Regular Meeting
The Planning Board held their regular meeting on Monday evening, February 4,
1963 at 7:30 P.M. in' the Town Building with the following me,ers present and
voting: James M. Barman, Chairman; George M. Farley and WillAam Chepulis..
Atty. Edward L. Lanigan appeared before the Board to inquire about Sylvan Terrace
Extension and showed a plan which is a recorded sub-division. He wanted to know
what the present status was and'what would be required. He would l~e a letter
from the Boar~ in order to have something to show his client. ~ Sylvan Terrace
Extension is shown on "Plan of Sylvan Terrace Ext. North Andover, Mass., Colgate
Construction 0o., Inc., owner; dated September 5, 1958, Ralph B. Brasseur,
Engineer. Plan No. 3722." Mr. L~gan said Leo F. Ga~v~y, 573 Mm~- St.,
Winchester is the lawyer for Mrs. Colgate.
The Board will send'Atty. Le~gan a letter stating that i~rther information
~ill require new quotations on costs for water, sewer, surface drm~Age, street
construction and hot top. A bond covering performance will be required and work
m~st be completed within two years. The present regulations are 28 ft. travelway.
Atty. Ralph E. Finck was present to apply for a re-zoning hearing. Atty. John 3.
Willis was also present with petitions for re-zo~-8 hearings. There will be
nine re-zO~g hearings. Mr. Chepulis made a motion to divide the hearings and'
hold them on the following dates: February 25, ~arch 4 and March 13, 1963. l~r.
F?rley seconded the motion and the vote was unanimous.
Mr; Edward Phelan, Board of Assessors, was also ~resent regarding the hearing
for re-zo~-g to be sponsored by the Pla~g Board on Turnpike Street.
The Board discussed a letter from Oscar Root, Chairman of the North Andover
Conservation Commission. He suggested that the Planning Board move to have a
p~reel of land owned by Arthur B. Colgate on Osgoed Street at the head of Lake
Cechichewick zoned as rural residential instead of as business, as it is at
present. Mr. Chepulis explained further as a member of the Conservation Commission
also.
Mr. Barman explained that the Pla~ng Board has no power to re-zone a~s
land without their permission. The owner can refuse to have it re-zoned. The
Pl-~ng Board could not initiate such a tb~Bg. A letter ~ he sent to Mr.
Root _~orm~g them that the Planning Board does not feel obligated to make any
recommendations for re-zoning.
The Board discussed the Plamniug Board ~dbook that was prepared by T~n Counsel
Arnold Salisbury and signed the necessary papers.-
