Dear Mr. Foley,
I have reviewed the application for endorsement of a plan believed not to require approval
submitted on September 2, 1997 for land on Bradford Street owned by Anne Mohnkern Renshaw,
Tr.. The following items as required by Section 3(A) of the North Andover Subdivision Rules
and are missing:
Section 3(A)(1)(b): The FORM A plan shall be reviewed by the Town Planner prior to being
time stamped by the Town Clerk.
Section 3(A)(2): The plans must be at a scale of 1” =40'. At this scale it is difficult to
determine the extent of wetlands on the lots. Under Section 2(C) of the North Andover Rules
and Regulations the Planning Board will not sign an ANR plan if the lots to be created or altered
can only be accessed by crossing a wetland from the legal frontage
Section 3(A)(2)(d): Note 4 incorrectly identifies the zoning of this property. This site is located
in the R-I Zoning District and is in the Lake Cochichewick Watershed Protection District.

Therefore, the North Andover Conservation Commission (hereafter
the "NACC") hereby finds that the following conditions are
necessary, in accordance with the Performance Standards set forth
in the State Regulations, the local ByLaw and Regulations, to
protect those interests noted above. The NACC orders that all
work shall be performed in accordance with said conditions and
with the Notice of Intent referenced above. To the extent that
the following conditions modify or differ from the plans,
specifications or other proposals submitted with the Notice of
Intent, the conditions shall control.
GENERAL CONDITIONS
1. Failure to comply with all conditions stated herein, and with
all related statutes and other regulatory measures, shall be
deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any
exclusive privileges; it does not authorize any injury to
private property or invasion of private rights.
3 . This Order does not relieve the permittee or any other person
of the necessity of complying with all other applicable federal,
state or local statutes, ordinances, by-laws or regulations.
4. The work authorized hereunder shall be completed within three
year from the date of this Order.
5. This order may be extended by the issuing authority for one
or more periods of up to one year each upon application to the
issuing authority at least 30 days prior to the expiration date
of the Order.
6. Where the Department of Environmental Protection is requested
to make a determination and to issue a Superseding Order, the
Conservation Commission shall be a party to all agency
proceedings and hearings before the Department.
7. The proposed work includes the creation of a walking trail by
removing existing small shrubs and understory to a width of
approximately five (5) feet.
8. The work shall conform to the following (except as noted in
the remainder of this document where revisions may be required) :

9. The following wetland resource areas are affected by the
proposed work: Buffer Zone of Bordering Vegetated Wetland. These
resource areas are significant to the interests of the Act and
Town Bylaw as noted above. These resource areas are also
significant to the recreational and wildlife interests of the
Bylaw. The applicant has not attempted to overcome the
presumption of significance of these resource areas to the
identified interests.
10. Due to the unobtrusive nature of the proposed work the NACC
neither agrees or disagrees with the applicant's delineation of
the wetland resource areas on the site and reserves the right to
confirm or deny the delineation if and when future work of a more
substantial nature is proposed. However, the applicant should
conduct field work in accordance with said plans dated 1/16/95
entitled "Existing Conditions Plan of Land" as approved by the
NACC. All feasible means of protecting adjacent BVW should be
incorporated as situations arise in the field.
11. Issuance of these Conditions does not in any way imply or
certify that the site or downstream areas will not be subject to
flooding or storm damage.
12 . The conditions of this decision shall apply to, and be
binding upon, the applicant, owner, its employees and all
successors and assigns in interest or control.
13. The NACC finds that the use of the upland areas and buffer
zone proposed on this site to construct a walking trail will not
cause further alteration of wetland resource areas. The trail as
proposed shall be constructed according to said plans except in
those areas where an encroachment to within ten feet (101 ) of the
wetland resource area(s) is shown (see below) . In order to
prevent any alteration of wetland resource areas beyond those
proposed in the Notice of Intent and approved herein, a minimum
setback distance of ten feet (101 ) shall be established from the
edge of the adjacent wetland along these areas. The trail
location as proposed between wetland flags 44A through 42A is not
acceptable and shall be pulled out a minimum of ten feet (101 ) so
as not to alter the adjacent wetland. In addition, the ten-foot
(101 ) setback shall be established from the edge of wetlands for
the following flag locations: 2A, 17A, 47K and 106A. No
disturbance of existing grade, soils or vegetation is permitted
in the no-disturbance zone. (See Appendix 5 of the Local
Regulations) .

