Property at: 73-75 Davis St. NAME: Chris Jenkins DATE:7/14/99 ADDRESS: 73-75 Davis St. PETITION:013-99 North Andover, MA 01845 HEARING:6/22/99&7/13/99 The Board of Appeals held a regular meeting on Tuesday evening,July 13, 1999 upon the application of Chris Jenkins, 73-75 Davis Street, North Andover,requesting a Variance from the requirements of Section 7, P7.3 for relief of front setback,and rear setback,of Table 2,and for a Special Permit from Section 9, P9.2 to allow construction of a deck&to allow construction of a new roof on the existing garages within the R-4 Zoning District. The following members were present:William J.Sullivan, Robert Ford,John Pallone and Scott Karpinski. The hearing was advertised in the Lawrence Tribune on 5/25/99&611/99 and all abutters were notified by regular mail. Upon a motion made by Robert Ford and 2n°by John Pallone, the Board voted to GRANT a dimensional Variance from the requirements of Section 7, P7.3 to allow relief of a front setback from the house of 134,and dimensional relief of a rear setback from the garages of 23.5'and to GRANT a Special Permit from the requirements of Section 9, P9.2 to allow construction of a deck 10'X31'as shown on the"Plan of Land"by: Bradford Engineering,Co.,James W. Bougioukas, R.L.S.,#9529,dated 4/14199,with the following corxtitions: 1. The Plan of Land be revised to show parking only within the garage for six(6)cars to satisfy the bylaw for a three family house. 2. That the garage and former bam be only a one story structure for its total dimensional length. 3, That the reconstruction of the garage be only within the current existing footprint. 4. The reconstructed garage be used exclusively for residential purposes and exclusively for residents of the associated three family home. 5. That a Massachusetts,registered,structural engineer's report be submitted to verify the integrity of the existing structure. 6. That if the existing structure is not suitable for rehabilitation,that the 23.6 rear lot line variance will become void. 7. If the petitioner fails to comply wittrthe request to revise the"Pian"within twelve(12)days,therefore,this decison will become"null and void".' Voting in favor: William J. Sullivan, Robert Ford,John Pallone,Scott Karpinski Page 1 of 2 TtJ�R �.rIr� KORTH JUL Chris Jenkins, 73-75 Davis St.,decision-continued 10.4 Variances and Appeals The Zoning Board of Appeals shall have power upon appeal to grant variances from the terms of this Zoning Bylaw where the Board finds that owing to circumstances relating to soil conditions,shape,or typography of the land or structure and especially affecting such land or structures but not affecting generally the zoning district in general,a literal enforcement of the provisions of this Bylaw will involve substantial hardship,financial or otherwise,to the petitioner or applicant, and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of this Bylaw. SPECIAL PERMIT The Board finds that the applicant has satisfied the provision of Section 9,paragraph 9.2 of the Zoning Bylaw and that such change,extension or alteration shall not b e substantially more detrimental than the existing non-conforming structure to the neighborhood. Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a Building Permit as the applicant must abide by all applicable local,state and federal and building codes and regulations,prior to the issuance of a building permit as requested by the Building Commission. Bohne Date: 11/26/96 73-75 Davis Street Petition# : 033-96 North Andover, MA 01845 Date of Hearzng: 11/12/96 The Board of Appeals held a regular meeting on Tuesday evening October 8, 1996 and decision rendered on November 12 , 1996 upon the application of George Bohne requesting a Special Permit of Section 4, Paragraph 1.22 (14) and Table 2 of the zoning By Law so as to permit a four (4) family dwelling in Zoning district R-4 by converting a two family dwelling. The following members were present and voting: William Sullivan, John Pallone and Joseph Faris and Ellen McIntyre. The hearing was advertised in the North Andover Citizen on 9/24 & 10/1 1996 all abutter were notified by regular mail. Upon a motion by John Pallone and seconded by Ellen McIntyre the Board of Appeals unanimously voted to GRANT the Special Permit for a legal three (3) family dwelling with the following conditions. 1) Provision for sufficient parking for 6 cars. 2) Establish stockade fencing on the left providing the neighbor screening from the car lights. 3) Providing before and after plans showing conversion from a four (4) to three (3) family dwelling. Voting members were William Sullivan, John Pallone, Joseph Faris and Ellen McIntyre. The vote was unanimous. The Board finds that the applicant has satisfied the provisions of Section 9, para. 9 . 2 of the Zoning Bylaw and that such change, extension or alteration shall not be substantially more detrimental than the existing non-conforming structure to the neighborhood. a Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local, state and federal building codes and regulations, prior to the issuance of a building permit as required by the Building commissioner.
