The North Andover Board of Appeals held a public hearing at its regular meeting in the North Andover High School
Lecture Hall,430 Osgood Street,North Andover,MA on Tuesday the 18th of December,2007 at 7:30 PM upon the
application of Matthew J.Burke, 14 Chickering Road, for premises at:Lot 2 Cotuit Street(Map 47,Parcel 148),
North Andover,MA requesting a Special Permit from Section 4,Paragraphs 4.122.14.A.b,4.122.14.1),and Section 10,
Paragraph 10.3 of the Zoning Bylaw in order to construct a two-family dwelling on a conforming lot. Said premises
affected is property with frontage on the North side of Cotuit Street within the R-4 zoning district. Legal notices were
sent to all names on the abutter's list and were published in the Eagle-Tribune,a newspaper of general circulation in
the Town of North Andover,on October 22&October 29,2007. The legal notice,only,was read then the hearing was
continued to December 18 during the regular November 13,2007 meeting.
The following voting members were present: Joseph D.LaGrasse,Richard J.Byers,Albert P.Manzi,111,Thomas D.
Ippolito, and Richard M.Vaillancourt. The following non-voting members were present: David R.Webster and
Daniel S.Braese.
Upon a motion by Richard J.Byers and 2d by Joseph D.LaGrasse,the Board voted to GRANT a Special Permit
from Section 4,Paragraphs 4.122.14.A.b,4.122.14.1),and Section 10,Paragraph 10.3 of the Zoning Bylaw in order to
construct a two-family dwelling on a conforming lot per:

The Board finds that Cotuit Street is in the Residential Four Zoning District,and that the Zoning Bylaw allows two,
three,four,and five dwelling units by Special Permit. The Board fmds that there are multi-family dwellings on Cotuit
Street,and on neighboring Leyden and Brewster Streets. The use,as developed,will not adversely affect the
neighborhood because the proposed two-family dwelling,as designed,will conform to the character of the
neighborhood in size, structure,and appearance. The Board finds that there were no adverse letters or adverse spoken
comments during the hearing,and that there will be no nuisance or serious hazard to vehicles or pedestrians because
the lot can accommodate the required 4 off-street parking spaces. Adequate and appropriate facilities,electricity,
phone,Town water,and Town sewer lines,are provided to Cotuit Street lots. The Board finds that the applicant has
satisfied the provisions of Section 4,Paragraphs 4.122.14.A.b,4.122.14.13,and Section 10,Paragraph 10.3 of the
Zoning Bylaw in order to construct a two-family dwelling on a conforming lot and that the granting of this Special
Permit for a two family dwelling unit at Cotuit Street,Map 47,Parcel 148 is an appropriate location because there are
other two-family dwellings on Cotuit Street. The Board fmds that this Special Permit is in harmony with the general
purpose and intent of the above cited bylaws,and this two-family dwelling unit shall not be substantially more
detrimental than the existing single,two-family,and multi-family dwellings in the Cotuit,Brewster,Acushnet,Leyden,
Jefferson,Kingston,and Village Green neighborhood.
Note: 1. This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of
Deeds,Northern District at the applicant's expense. 2.The granting of the Variance and/or Special Permit as requested
by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide by all
applicable local, state,and federal building codes and regulations,prior to the issuance of a building permit as required
by the Inspector of Buildings.
Furthermore, if the rights authorized by the Variance are not exercised within one(1)year of the date of the grant,it
shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted
under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date on
which the Special Permit was granted unless substantial use or construction has commenced,it shall lapse and may be
re-established only after notice,and a new hearing.

Re: Robert J. Burke Trust, Cotuit Street Special Permit Application
Pursuant to paragraph#9 of the Town of North Andover special permit application,
please accept the following as written documentation.
1. We are requesting that we be allowed to build a two-family structure consistent
with the recently developed structures that we have built. The proposed structure will be
consistent in size, structure and appearance as the two structures recently developed.
2. The specific site is an appropriate location for such structure. A search of the
surrounding streets, including Cotuit Street,Jefferson Street,Kingston Street, Village
Green Drive, Brewster Street and Acushnet Street, identifies a combination of single
family dwellings, two-family dwellings and apartment complexes. The applicant
believes that the proposed structure compliments and reinforces the design features of
this neighborhood. In support,the applicant has recently completed construction of two
(2) two-family structures that abut the subject property. Said structures, as stated in this
application, are consistent in size, structure and appearance as the proposed structure that
is the subject of this application. In addition, the applicant believes that the proposed
structure assists in achieving design compatibility with the architectural features and
exterior materials of surrounding structures,not only of the applicants recently completed
structures but the surrounding neighborhoods as well.
3. The applicant believes that there will be no nuisance or serious hazard to vehicles
or pedestrians because the structure is set back from the road and the developer has and
will continue to maintain and care for the site on a daily basis.
4. The applicant/developer has ensured(and will ensure)that adequate facilities will
be provided for the intended use of a two-family structure. The applicant/developer has
already provided the proper facilities for the two previously constructed structures.
5. The applicant believes that the requested structure is in harmony with the purpose
and intent of the Zoning By-Law because the proposed structure is consistent in size,
structure and appearance as the two structures recently developed and the neighborhood
presently is made up of a combination of single family dwellings,two-family dwellings
and apartment complexes.