14. The applicant shall follow the guidelines as written in
correspondence referenced in Condition #8. It is agreed that the
proposed measures described in this correspondence will safeguard
the interests of the Wetlands Protection Act.
PRIOR TO CONSTRUCTION
15. No work shall be undertaken until all administrative appeal
periods from this Order have elapsed or, if such an appeal has
been filed, until all proceedings before the Department or Court
have been completed.
16. This Order shall be recorded by the applicant at the
Registry of Deeds immediately after the expiration of all appeal
periods. No work shall be undertaken until the Final Order has
been recorded in the Registry of Deeds or the Land Court for the
district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the
Final Order shall also be noted in the Registry's Grantor Index
under the name of the owner of the land upon which the proposed
work is to be done. In the case of registered land, the Final
Order shall also be noted on the Land Court Certificate of Title
of the owner of the land upon which the proposed work is to be
done. The recording information shall be submitted to the North
Andover Conservation Commission on the form at the end of this
Order prior to commencement of the work.
17. A sign shall be displayed at the site not less than two
square feet or more than three square feet in size bearing the
words, "Massachusetts Department of Environmental Protection,
File Number 242-73411.
18. Any changes in the submitted plans caused by the applicant,
another Board's decision or resulting from this Order of
Conditions must be submitted to the NACC for approval prior to
implementation. If the NACC finds said changes to be
significant, the NACC will call for another public hearing (at
the expense of the applicant) . Within 21 days of the close of
said public hearing the NACC will issue an amended or new Order
of Conditions. Any errors found in the plans or information
submitted by the applicant shall be considered as changes. The
proposed project may be still under review by other local or
state boards or agencies. This may result in changes to the
project plans or wetland impacts. If any such changes occur a
revised plan and an explanation of the revisions shall be
submitted to the NACC for review and approval prior to the start
of construction. No work shall begin on a project until written
approval has been granted by the NACC.
19. The applicant shall contact the Conservation Office prior to
site preparation or construction and shall arrange an on-site
conference with an NACC representative, the contractor and the
applicant to ensure that all of the Conditions of this Order are
understood. This Order also shall be made a part of the

contractor's written contract. The applicant or contractor shall
notify the NACC in writing of the identity of the on-site
construction supervisor hired to coordinate construction and to
ensure compliance with this Order.
20. The applicant shall submit a construction schedule/sequence
to the NACC detailing the proposed sequence of work on site to
complete this project.
21. Wetland flagging shall be checked prior to start of
construction and shall be re-established where missing so that
erosion control measures can be properly placed and wetland
impacts can be monitored.
22. A temporary haybale or silt fence shall be established and,
as approved, will move forward as construction progresses.
Additional erosion prevention and sedimentation protection
measures found necessary during construction shall be implemented
at the direction of the NACC.
23. The applicant shall have on hand at the start of any soil
disturbance, removal or stockpiling, a minimum of 25 hay bales
and sufficient stakes for staking these bales. Said bales shall
be used only for the control of emergency erosion problems, and
shall not be used for the normal control of erosion.
DURING CONSTRUCTION
24. Upon beginning work, the applicant shall submit written
progress reports every month detailing what work has been done in
or near resource areas, and what work is anticipated to be done
over the next period. This will update the construction
sequence.
25. As stated on the approved plans referenced above: all work is
to be done by hand; meander trail as required to avoid trees and
large boulders; existing turf shall remain in place and small
voids will be filled by hand as required; remove all brush and
dispose outside of Buffer Zone for pick up.
26. No exposed area shall remain unfinished for more than thirty
(30) days, unless approved by the NAM
27. There shall be no stockpiling of soil or other material.
28. All waste generated by, or associated with, the construction
activity shall be contained within the construction area, and
away from any wetland resource area. There shall be no burying
of spent construction materials or disposal of waste on the site
by any other means. The applicant shall maintain dumpsters (or
other suitable means) at the site for the storage and removal of
such spent construction materials off-site.

