' This Special Permit is requested for A Ground Sign that exceeds the maximum square footage and heightaya|lovvedbv the Zoning Bylaw. Section 6.6D2 - Special Permit Application for Ground Sign - points 1-6: 1. Use of Structure - The tenant signage will consist of a signboard approximately 9'-5" wide and 8'-0"tall fastened to the sign structure. The bottom of this signboard will be 4-6" above ground level to provide visual clearance under the sign for parking and keep sign above the picket fence around the property. There will also be1Oinch high post-mounted letters fastened tnthe Ground Sign structureabovethesignboard. The Ground Sign will beused toadvertise the businesses located in the 1Z11Osgood Street Retail building. 2` Specific Site - The specific site and location of the Ground Sign is appropriate because it will be easily seen by vehicles travelling to and from the Retail Center along Osgood Street' 3. Nuisance orSerious Hazard - There will be no nuisance or serious hazard to vehicles or pedestrians because the bottom of the Ground Sign is 4''6~ off the ground, and will not block the views of vehicles pulling in and out of the Retail Center site. The two (2) supporting legs of the Ground Sign will not significantly block views. Pedestrians will also be able to see under and around this sign as they walk to and from their parked cars. 4. Adequate and appropriate facilities- Support structure including a concrete foundation, tube steel frame, will be supplied. Electrical power for exterior lighting the sign at night, and landscaping will also be provided as a part of the construction of the self-supporting � Ground Sign. S. Harmony with the Zoning Bylaw- The Ground Sign is in harmony with the purpose and intent of the Zoning Bylaw because it meets the definition of a Ground Sign (6.3.6). The sign will also, 'beset back aminimum uften/20Vfeet from aY 6inesa/uda minimum of forty(40)feet from all residentlal d1stricts orstructures"(6.6A6)and will be a single, self-supported sign (E6Zl3). Other signs for businesses along Osgood Street, and inother G-Bzones inNorth Andover are of similar sizes ifnot larger (6,6H'Environmental Relationship, 1)see attached photographs. The Ground Sign lighting will be from single fixtures mounted on both sides of the sign above the sign board and will be of an appropriate brightness level (6.6}/Environmental Relationship, 2). The GoundSign will not obscure views ofthe Retail Center, will be constructed of similar materials, colors, and architectural details and will match the scale of the Retail Center building (667f Building Relationship, 1, 2and3). This sign will not be incongruous tothe district in which it is located because it is a similar size. The sign will also match the architecture of the Retail Building. A majority of the existing signs on other sites do not match the architecture of their related buildings as well as this proposed Ground Sign. This sign addresses safety issues in a way that is more in tune with the Zoning Bylaw, while some existing signs on other properties do not allow for visual clearance atthe base ofthe sign. In addition, a Special Permit is requested to allow this sign because the specific Zoning Bylaw requirements for maximum height and maximum square footage of a Ground Sign, do not allow enough space to clearly and adequately display the names of the Retail Center tenants. Also, this sign will be visible from a greater distance than a smaller sign would be. This will allow drivers to plan and initiate their turns safely into the property. This Special Permit was requested by Frank and Kathleen Terranova, d/b/a 1211 Osgood Street, North Andover, MA 01845. The application was filed with the Planning Board on December 3, 2004. The applicant submitted a complete application which was noticed and reviewed in accordance with Sections 8.3, 10.3, and 10.31 of the Town of North Andover Zoning Bylaw and MGL c.40A, sec. 9. The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Section 8.3 and 10.3. FINDINGS OF FACT: 1. The specific site is an appropriate location for the project as it is located in the General Business Zone and involves the constriction of a permitted use within the General Business Zone. The North Andover Zoning By-Law Section 4.131, allows retail establishment and office use within the General Business Zoning District. 2. The use as developed will not adversely affect the neighborhood as a sufficient buffer has been provided. Extensive landscaping has been provided around the perimeter of the property. 3. There will be no nuisance or serious hazard to vehicles or pedestrians. The applicant has demonstrated that the curb radii for the entrance/egress driveways are adequate. Entrance signs have been added off Osgood Street. An entrance sign has been added at the Barker Street entrance. The labeling for the proposed snow stockpiling area has been appropriately labeled. 