Regular Meeting & Hearing
The Planning Board held ~heir regular meeting on ~onday evening, OctoBer 1, 1952
at 7s30 P.M. in the Town Building with the following ~embers present: Ja~es M.
BA~uan~ ~hairaan; Robert J. Burke, Secretary; Howard Gilman, William Chppulis an~
George Farley.

Secretary Burke read the legal notice and description of the land, bordering
Massachusetts Avenue and Wood Lane. There were approximately five abutters present.
Atty. John J. Willis sho~ed the plans and explained the sub-division to the Board.
There are 34 lots~ several of the lots are on accepted streets, Nos. 1 & 34 and 13
through 1§~ the remaining lots are to be approved, but all lots are shown on the
plan to make it easier and clearer. Ail lots have the required frontage and re-
quired area. Ail provisions have been made for all utilities, sewer, water, surface
· drain~ estimate as to coat of sewer and water; estimate as to street drainage; also
prices on oil and gravel and bituminous concrete roads. This area ~as developed
on the basis of requirements for oil' and gravel. Martin Ave. is recorded on an old
plan, is a paper street; will end up as impassable. There is sewerage on Adams
Avenue nee; the rest of the land at the end of the street could be developed.
Hr. ~elley, %4 Woodstock St., questioned the size of a~ae ~f the lots, saying they
are 100 feet in front and narrow down to §O fret"in the back. He can't envision
houses that would be as good as the houses on Woodstock:..St.. Wanted to know what'
type of house is planned for such size Iota.
Atty. Willis said that there are § houses now ~nder construction ~hich will be sub-
stantially better than the houses on Woodstock St. now.
Hr. Willian Driscoll, Woodstock St., asked if the street would be put in cc~letel~
before the houses are built.
Hr. Bannan said that a covenant is required so +~t the street has to be cc~pleted/
Andrew Bo-~hue, Weed Lane, son-in-law of James Roehe, obJect~ to ~ood Lane being
called a private way and with t2~tngs being laid out the way they are now, there ia
strip of land that wo~__d leave them closed in.
Atty. Willis said the empty land is a result of the town changing the course of Wood
Lane. Since 1908, Wood Lane is supposed to be where it is located now. Tt was ruled
by TO~n Counsel, notices were sent out, a hharing was held, etc.
Hr. Donahue said he doesn't want to be closed off! he wants to know the status of
his land.
Atty. ~illis said either Hr. Roche will buy the strip of land from Willis or Willis
from Rpche. The old roadway ia the private way. He had to go by some bounds for the
description, so he called Wood Lane a p~ivate way.
~r. Barman checked the status of Wood Lane on the street records and said that
Lane aa sho~n on the Willis plan is as the Town of North ~n~over clai~ it is.
Hr. Donahue said he was worried about the bounds of Wood Lane and wanted to be re-.
corded aa his objecting.

Atty. ~lltS said he will Just develop the street to the end of his property.
Nr. Burke asked if he was going to put up a bond.
Atty. W4114S said he would rather put up a cov~mant. Title would not he accepted
until c~iitions are mat. He will have the gas inst~lation checked-with the
Gas Oo~pany.
~r. hannah said he would like to have all underground work for gas done before
completing the road.
Mr. Burke said to have all ser~Tces connected before the road is completed.
Atty. Willis said he gave the Gas. Company a copy of the plan~ a~ an engineer is
workin~ on it new, but it takes time. The gas will go in about the same time as
water, sewer and surface drains go in. Mr. Duffy can't bring in lines to vacant
lots because he doesn't know where the house and connections are going to go.
~r. Burke said that in Andover they do it and it's working out very well.
~r. Driscoll asked what a covenant was.
Atty. Willis explained that a covenant is recorded at the Registry and it ia what a
developer has to do and everything must be met and signed and released by the Plannimg
Board. You can't sell a lot or a house until all conditions have been met. A
covenant could be drawn up with respect to water, sewer and surface drainage and
then post a bend as to the requirements of the street.
Hr. Shelley asked if there was any range in price as to the style af he, sos.
Mr. Willis said they would cost around Z20~O00. There is nothing te worry about,
the houses will he attractive.
Barman emplained that this Board has nothing to do with the style of houses.
Chepulis asked if he ~ld regrade Wood Lane.
Willis said he would, that smme has been regraded a3_ready.
Mr. B~,an em~lained that a covenant is drawn up by Town 0~unsel so there~ nothing
to worry al~h% as far as that goes. The Board favors a bituminous c~ncrete finish
for the roads, even though it would be more expensive for the developer.
Mr. Burke made a m~%ion to take the matter under advisement'.. Mr. Chepulis seconded
the motion and the vote was unanimous.
FASS. FED. ~F P~G BOARDS:
The Board discussed the Annual Meeting of the Mass. Federation of Pla~ing Boards to
be held in Chicopee, Mass. on October 13, 19~2. Mr. Farley _w~__de a motion to have the
Chairman attend the meeting and allow the necessary expenses. Hr. B~rke seconded the
motion and the vete was unanimous.
FED~SAL GRA~T~
Mr. Barman em~lained to the Board that North Andover can cema under the Federal
~vernment for a master plan that was never completed, to tsk up where we left
off 6 years ago. The teen pays 1/3 and the Fed. gov't, pays 2
October 1, 1962
The Board discussed tbs sub-division hearing.
Mr. Burke says that Willis should put the services in and hot top the street first.
Infor~ the Selectmen that the Gas CO. is to put in the servides first or not be
allowed to put it in at all.
Mr. ~i~ said they should have a time limit so that the street w~ld be finished
right.
Mr. ~urke said that it was done in Andover, that m~ utilities were put in first and
then finished the street amd it worked out all right. Willis can do one street at a
~tme.
Mr. ~aepnlis said we can write that in on our approval.
Mr. Barman said we can insist on a covenant but w~ald want a b~nd to cover the
finishing of the street.
Mr. ~ilman agrees with Mr. Burke to have the services installed first and the~
finish the Street.
The Board spoke about Mr. Duffy not liking to do things that way, ~ut he could always
come before ~e Boar~ and explain ~y.