29. Accepted Soil Conservation Service (SCS) standards and
procedures shall be followed (see correspondence dated 3/15/95) .

the NACC or agent shall

enter upon and inspect the premises to evaluate and/or effect
compliance with this Order of Conditions. The NACC reserves the
right to require, following field inspection, additional
information or resource protection measures.
31. During and after work on this project, there shall be no
discharge or spillage of fuel, or other pollutants into
any wetland resource area. If there is a spill or discharge of
any pollutant during any phase of construction the NACC shall be
notified by the applicant within one (1) business day. No
construction vehicles are to be stored within 100 feet of wetland
resource areas, and no vehicle refueling, equipment lubrication,
or maintenance is to be done within 100 feet of a resource area.
AFTER CONSTRUCTIO
32. Pesticides and herbicides shall not be used within 100 feet
of a wetland resource area. This condition is issued under the
authority of the Town's Wetland Protection ByLaw.
33 . Upon completion of construction and grading, all disturbed
areas located outside resource areas shall be stabilized
permanently against erosion. This shall be done either by
loaming and seeding according to SCS standards. If the latter
course is chosen, stabilization will be considered complete once
vegetative cover has been achieved.
34. Upon completion of the project, a Certificate of Compliance
will be issued at the discretion of the Conservation Commission
and based upon a satisfactory report from the Natural
Resource/Land Use Planner.
35. The following special conditions shall survive the issuance
of a Certificate of Compliance for this project:

Dear Ms. Bradshaw,
The North Andover Planning Board held a public hearing on
Tuesday evening, April 18, 1995 in the Library Conference Room at
the Town Hall Building on the application of C/M Realty Trust
c/o Anne Mohnkern Renshaw, 2910 Military Road, Washington, D.C.
20015 requesting a special permit under section 4. 136 Paragraph 5
(a) (Watershed Protection District) of the North Andover Zoning
Bylaw. The legal notice was properly advertised in the North
Andover Citizen on March 29 and April 5, 1995 and all parties of
interest were duly notified. The following members were present:
Joseph Mahoney, Vice Chairman, Richard Rowen, Clerk, Alison
Lescarbeau and John Simons.
The petitioner was requesting a special permit to allow the
construction of a Walking Trail within the Watershed Protection
District. The premises affected is Assessors Map 62, Parcel 5
located on Bradford Street, in a Residential 1 (R-1) Zoning
District and the Watershed Protection District.
Richard Rowen read the legal notice to open the public
hearing.
Ms. Colwell stated that since work will be done in the buffer zone,
there is a need for a public hearing.
Mr. Gerry Foley of Belanger & Foley presented the plan. Only hand
tools to be used, no equipment. Logs will be put in place to

define the trails. Drainage structures are not necessary.
The owner wants a walking trail in place before something happens,
such as the land being developed. According to Mr. Foley, there is
some discussion regarding developing the land, but the present
owner does not want to be the developer.
Mr. Brown, abutter, spoke regarding his property abutting the
walking trail. Is concerned over whether or not he would have any
problems in the event he wanted to develop his property.
Mr. Mahoney: doesn't foresee any problems with that.
On a motion by Mr. Simons, seconded by Mr. Rowen, the public
hearing was closed.
Mr. Mahoney directed staff to draft a decision for the May 16th
meeting.
The Planning Board held a regular meeting on May 16, 1995.
The following members were present: Richard Nardella, Chairman,
Joseph Mahoney, Vice Chairman, Richard Rowen, Clerk, Alison
Lescarbeau, John Simons and Alberto Angles.
It was decided by the Board that no bond will be required for
this project.
On a motion by Mr. Rowen, seconded by Ms. Lescarbeau, the
Planning Board voted unanimously to approve the Special Permit as
amended.
Attached are those conditions.

