The Board finds that the circumstances of the land and structure of 213 Sutton Street(Map 39,Parcel 15)especially affects this land and structure and does not affect generally the Industrial-S(I-S)zoning district in which it is located. The Board finds a literal enforcement of the provisions of Paragraph 8.1.7 would involve substantial hardship, financial or otherwise,to the petitioner. The Board finds that there was no written or spoken opposition. The Board finds that the revised Site Plan dated May 28,2008 shows that the driveway shall be painted and signed as one way, only. The Board finds that desirable relief of 13.2'may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the North Andover Bylaw, Also, the Board finds that the applicant has satisfied the provisions of Section 9,Paragraph 9.2 of the zoning bylaw and that the granting of this Special Permit to extend the use of 213 Sutton Street is in harmony with the general purpose and intent of the by-law. The Board finds that 213 Sutton Street is an appropriate location for a medical office;medical offices are an allowed use in the I-S Zoning District. The proposed medical offices,as developed, will not adversely affect the neighborhood because there are other medical offices in Sutton Street neighborhood. The Board finds that there will be no nuisance or serious hazard to vehicles or pedestrians due to the one-way driveway being signed and painted The Board finds that adequate and appropriate facilities,Town water and sewer, electricity, and telephone, are provided for the proper operation of the proposed use. The Board finds that the renovation of 213 Sutton Street from non-conforming residential dwelling to conforming medical office use is in harmony with the general purpose and intent of this Bylaw and this change, extension or alteration shall not be substantially more detrimental than the existing structure to the neighborhood. This grid paver provides a sustainable solution to surface erosion allowing infiltration of water and the ability to establish vegetation. Grasstone"'11 offers limited protection for erosion control of mild slopes and landscaping berms. Grasstone'II reinforces grass areas by providing a concrete matrix support combined with topsoil and vegetative cover. Grasstone'II has been used extensively for vegetated fire lane pavements when designed and constructed according to conventional pavement design. This layer of concrete and organic materials shall be constructed over a structural base course designed to carry the anticipated loads and repetitions. This system can provide substantial pavement strength to minimize rutting and create a suitable platform for intermittent vehicular use. Vegetation is recommended for maintaining environmental benefits. Civil engineering, according to local building codes and municipal requirements may be required.
