The Board finds that owing to circumstances relating to the shape of 1475 Osgood Street(Map 34,Parcel 16),and the location of the existing structure especially affects 1475 Osgood Street and the existing structure but does not affect generally the CDD-3 zoning District in which it is located. The Board finds that the existing rectangular structure was designed to face the 330-foot Osgood Street frontage,the building's main entrance designed to face the 208-foot Orchard Hill Road frontage,and the lot's right side has an existing vegetative buffer between the parking lot and the right side Osgood Street abutter: The Board finds that a literal enforcement of the provisions of Paragraph 7.3&Table 2 and Section 10,Paragraph 10.4 would involve substantial hardship,financial or otherwise,to the petitioner. The Board finds that the N.A.Fire Department's March 17,2009 memo states that there will be no problem regarding emergency vehicle access and that the sprinkler system and the fire alarm system will be extended into the new addition and that there was no written or spoken opposition. The Board finds that safety and aesthetic concerns make the building rear the best location for the sally port and detention area. The Board finds that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the North Andover Bylaw. After a public meeting given on the above date,the Board recommended approval of the attached conditions imposed on the project. �5n behalf of the Noo Andover Planning Board John Simons,Chairman Courtney LaVolpicelo Timothy Seibert Michael Walsh The Planning Board herein APPROVES the construction of a 3,064 sq. ft. addition to an existing building located at 1475 Osgood St,,with associated drainage and landscaping improvements.The project is located in 1 North Andover School Department Site Plan Special Permit—1475 Osgood St. Police Station North Andover,Massachusetts,01845,in the Corridor Development District 3 (CDD3)District. This Special Permit was requested by the town of North Andover. The application was filed with the Planning Board on February 17, 2009. The public meeting on the above referenced application was opened on March 16,2009 and closed by the North Andover Planning Board on May 5,2009. The applicant submitted an application, which was noticed and reviewed in accordance with Section 8.3, 10.3, and 10.31 of the Town of North Andover Zoning Bylaw and MGL C.40A,Sec.9. The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Section 8.3 and 10.3: FINDINGS OF FACT: 1) The specific site is an appropriate location for the project as it is located in the Corridor Development District 3 (CDD3) Zoning District and consists of the construction of a 3,064 sq. ft. addition to an existing building located at 1475 Osgood St., with associated drainage and landscaping improvements; 2) The use as developed will not adversely affect the neighborhood as the existing building had been occupied by a commercial business and the volume of traffic to be generated by the new use is anticipated to be approximately 25% of the previous use. The existing driveway off Orchard Hill Road will be maintained as the main access to the facility; 3) There will be no nuisance or serious hazard to vehicles or pedestrians. The addition will be located in the rear of the building, thus screening most police activity from the general public. The Police Station will utilize existing parking as well as traffic entrances and exits to the site; 4) A landscaping plan has been proposed which retains the existing landscaping that borders Osgood St. and Orchard Hill Road. New plantings are proposed at the public entrance,as well as on both sides of the new addition. All plantings and screening depicted on the approved plans referenced herein shall remain in perpetuity over the life of the project; 5) Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The building is currently serviced by town water and has an on-site septic system. The Division of Public Works has reviewed the application, utilities, and drainage and stormwater management plan. The applicant has agreed to make the necessary changes regarding stormwater management as requested by the town's engineer in his letter dated March 13,2009.. 6) The Town of North Andover Zoning Board of Appeals granted a dimensional variance from the town's Zoning Bylaw, Section 7.3, Table 2 for relief of 16.3 feet from the rear setback. This relief was granted at a public hearing held on March 19,2009. Finally the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.3.5, but requires conditions in order to be fully in compliance. The Planning Board hereby grants an approval to the applicant provided the following conditions are met: SPECIAL CONDITIONS: 1) Permit Definitions: 2 North Andover School Department Site Plan Special Permit— 1475 Osgood St.Police Station A) The "Plans"refer to the plans prepared by Sullivan Engineering Group, 22 Mount Vernon Road, Boxford, MA 01906,titled 1475 Osgood St., Site Plan of Land located in North Andover, MA", dated February 16, 2009, consisting of Sheets 1, C-2.1, A-1.1, A-1.2, A-1.3, A-5.1, A-5.2, C-2.2 along with an ALTA/ACSM Land Title Survey dated August 25, 2008,and an existing site layout plan by Lieb Architects,dated February,2009. B) The "Project" refers to the construction of a 3,064 sq. ft. addition to include a sallyport and detention area, on an existing building located at 1475 Osgood St. with associated drainage and landscaping improvements. C) The"Applicant"refers to the Town of North Andover,the applicant for the Special Permit. D) The "Project Owner"refers to the person or entity holding the fee interest to the title to the Locus from time to time,which can include but is not limited to the applicant and owner. 