Military Rd, Washington, D.C. 20015, dated March 14, 1995,
requesting a Special Permit under Section 4.136 of the North
Andover Zoning Bylaw to allow vegetation removal within the Non-
Disturbance Zone of the Watershed Protection District.
FINDINGS OF FACT
In accordance with 4. 136(7) the Planning Board makes the finding
that the intent of the Bylaw, as well as its specific criteria, are
met. Specifically the Planning Board finds:
A. The walking trail will be created by removing small
plants and trees less than two (2) inches in diameter.
The trail does not require any construction therefore
there will not be any significant degradation of the
quality or quantity of water in or entering Lake
Cochichewick.
B. There is no reasonable alternative location outside the
Non-Disturbance as the purpose of the trail is view the
wetland resource area and enjoy the natural environment
of the site.
In accordance with Section 10.31 of the North Andover Zoning Bylaw,
the Planning Board makes the following findings:
A. The specific site is an appropriate location for the
trail as this is an area of Town designated for
protection by the Open Space Plan. The trail will allow
people to enjoy the natural environment of the site;
B. The use will not adversely affect the neighborhood as the
lot is located in a residential zone and abuts the
Mazurenko Farm preservation area;
C. There will be no nuisance or serious hazard to vehicles
or pedestrians;
D. Adequate and appropriate facilities are provided for the
proper operation of the proposed use;
E. The Planning Board also makes a specific finding that the
use is in harmony with the general purpose and intent of
the North Andover Zoning Bylaw.
Upon reaching the above findings, the Planning Board approves this
Special Permit based upon the following conditions:
SPECIAL CONDITIONS:
1. This decision must be filed with the North Essex Registry of
Deeds. The following information is included as part of this
decision:
a. Plan titled: "Proposed Walking Trail", Bradford Street
North Andover

b. Letter dated March 17, 1995, from I. William Place, P.E. ,
to North Andover Planning Board stating that this project
will not cause any adverse effects on the Watershed
Protection District.
Any changes made to these plans shall be approved by the Town
Planner. Any changes deemed substantial by the Town Planner
will require a public hearing and modification by the Planning
Board.
2. Prior to any work on site:
a. No performance guarantee will be required for this
project.
b. All erosion control measures must be in place and
reviewed by the Town Planner.
C. The site shall have received all necessary permits and
approvals from the North Andover Conservation Commission,
and be in compliance with the above permits and
approvals.
3. In no instance shall the applicant's proposed area of
disturbance be allowed to further impact the site than as
proposed on the plan referenced in Condition # 1.
4. No open burning shall be done except as is permitted during
burning season under the Fire Department regulations.
5. The provisions of this conditional approval shall apply to and
be binding upon the applicant, it's employees and all
successors and assigns in interest or control.
6. This permit shall be deemed to have lapsed after a two (2)
year period from the date on which the Special Permit was
granted unless substantial use or construction has commenced.

