Special Hearings
The Planning Board held a special meeting on Wednesday evening, April 25, 1962
at 7:00 P.M. in the To~n Building. The following members were present and voting.'
J~m~s M. Barman, Chairm~; Robert J. Burke, Secretary; George Farley, William
Chelm,1 ~ s and Howard Gilman.
1. HEARING: Nazaire Giard.
Mr. Chepulis read the legal notice to ch~__~ge a parcel of la~ off F~as. Ave.
from C~untry Residence to Village Residence. There were approx. 15 people present.
Atty. John J. Willis represented Mr. Giard and showed plans and explained the reasons
for their desire to re-so~e. The special town meeting is being held on May 14th.
He explained that Mr. Giard has lived in town for over 40 years and has used the land
as a farm, but due to his age is no longer able to conduct it as a farm. The reas~a
this land was zoned for larger lots was because of a drainage problem; most sections
whe*e sewerage is a~ilable, lots were established at 12,500 sq. ft. The Green ~
Ave. and Woodstock St. secti~, a low years ago presented a similar case. The plans
shown tonight are a tentative sub-division if the me~mg cha~ge is m~de. The average
lot is 14~000 sq. ft., some are 15,000. The whale area will be supplied sewerage,
drainage and a street that will be accepted under the Board's Sub-division Control
Law. It is in keeping with the surrounding area to have ,m~l~er lots. There are
36 lots in all.
There was no opposition to the petition. Mr. & Mrs.. Giard, their son amd son-
in-law were present; also Mr. Carlson, Mr. Panish end other abutters who discussed
the re-zoning and sub-division.
Mr. Farley made a motioa to take the petition under advisement. Mr. ~urk® seconded
the motion and the vote was unanimous.
2. HEARING: Alfred Boeglin.
Mr. Burke read the legal notice to change a parcel of land on Osgood Street
to Business. There wore three abutters present. Mr. Boeglin and Mr. Kneupfer were
present. Mr. Boeglin showed the plans and pictures of the old and new buildings.
He stated that the new building cannot be completed until the land is re-zoned,
in order to get a loan from the bank, for the additional 8,000 to 10,000 dollars
needed. Once the building is completed, they would either lease it or sell it for
some business. They have already invested $20,000 in the building. The taxes are
from $600 to $700 a year. They would like to improve the building but can't do
anything until they are able to get more funds. They have no one in mind for a
business. If they leased, it would have to be on a five year basis. Mr. Boeglin
spoke about puttin~ up a chain link fence to protect the property and the children
in the neighborhood. Whatever business it would be, it could not be a big operation
because the building is 105 feet long and 30 feet w~de and there would not be' much
traffic from it. The present building could not be expanded. The best use for the
building would be an office in front and storage in back.
Mrs. Brucato and Mrs. Nerney asked Mr. Boeglin several questions regarding the
types of business. Mm. Peabody stated that he did not want to stop progress, but
wants to see things look better. Mr. Farley said that the Town Officials would not
go along with anything that w~uld be obnoxious, which is some protection to the
neighborhood.

Mr. Burke made a motion to take the petition under advisement. Mr. Gilman
seconded the motion and the vote was unanimous.
The Board then voted on the two hearings:
1. Nazaire Giard:
Mr. Farley made a motion to APPROVE the petition of Nazsire Giard to re-zone
fro~ Country Residential to Village Residential. Mr. Burke seconded the motion and
the vote was unanimous.
2/ Alfred Boeglin:
Mr. Gilman made a motion to APPROVE the petition of Alfred Boeglin to re-zone
from Village Residential to Business. Mr. Burke seconded the motion. Four members
voted in favor of approving the re-zoning and Mr. Chepulis voted against it.
SIGNS:
Mr. Chepulis questioned the case before the Board of Selectmen regarding the
erection of a sign by the Motel on Chickering Road. He asked whether the Planning
Board has been contacted. Mr. Bannan said that the State regulates signs on the
highway and that the Building Inspector has the regulations.
HYLLCR~STREALTY:
Mr. Bannan read a letter from the Highway Department regarding the sub-
division on Johnson Street~yHillcrest Realty. They are to bring in new maps and
plans to be approved by the Board.