2) PRIOR TO THE START OF CONSTRUCTION A) If changes are to be made to the approved Plans at the request of the town's engineer, the applicant shall provide an updated Plan to the Planning Office showing those changes. B) A detailed construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. C) All applicable erosion control measures:rust be in place and reviewed and approved bythe Planning Department. D) A pre-construction meeting must be held with the applicant, their construction employees, Planning Department and Building Department (and other applicable departments) to discuss scheduling of inspections to be conducted on the project and the construction schedule. E) The applicant shall provide the Planning Board with copies of permits, plans and decisions received from all North Andover Land-Use Boards. 3) PRIOR TO THE ISSUANCE OF A BUILDING PERMIT A) Three(3)copies of the signed,recorded plans must be delivered to the Planning Department. 4) DURING CONSTRUCTION A) Dust mitigation must be performed weekly, or more frequently as directed by the Town Planner, throughout the construction process. B) Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times and fenced off to minimize any dust problems that may occur with adjacent properties. C) It shall be the responsibility of the applicant to assure that no erosion from the construction site shall 3 North Andover School Department Site Plan Special Permit— 1475 Osgood St.Police Station occur which will cause deposition of soil or sediment upon adjacent properties or public ways, except as normally ancillary to off-site sewer or other off-site construction. Off-site erosion will be a basis for the Planning Board making a finding that the project is not in compliance with the plan; provided, however, that the Planning Board shall give the applicant written notice of any such finding and ten days to cure said condition. D) In an effort to reduce noise levels, the applicant shall keep in optimum working order, through regular maintenance,any and all equipment that shall emanate sounds from the structures or site. 6) AT COMPLETION OF CONSTRUCTION A. The applicant must submit a letter from the architect and engineer of the project stating that the building, landscaping, lighting and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board. B) The Planning Staff shall review the site. Any screening as may be reasonably required by the Planning Staff will be added at the Project Owner's expense. C) A final as-built plan showing final topography,the location of all on-site utilities,structures,curb cuts,parking spaces and drainage facilities must be submitted to the Planning Department. D) Once the building has been in full operation for at least 30 days,the applicant shall meet with the Town Planner, the Police Dept, as well as other pertinent town departments to review the use of the parking spaces on the site as well as the traffic patterns on site. 7) GENERAL CONDITIONS A) Any plants, tree, shrubs, or fencing that have been incorporated into the Landscape Plan approved in this decision that die or fall into disrepair must be replaced by the project owner in perpetuity. B) The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. C) Gas, Telephone, Cable and Electric utilities shall be installed underground as specified by the respective utility companies. D) The hours for construction shall be limited to between 7:00 a.m. and 5:00 p.m. Monday through Friday and between 8:00 a.m. and 5:00 p.m. on Saturday. E) No open burning shall be done except as is permitted during burning season under the Fire Department regulations. F) No underground fuel storage shall be installed except as may be allowed by Town Regulations. G) The provisions of this conditional approval shall apply to and be binding upon the applicant, its employees and all successors and assigns in interest or control. 4 North Andover School Department Site Plan Special Permit— 1475 Osgood St. Police Station H) Any action by a Town Board, Commission, or Department, which requires changes in the plan or design of the building, as presented to the Planning Board, may be subject to modification by the Planning Board. The Town of North Andover requests a variance from the Zoning By-Law Regulations for municipal building addition known as the new North Andover Police Facility at 1475 Osgood Street for the rear setback requirements of 50'0"of the new addition from the property line. A new addition to the existing building is required to accommodate new secured and detention areas for the police station. The proposed one(1) story addition of 3,064 gsf addition is for the detention area and sallyport for the intake of individuals in custody. It is critical that the addition be located at the rear of the building as shown on the accompanying drawing C-1.1 B. The variance requested is for the reduction in the rear yard dimension requirement as indicated within the Zoning By-Law Regulation of 50'0"from the addition to the property line at the rear from the rear