Special Meeting
The Planning Board held a special meeting on Monday evening, June 24th, at
7:30 P.M. ~ith the follo~g members present: James M. Barman, Chairm~-;
N~ward G~lw~, Robert J. Burke a~d William Chepulis. Mr. Farley could not attend
due to the illness of his wife.
The Board Mt in order to discuss and make reco~nendations on the plans of Al.bert
Steinberg for an apartmsn~ development. The Board of Appeals held a hearing and
s~nt a letter and copy of plans to this Board for their discussion and reco~endations
in order that they may make a decision.
Mr. Gi~ questioned ~ether it was a sub-division.
Mr. Barman said that Town Counsel Sslisbury says it is not a sub-division and that
a hearing under the Planning Board is not necesssmy. He said do you want to tttrm it
down and ,~_ke a sub-division?
Mr. G~ said we would have more protection.
Mr. Barman said if we give reco~nendations and they dontt ~ollow them, they ~ t~ve
a hard t~ building more.
Mr. G~,~n said this is a private street; he wontt keep it up.
Mr. Barman said he ~-Lll have to post a bond.
Mr. Gilman said if we make recommendations then we are covered.
¥~. Burke said a cove~t is better; a bond runs forever. We should put a~time l~t
on all future bonds, etc. If something happens we can extend it.
Mr. Chap, s~$ said the Town cantt accept it as~a street. It is a private enterprise.
Mr. Barman said there shoDld be a provision if he ever develoPs further; should he
extend from that road.
Mr. Gil~ said, is he going to~ plow the street,, take care of it, et~, In ten years
the town ~ be in trouble. He' s got a sub-division and a private way.
Mr. Chepulis said this is one~iot of land, so it's not a sub-division; the land is
not being divided.
Mr. Burke said he ts not asking to sub-divide; it ts all in one lot.
Mr. Gilma~ said, I don't go for a private road. When this is sold individually,
everyone will eq~in to the town.
Mr. Chep~lis said they cantt be sold individually.
Mr. Gilman said these can be sold individually because they conform ~ith the zoning
regulations. This is Just another gimmick for getting the thing over. ~d it is
Just Mro Salisburyt s interpretation.

Mr. Barman said the plans are signed only by a land surve2pr. They should also be signed
by a Registered CivLl Engineer. The plans should contain both signatures.
Mr. Gilman said he would never go along on a private road; has to be accepted by the town.
Mr. Chepulis read parts of the sub-division Control Law pertaining to number of lots,
road, etc.
Mr. O~man said I'll go along as a sub-division road but not as a private road.
The Board ihen discussed where the water was going, etc. and read the letter from
the Board of Public Works with their requirements. Mr. Barman explained that the
contractor puts everything in under town supervision. He should see that he gets
easements as long as this is a private way. It is very important that he gets the
easements. Our only Jurisdiction comes under t~e_ roadmmy.
Mr. G~lm~nmade a motionthetMr. Steinberg conform withtherulesandregulations of
the latest sub-division Control Law pertaining to streets. Mr. Burke seconded the
motion and the vote wnsunanimous.
Mr. Chepulis said it should go on record about having the double s~n_S~rd of a
registered land surveyor and a registered civil engineer on plans. ~e then checked
the plans again and said, he's dividing his land which makes 2 lots, so it is a
sub-division.
Mr. Burke said if he builds this road according to the Sub-division Ccmtrol Law, he
can have other lots farther on.
Mr. Barman said he can't come in for a sub-division unless he has access to a public
street.
A letter will be sent to the Board of Appeals with the_ following list of reco~endations:
1. Suitable bond or covenant should be required on water installation and stree~
construction.
2. A plan should be presented showing where excess surface water wtl~ go.
3. An easement should be received from the owner, granting access to the road.
4. Road sh~ld be constructed of b~t, minons concrete.
5. Plans should require stamps of both a Registered Professional Civil Engineer and
a Registered Land Surveyor.
A man was present to ask the Board to sign plans with the stamp not reqn~Flng Planni~
Board approval for land of Mazure_~_~_o.
The Board signed bills for.' N.E. Tel. & Tel. Co. $8.65