Re: Lots 1 &2 Bradford Street—Frontage Exception Special Permit.
Dear Ms. Griffin:
On behalf of Tara Leigh Development, LLC. I am pleased to provide the attached Special Permit
applications for two frontage exception lots on Bradford Street in North Andover.
The following is a brief description of the proposed lots, existing property, and the specific
requirements to be met for the issuance of the Special Permits.
1. Description of Proposed Project:
These applications seek to allow access to Lot 1 &Lot 2 across the proposed frontage on
Bradford Street, a public way in the Town of North Andover. The lots have an excess of
50' frontage, and contain approximately 9.0 +/- and 8.5 +/- acres respectively, both
providing more than three times the area required in the R-1 Zoning District.
2. Description of Premises:
Both lots are presently undeveloped, consisting of woodlands and open fields. Lot One
(1) contains approximately 9.006+/-acres and has 50.19' +/-, and Lot Two contains
approximately 8.489+/-acres and has 50.40' +/-on Bradford Street, a public way in the
Town of North Andover. (shown as Lot-1 and Lot-2 on the attached plans).
3. NAZB Section 10.31, SPGA findings to be met:
a. The specific site is an appropriate location for such use, structure or
condition.
The property is zoned for residential use, and only one (1) single-family dwelling
will be constructed on each lot.
b. The use as developed will not adversely affect the neighborhood.
The development of single family homes on lots in excess of 8.5 acres is in keeping
with the current zoning and respects the rural character of the existing
neighborhood
C. There will be no nuisance or serious hazard to vehicles or pedestrians.
The limited traffic associated with the proposed homes will have no impact to the
safety of vehicles and pedestrians in the area. Each driveway will have adequate
site distance for entering and exiting Bradford Street.
d. Adequate and appropriate facilities will be provided for the proper operation
of the proposed use.
Each home will be provided with appropriate utilities, septic system and drinking
water well in conformance with the requirements of the Town of North Andover.
C. The SPGA shall not grant any special permit unless they make a specific
finding that the use is in harmony with the general purpose and intent of this
bylaw.
We are confident that the plans and supporting information we have submitted are
in keeping with the general intent of the North Andover Zoning Bylaw, and are in
the best interest of the neighborhood and the Town of North Andover. For these
reasons, we request that the Planning Board issue a Special Permit Approval for
each of the two lots.
4. Specific Requirements to be met for obtaining a Frontage Exception Special
Permit:
1. The area of the lot exceeds three (3) times the minimum lot area required
for that district;
The R-1 Zoning District requires a minimum lot area of two (2) acres. Section
7.2.2 of the NAZB allows a reduced frontage of 50' with the provision of three
times the required area, or a minimum of six(6) acres.
Lot One (1) contains approximately 9.006+/- acres and has 50.19' +/-, and Lot
Two contains approximately 8.489+/- acres and has 50.40' +/- on Bradford
Street, a public way in the Town of North Andover. (shown as Lot-1 and Lot-
2 on the attached plans).
2. The lot has a minimum continuous street frontage of not less than fifty
(50) feet and a width of not less than fifty (50) feet at any point between
the street and the site of the dwelling;
Lot One(1) contains approximately 9.006+/- acres and has 50.19' +/-, and Lot
Two contains approximately 8.489+/-acres and has 50.40' +/- on Bradford
Street, a public way in the Town of North Andover. Both lots maintain a
minimum width of 50' between the street and the site of the dwelling. Please
refer to the attached plans for specific dimensions.
3. There is not more than one other such lot with frontage contiguous to it;
There is not more that one other frontage exception lot contiguous to either
Lot 1, or Lot 2.
4. It is so located as not to block the extension of a dead end way;
Both lots have frontage on Bradford Street, which is a through way connecting
Great Pond Road and Barker Street. The creation of these lots will not block
the future extension of a dead end street.
5. The creation of the frontage exception lots will adversely affect the
neighborhood;
The development of single-family homes on lots in excess of 8.5 acres is in
keeping with the current zoning and respects the rural character of the existing
neighborhood. The limited traffic associated with the proposed homes will
have no impact to the safety of vehicles and pedestrians in the area. Each
driveway will have adequate site distance for entering and exiting Bradford
Street.
6. The creation of the frontage exception lots is in harmony with the general
purpose and intent of the Bylaw;
We are confident that the creation of these frontage exception lots are in
keeping with the general intent of the North Andover Zoning Bylaw, and are in
the best interest of the neighborhood and the Town of North Andover.
7. No such lot as described above, on which a dwelling is located, shall be
hereafter reduced in area below the minimum area required in Section
7.1 of the North Andover Zoning Bylaw;
Each lot presently conforms with the requirements of Section 7.1, and will not
be reduced in area below the minimum area required by the current Bylaw.
We are confident that the plans and supporting information we have submitted are in keeping with
the general intent of the North Andover Zoning Bylaw, and are in the best interest of the
neighborhood and the Town of North Andover. For these reasons, we request that the Planning
Board issue a Special Permit Approval for each lot in question.
