Findin s Pursuant to the North Andover Old Center Historic District Bylaw ("Bylaw"), Section 7 and Mass.Gen.Laws c. 40C ("Act"), the North Andover Historic District Commission ("Commission") makes the following findings in connection with the Applicant's Application for Certificates of Appropriateness: 1 . The proposed construction for 85 Osgood Street, as depicted on the Plans referenced above, will be appropriate and compatible with the preservation and protection of the North Andover Old Town Center Historic District ("District") and the purpose and intent of the Bylaw. 2. The proposed construction for 95 Osgood Street, as depicted on the Plans referenced above, will be appropriate and compatible with the preservation and protection of the District and the purpose and intentof the Bylaw. 3. The Commission has voted and issued its Decision and Certificates of Appropriateness following a duly noticed and duly held public hearing, in conformance with the Bylaw and the Act. CADocuments and Settings\DSchatzN.ocal Settings\Temporary Internet Files\OLK23\Decision 85 95 Osgood Sb=t.doc Certificates of Appropriateness Pursuant to Section 7.F of the Bylaw, the Commission has issued Certificates of Appropriateness simultaneously herewith for the following: 1 . The proposed construction of a single family home and associated improvements within the jurisdiction of the Commission for property located at 85 Osgood Street, as depicted on the Plans for "The Adams" as referenced above. 2. The proposed construction of a single family home and associated improvements within the jurisdiction of the Commission for property located at 95 Osgood Street, as depicted on the Plans for "The Jefferson" as referenced above. Conditions This Decision and the Certificates of Appropriateness stated above are subject to the following conditions: 1. The installation and construction of all exterior architectural features within the jurisdiction of the Commission shall be completed in accordance with the Plans referenced above and said Plans are incorporated hereby. Within ten (10) days of the Applicant's request, the Commission, through its Chairperson or other designated representative, shall confirm that each home has been constructed in accordance with this Decision and the Commission's Certificate of Appropriateness. Such confirmation shall be given for each respective home prior to the Town Building Inspector's issuance of an occupancy permit for that home. In the event a home or other work or improvement approved by this Decision is determined not to be in compliance with this Decision or the Commission's Certificate of Appropriateness, the Commission shall provided the Applicant with a written list of all non-complying items within said ten (10) day period, so that they may be appropriately addressed. The specifications and materials of all exterior architectural features within the jurisdiction of the Commission shall be as specified on the Plans. To the extent the Plans are silent as to any such specification or materials or the Applicant wishes to insubstantially modify or amend some, such specifications and materials shall be determined through consultation with the Commission's chairperson or other designated representative and shall be consistent with good, architectural practice, recognized historic preservation standards, and the purpose and intent of the Bylaw. 3. Prior to the commencement of framing on each home, a survey plan showing the location of the foundation for that home to be in compliance with the Plans shall be submitted to the Commission and the Town's Building Inspector. A. In the event the two homes are not constructed simultaneously, the Applicant shall construct the home at 95 Osgood Street first. An occupancy permit for the 95 Osgood Street property shall not be issued until the foundation has been constructed for the 85 Osgood Street Property and the Town Building Department's required foundation inspection has been passed. 5. At the Commission's request the Applicant shall, prior to the issuance of any occupancy permit, offer a landscaping easement to the Town over certain land located at the Southern-most corner of the 85 Osgood Street property, to be located along the property's boundary with Massachusetts Avenue, to be triangular in shape, all as more specifically depicted on Sheet L1 of the Plans. It is the Commission's intention that this landscape easement area might ultimately be improved by the Town for the purpose of placing and maintaining a monument and landscaping. This condition shall have no effect in the event that the Town's Building Department or other Town authority determines that the grant of such an easement would cause said lot to be out of compliance with any applicable zoning or land use requirement. 6. The Applicant shall provide landscaping at the Southern-most corner of the 85 Osgood Street property, as indicated on the Plans. 7. No swimming pool shall be installed on the South side of the property at 85 Osgood Street.
