HomeMy WebLinkAbout1962-08-16Spoc~al ~et~ The Flanning ~ held a special meeting on Thursda~ evening, August 19~ at 7:00 P.M. in the Town Building. The following ~bers were present and _voting: James M. BA~ Chair~; WilliLm Ohepulis and George Farley. The Board met to discuss the decisions of the Board of Appeals for the hearings held by that Board on August 13, 1962. No official decisions have hean received by this Board, but a discussion was held on the information as reported in the North Andover News section of the Eve-~-.= Tribune on Tuesday, August 1~, 196~. The Board was concerned particularly with the petitions ~f George Farkas for a special permit to permit the sale of used cars as an accessor~ use to the p~esent Autc~obile Service and l~l~,~ Station located at 1615 0sgood Street; (2) John & Keidi I~elas, for the subdivision of an existing lot located at 11 Rosedale Ave. and (3) Jack Broadhead, for the subdivision of an existing lot located at 66 Longwc~d Ave. Mr. Ohepulis stated that the Board of Appeals c---ct do any z~, they do not have that authority, that only the Tow Meeting cA- do zoning. In the cases ~f!ndelas and Broedhead they have allowed subdivision of lots without the area being re-zoned first. In the case of George Farkas, they have allowed a special per~it to sell used cars in an Industrial zone, which is not A~owed under the Zo-~-~ By-Laws. The Board stated that Cashman on Sutton Street was denied a permit because it is in an Industrial zone. The se~e e~nditions apply to George Farkas. Under Section ~.A1 of the Zoning By-Laws, a special poA-~it ie exlmr~sely l~ohibited. Farkas is an illegal operation since June 1st, It wes an ~egal license in the first place when issued by the Board of Sele~n. I% has not yet been renewed by the Selectmen since the ~/-~-~-~ Board seat rhea a lette~ regarding the license. Selling used cars &C~'A~ly is not an accessory use. Mr. Chapulia made a --_tion to _-=-_~ ~_-letter to the Beard of Seleet~en, seconded by Hr. Farley and voted unamhaously. The B~ard then further discussed the petitions of Broadheed and Indelas and stated that the decisions made by the Board of Appeals were not right, that the land needs to be rezoned first. A letter w~ be sent to the Board of Appeals regarding these petitions and also requesting the~ to meet with the P~a~8 Board. The newspaper reporter ~as present. Atty. John Willis appeared before the Board to ask for his copies of the plans of his property on Johnson St. He also dis- - cussed having a hearing and ~ apply at the Sept. 10 meeting.