8' width parking Parallel spaces are labeled. The dumpster area has been modified so as to provide adequate truck access. Four (4) building perimeter lights in the rear of the building are to be directed downward. Trucks can safely navigate the loading zone. Traffic flaw change signs have been placed regarding the one way. An additional handicap space has been added to comply with the Section 8.1.14 of the Bylaw. The three (3) handicapped spaces will conform to (MARB) dimensions and specifications. Wheelchair ramps proposed along the sidewalk on the southeast side of the building are not wheelchair ramps, these ramps will be used for loading and un-loading during deliveries. Access change onto Osgood Street (Rte. 125) has been approved by MHD. The proposed driveway onto Rte. 125 located at the northwesterly end of the site has been approved by MM. 4. The landscaping approved as part of this plan meets the requirements of Section 8.4 as amended by the Planning Board, of the North Andover Zoning Bylaw. Landscaping has been provided throughout the property with particular emphasis 2 placed to provide a landscaping buffer between the abutting Barker property, Tax Map . Internal landscaped islarais and a 4' vinyl white picket fence have been included along the perimeter of the property along Rte. 125. 5. The site drainage system is designed in accordance with the Town Bylaw requirements and has been reviewed and approved by the outside consulting engineer, VHB. 6. The applicant has met the requirements of the Town Site Plan Review as stated in Section 8.3 of the Zoning Bylaw. 7. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The project will be on Town water and sewer. Hours of operation for any establishment within the retail facility shall be 6 a.m.to 1.0 pm. 8. Waivers have been granted for the following: a. A waiver from Section 8.1.7 of the Bylaw to allow a minimum width of 17' for the one-way aisle along the northerly portion of site. The minimum aisle width provides sufficient access and egress for emergency vehicles on and around the site. b. A waiver from Section 8.1.7 of the Bylaw allowing four (4) 8'x22' parallel parking spaces along the Northerly portion of the site. The length of the four (4) newly created parking spaces have been increased to allow easier entrance and exiting. c. A waiver from Section 8.1.7 of the Bylaw to allow a minimum width of 16' for the one-way aisle at the rear of the building except where labeled "LOADING ZONE" (approximately 56') where a minimum aisle width of 19' was previously approved 1/15/04. The minimum aisle width provides sufficient access and egress for emergency vehicles on and around the site.d. A waiver from Section 8.1.14 to allow the handicapped parking spaces to be 8'x18'. The three (3) handicapped parking spaces meet the requirements of the CMR 521 of the Architectural Access Board (AAB) by providing additional 8' striped areas adjacent to the 8'xl8' handicapped parking spaces. A sign identifying "Handicapped Parking Only" will be placed at each of the handicapped parking spaces. All handicapped signs will comply with the Bylaw. Finally, the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.35, but requires conditions in order to be fully in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1. This approval is based on the fact that a restaurant will not be included in 3 the development. This restriction is required due to the parking spaces provided and the parking limitations of the site. If the development chooses to include a restaurant, a modification to the Site Plan Special Permit must be applied for through the Planning Department. 2. The developer shall designate an independent Environmental Monitor who shall be chosen in consultation with the Planning and Community Development Staff. The Environmental Monitor must be available upon four (4) hours notice to inspect the site with the Planning Board designated official. 3. The applicant shall designate an independent construction monitor who shall be chosen in consultation with the Planning Department. The construction monitor must be available upon four (4) hours notice to inspect the site with the Planning Board designated official. The construction monitor shall make weekly inspections of the project and file monthly reports to the Planning Board throughout the duration of the project. The monthly reports shall detail area of non-compliance,if any, and actions taken to resolve these issues. 4. Prior to the endorsement of the plans by the Planning Board, the applicant must comply with the following conditions: a) The final plans must be reviewed and approved by the DPW and the Town Planner and subsequently endorsed by the Planning Board. The final plans must be submitted for review within ninety days of filing the decision with the Town Clerk. b) A bond in the amount of$7,000.00 by Western Surety Company dazed 8/4104 was posted for the purpose of insuring that a final as-built plan showing the location of all on-site utilities, structures, curb cuts, parking spaces, topography, and drainage facilities is submitted. The bond is also in place to insure that the site is constructed in accordance with the approved plana The said bond amount posted by the Western Surety Company will be rolled over from the previously approved 2004 Site Plan. c) Deeds and easements relative to the project must be supplied to the Planning Staff. 5. Prior to the start of construction: a) During construction,the site must be kept clean and swept regularly. b) A construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. c) The Town Planner must be contacted and review the site prior to any cutting on site.
