The particular use proposed for the land or structure. I am requesting a Special Permit to construct a second floor addition. The addition will allow me to have(1) additional rental unit and larger living quarters for myself. 2. The specific site is an appropriate location for such use, structure or condition. My home is a preexisting nonconforming duplex dwelling. I am in a neighborhood, which consists of many multiple use as well as multiple dwelling units. The North Andover housing authority complex is directly across the street from my home. Less than 200 feet away is a Commercial/Light Industrial Building. My home as well as the only other two homes on my street are zoned R4,however, immediately adjacent to our properties as wells as completely surrounding our properties the zoning is modified to incorporate R5, Gen. Business and Ind 3. In actuality, Baldwin Street only has three(3) structures(residential homes) and they are an isolated island designated R4. There will be no increase in aggregate non-conforming use area, since my addition as proposed will not exceed 20% coverage of lot and is consistent with residential dwellings. 3. There will he no nuisance or serious hazard to vehicles or pedestrians. The intent of my building an addition is to create a financial affordable home for my family and myself as well as an aesthically-pleasing dwelling more consistent with that of my neighbors. There will be no significant increase in vehicle or foot traffic as a result of my building an addition. My plans outline off-street parking facilities for eight vehicles housed in the manner,which the town of North Andover requires. Baldwin Street is wide, without benefit of sidewalks and my addition will not create any hazard to vehicles or pedestrian since I am not encroaching further forward on my lot but instead utilizing the air space above my existing home and the side space already available. The improvement of my home will not only visually enhance the residential feel of our immediate neighborhood but I feel will also significantly increase the value of the homes adjacent to me, since I will be modernizing and updating the dwelling to more closely resemble the look of both my neighbors homes I am an owner occupant of this dwelling, this is my home. I require strict adherence to noise, nuisance and hazard by my tenant. t 2. RE: Special permit/14-16 Baldwin Street North Andover, MA 01845, cont. 4. I will provide all appropriate facilities that the Town of North Andover deems necessary for me to complete this addition. I have sought variances from the Town for the parking provision as well as a set back variance for the construction of a two-stall garage attached to my home. I will accommodate, with no impact to my neighbors,off-street parking for ten(10)vehicles in the manner with which the town requires. The facilities will be esthetically pleasing and consistent with proper operation and placement that will create no hazard or nuisance to the neighborhood. In fact, I feel,that it will alleviate vehicle congestion in front of my home by visitors and allow me storage that I do not have at present. 5. The use is in harmony with the purpose and intent of the zoning by-law. My home was built in 1965. At the time of its construction it met all zoning requirements. Subsequent zoning and by-law changes have made my lot and the immediate area non- conforming. However, the purpose and use of my addition is consistent with and reasonable with the intent of the zoning by-laws. This is a multiple and mixed used residential neighborhood whose residents have, over the years, strived to improve their properties with scores of amenities, additions and modernizations. It has become a sought after area with respect to the schools and community atmosphere. That is the reason I wish to remain in my neighborhood and to improve my home in a manner consistent with my neighbors home. My addition will have a positive affect on the neighborhood. 6. The Particular use proposed for the land or structure: I am requesting a variance on the left side setback dimensional requirement for the purpose of constructing a two(2) stall garage. The garage will be used for housing my motor vehicles as well as storage. At present I have four(4)parking spaces. I have applied for a Special Permit for the construction of a second story addition to my existing dwelling. This would allow for larger living quarters for my fam.Uy and myself and also provide me with an additional rental unit. A second driveway to the right side of my house would house an additional four(4)parking spaces. This driveway would be within the setback requirement of 15 feet from the property line, I believe, that driveway would not require a special variance according to the existing North Andover setback requirements. B. The circumstances relating to soil conditions,shape or topography of such land or structures especially affecting the property for which the variance is sought which do no affect generally the zoning district in which the property is located: I am very desirous of building an attached garage. My land is flat and rectangular in shape (11780 sq. ft). I am nol in a flood plain nor are there any special soil or topography conditions that could adversely affect the properties surrounding me. My house sits directly in the middle of the property facing southeast. The land to the left of my house is now my existing driveway. There is a large space(60 feet) separating my house and my neighbor's house to the left. There is 30 feet between my house and my neighbors lot line to the left,which is separated by a stockade fence. My neighbor's driveway is on the other side of that fence constituting more open space. My neighbor's house on the left side is set closer to the street than mine. The rear(west)of my home is bordered by trees and fences and not suitable for construction or easy access to a garage. ti 2. RE; Request for a Variance/14-16 Baldwin Street,North Andover, MA 01845 The land to the right(north)of my home is open space for 30 feet bordered by a stockade fence. My neighbor's home to the right sits approximately 20 feet away from that stockade fence. A driveway on the right(north) side of my property would allow parking for four(4)vehicles as well as access to the rear of my home. The driveway proposed would be 15 feet from the lot line; hence,I do not believe it would need a special variance for construction. C. Facts,which make up the substantial hardship,financial or otherwise, which results for literal enforcement of the applicable zoning restrictions with respect to the land or building for which the variance is sought. My home when built in 1965 conformed to the zoning laws in place at that time. The requirements for the buildings in my neighborhood have changed significantly over the years. My home is in an older section of Town with many different styles and types of buildings, some conforming and some not. It would be impossible for me to acquire additional land in this development since it is completely built up. I very much enjoy living in North Andover and wish to continue to make it my home. My house is small;therefore, I am making significant changes that will allow my family and myself to continue to live there for many years to come without outgrowing the house. D. Facts retied upon to support a finding that relief sought will be desirable and without substantial detriment to the public good. Homes in my area have seen dramatic improvements over the years. Residents have made large scale improvements in their properties,building up and out, constructing decks, garages, replacing windows, lawns and remodeling the interiors. My home was built in the 1960's the design is that of a tract home. I have made renovations on the inside but would very much like to make it lookand conform to those around me, with all the amenities of the new homes in our town. I feel certain that my neighbors would welcome the changes I am proposing, as it will greatly enhance the look and value of my home as well as those properties around me. A garage attached to the left side of my home set back from the front of my existing house will greatly improve the visual look of my home as well as not adversely affecting my neighbor or any other family in the neighborhood. t 3. RE: Request for a Variance/14-16 Baldwin Street, north Andover, MA 01845 E. Facts relied upon to support a finding that relief sought may be given without nullifying or substantially derogating from the intent or purpose of the zoning bylaw. The intent of the side setback requirement is to provide sufficient distance between dwellings in the zoning district. In my case: Due to the different front setbacks of my home and the home of my neighbor to the left, the significant open space distance between our two homes, my intent to place my garage further back than my house front set-back, the fact that his driveway will still border my property on the other side of the stockade fence maintaining a significant open space between the two properties;there would be no nullifying or substantially derogating from the purpose of the zoning bylaw, since significant open space will still be present. There would be no harm caused to my neighbor or the neighborhood in general. In fact, I see improvements to my home as enhancing and conforming to the look and style of the improving neighborhood in keeping with and adhering to the intent of the zoning bylaw. F.