wall face to the lot rear property line, and acceptance of the dimensions indicated on the attached drawing C-1.1. The soil conditions and location of the proposed addition are not interfering, changing, or altering in anyway with any other abutting property and will not alter soil conditions provided the variance is approved. Moving the addition to another location on the site will involve substantial alterations to soils, leaching fields and existing soil conditions related to an existing on site septic system. The circumstances relating to shape of the lot are that the Zoning Regulations {that were passed at the 2008 Annual Town Meeting changing the site from Business-1 Article 4.126 to Industrial- 1 Article 4.132} require a 50'0"setback from the property line at the rear to the face of the building addition, but the configuration and required location of the addition will only allow for a 13'10" at the left side and 137"at the right side for the setback from the addition to the property line. The building addition conforms to the setback requirements for the front setback and conforms to the right and left side setback requirements The variance is required to fit the addition to the existing building that will result in the most efficient use of the interior and exterior parts of the property for use as a state of the art police facility. Relocating the addition would interfere in proper flow for the processing of individuals and needed separation for the public. C. The topography and shape of the lot does not allow for the"swapping"of the addition to the front elevation. The existing building was placed with its frontage onto Osgood Street. Placing the addition on the front of the building would alter its appearance from the more traveled way(Osgood St) and not be in harmony with the other buildings and structures surrounding the property. A new addition and renovation of the former Merrimack Valley Credit Union Building is required to accommodate new secured and detention areas for the police station. The proposed one(1)story addition of 3,064 gsf addition is for the detention area and sallyport for the intake of individuals in custody. The addition to the site will only increase the lot coverage to approximately 10.4%thus maintaining adequate light and air. It is critical that the addition be located at the rear of the building as shown on the accompanying drawing C-1.1 Relocating the addition would interfere in proper flow for the processing of individuals and needed separation for the public We believe that the adaptive reuse of the former Credit Union building into a Municipal use Police Facility is an appropriate use of the property as it has no major impact on the surrounding abutting properties and would not be visible from Osgood Street(Route 125)at the front. To the right, it is substantially lower in the vertical elevation by 20'0"(elevation 102'0"to elevation 122'0")from the abutting property. The new addition is at elevation 102'0"at finish floor and the building to the rear at finish floor elevation of approximately elevation 126'0", some 2410" vertically lower than the abutting building. We will be preserving loth the value of the land and increasing the value of the building through its interior renovations. The topography and shape of the lot does not allow for the"swapping"of the addition to the front elevation. The existing building was placed with its frontage onto Osgood Street. Placing the addition on the front of the building would alter its appearance from the more traveled way (Osgood St) and not be in harmony with the other buildings and structures surrounding the property. Also,there is a grade change of over 10 feet that would require additional drainage, site retaining walls and alterations to previously mentioned septic system and would require relocating parking. The addition will not impact the existing on site sewer system and will also reuse the existing fire and domestic water lines.There are no impacts on transportation as the former police facility required vehicular access to visit the property and we are relocating the new facility away form schools and parks in a more appropriate industrial zone. The reuse of the building to municipal/police,we believe will result in less traffic and flow to and from the site as the former credit union employed a drive up window at the buildings rear elevation thereby stacking cars and traffic along the lot line to its closest abutter. Only police vehicles would access the addition to the rear. The public and employee utilizing the building will access and utilize existing parking spaces. We are reducing fire hazards to the property by improving the fire suppression system and maintaining fore truck access to all sides of the A r building. The new addition will not impact area waterways or bodies of water and the runoff will be captured and discharged into the existing parking lot drainage system. No flooding was reported or evident before the town purchase of the building and none is anticipated... In summary,we believe the addition to the building was appropriately placed to lessen impact on traffic, abutters and keep the appearance of the building in harmony with its surroundings. But as important,the addition is appropriately placed to allow for the best segregation of Police activities from the sight and access of the general public.
