clerk, Richard Rowen and John Daghlian,
Associate Member. John Simons and John Draper were absent.
Robert Nicetta, Building Inspector, told the Board that the
structure needs to be reviewed. There is a change in use,
therefore building must be brought up to current building codes.
Mr. James Bourgeois requested continuation, in the meantime
address structure issues.
Mr. Nardella asked the Building Inspector and the applicant to
discuss the building use issues and parking.
The Board to continue the hearing until the next meeting,
January 4, 1994.
On January 4, 1994 the Planning Board held a regular meeting.
The following members were present: Richard Nardella, Chairman,
John Simons and Richard Rowen. JoSeph Mahoney, John Daghlian and
John Draper were absent.
Mr. James Bourgeois told the Board that after discussion with
staff, he has decided to call the use proposed, a medical office
and not a professional office.
Mr. Nicetta told him that changes need to be made to the plan
so that the number of parking spaces required for the use can be
calculated.

Site Plan Review Conditional Approval
The Planning Board makes the following findings regarding the
application of Dr. Sudarshan Chatterjee, 42 Jay Road, North
Andover, MA 01845, requesting a change in use of an existing
building from residential to a medical office in an Industrial-S
zone as required by Section 8.3 of the North Andover Zoning
Bylaws:
FINDINGS OF FACT:
1. The proposed use as a medical office and site design for
this lot are appropriate, as the site is zoned Industrial-
S.
2. Adequate vehicular and pedestrian access into the site has
been provided with the adherence to the approved plans.
3 . The plan as approved meets the requirements of Section 8.4
(Screening and Landscaping) of the Zoning Bylaws, with the
addition of the enclosed conditions.
5. The applicant has met the requirements of the Town for Site
Plan Review as stated in Section 8.3 of the Zoning Bylaw.
6. Adequate and appropriate facilities will be provided for the
proper operation of 'the proposed use.
Finally, the Planning Board finds that this application generally
complies with the Town of North Andover Zoning Bylaw requirements
as listed in Section 8.3 but requires conditions in order to be
fully in compliance.
Therefore, in order to fully comply with the approval necessary
to change the use of the facility as specified in the Site Plan
Review application before us, the Planning Board hereby grants an
approval to the applicant provided the following conditions are
met:
SPECIAL CONDITIONS:
1. This site plan review approval is for the creation of 925
square feet of medical office space contained on the first
floor. This approval does not authorize the use of either
the basement or the attic.
2 . A minimum of 7 parking spaces must be reserved and marked in
the parking lot behind the building for use by the medical
office. I€ 7 parking spaces is determined not to be
adequate by the Building Inspector, the applicant must come
back before the Planning Board.

3. Prior to endorsement of the plans by the Planning Board:
a. Sheet A-1 must be changed to reflect the use of all
rooms shown on the floor plans.
4. Prior to FORM U verification (Building Permit Issuance):
a. The decision must be recorded at the Registry of Deeds
and a copy sent to the Planning Office.
5. All artificial lighting used to illuminate the site shall be
approved by the Planning Staff. All lighting shall have
underground wiring and shall be so arranged that all direct
rays from such lighting falls entirely within the site and
shall be shielded or recessed so as not to shine upon
abutting properties or streets.
The site shall be reviewed by the Planning Staff. Any
changes to the approved lighting plan as may be reasonably
required by the Planning Staff shall be made at the owners
expense.
6. Any plants, trees, or shrubs that have been incorporated
into the Landscaping Plan approved in this decision that die
within one year of planting must be replaced by the owner.
7. The contractor shall contact Dig Safe at least 72 hours
prior to commencing any excavation.,
8. Gas, Telephone, Cable and Electric utilities shall be
installed as specified by the respective utility companies.
9. All catch basins shall be protected and maintained with hay
bales to prevent siltation into the drain lines during
construction.
10. No open burning shall be done except as is permitted during
burning season under the Fire Department regulations.
11. No underground fuel storage shall be installed except as may
be allowed by Town Regulations.
12 . The provisions of this conditional approval shall apply to
and be binding upon the applicant, it's employees and all
successors and assigns in interest or control.
13 . Any revisions to this plan must be submitted to the Town
Planner for review.
14. This Special Permit shall be deemed to have lapsed after a
two (2) year period from the date on which this permit was
granted unless substantial use or construction has
