The North Andover Board of Appeals held a public heaving at its regular meeting in the Town hall top floor meeting
room, 120 Main Street,North Andover,MA on Tuesday,January 10,2006 at 7:30 PM upon the application of
Tripnorth Realty,LLC c/o John Tripodis, 17 Maple Avenue,for premises at:10-16 Main Street(Map 28 Parcel 8),
North Andover requesting a dimensional Variance from Section 6,Paragraph 6.6.G.3 of the Zoning Bylaw for relief of
the requirements for ground sign setbacks from lot lines. Said premise affected is property with frontage on the East side
of Main Street within the I-S zoning district. Legal notices were sent to all names on the abutter's list deemed by the
Assessor's Office of North Andover to be affected,and were published in the Eagle-Tribune,a newspaper of general
circulation in the Town of North Andover,on December 26,2005&January 2,2006.
The following voting members were present: Ellen P.McIntyre,Richard J.Byers,Thomas D.Ippolito,Richard M.
Vaillancourt,and Daniel S.Braese. .
Upon a motion by Richard J.Byers and 2nd by Richard M.Vaillancourt,the Board voted to GRANT a dimensional
Variance from Section 6,Paragraph 6.6.G.3 of the Zoning Bylaw for relief of 39'from the front setback and 35'from
the north side setback in order to construct a proposed ground sign,a 36'x 48'PVC sign panel between 8'x 6"x 6'
granite posts;per:

The Board finds that the circumstances relating to the shape of 10-16 Main Street and the location of the existing
structures on the site,especially affecting this site but not affecting generally the Industrial S zoning district in which it is
located,a literal enforcement of the provisions of 6.6.G.3 would involve substantial hardship,financial or otherwise,to
the petitioner. The Board finds that one structure is 112'from the front lot line,and the other L-shaped structure is on
the front and south side lot lines. The Board finds that 6.6.G.3,requiring a 40'setback from any property line,would
locate the sign beyond the sight line of Sutton Street vehicles and would be in the sight line of Main Street vehicles for a
few seconds. Board finds that that there was no written or spoken opposition. The Board finds that desirable relief may
be granted without substantial detriment to the public good and without nullifying or substantially derogating from the
intent or purpose of the North Andover Bylaw.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the
granting of a building permit as the applicant must abide by all applicable local,state,and federal building codes and
regulations,prior to the issuance of a building permit as required by the Building Commissioner.
Furthermore,if the rights authorized by the Variance are not exercised within one(1)year of the date of the grant,it
shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted
under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date on which
the Special Permit was granted unless substantial use or constriction has commence,it shall lapse and may be re-
established only after notice,and a new hearing

A. My particular Variance request is for the proposed 36"X 48"ground
sign on the existing landscaped island,where the existing tree will be
cut down for the sign to take its place.
B. The particular circumstances of my lot relating to soil conditions will
not be altered with only the tree to be removed
The particular circumstances relating to shape will be a 36"h X 48"w
PVC sign panel and 8' x 6"x 6"Granite Posts.
The particular circumstances of my lot relating to topography, or to
structures especially affecting the property for which the variance is
sought do not affect the rest of this zoning district.
C. The ground sign being required to be set back 10' from property lines
and 40' from residential structure and districts would prevent a sign to
be erect within reasonable viewing distance of traffic,particularly
since the front of one of the buildings abuts the sidewalk the same
manner the sign is proposed. There have been numerous requests by
my existing tenants for a sign to let their existing and prospect
customers know their location,particularly since one of my buildings
is set so far back. The lack of this sign has also deterred prospect
tenants from leasing space on this property providing a financial
hardship. These hardships result if the literal enforcement of the
Zoning Bylaw Sec 6(6.6)(A)(Z) on this land or use if this Variance
relief is not granted.
D. The relief sought will be a desirable PVC panel matching the vinyl
sided front building with attractive granite posts matching the stone
building structure in the back of my property,which will be desirable
and without detriment to the public good.
E. The plan provided will support a finding that the relief sought may be
given without nullifying or substantially derogating from the intent or
purpose of the Zoning Bylaw.
F. This variance is not for Contiguous Buildable Area(7.1.1)
