The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,the 9b of
September,2003 at 7:30 PM in the North Andover Middle School Auditorium,495 Main Street,North
Andover upon the application of Eaglewood Properties,LLC,P.O.Box 337,Topsfield,MA 01983,
Vincent C. Manzi,Jr.,Attorney,Turnpike Street,North Andover requesting a dimensional Variance from
Footnote 1 of the Zoning By-law for relief of parking setbacks from Route 114(Turnpike Street)and for
relief from Footnote 2 of the Zoning By-law for an additional 15'rear setback adjacent to a residential district.
The said premise affected is property with frontage on the West side of Turnpike Street within the GB zoning
district.
The following members were present: William J. Sullivan,Walter F. Soule,Ellen P.McIntyre,Joseph D.
LaGrasse,and Joe Edward Smith.
Upon a motion by Walter F.Soule and 2°d by Ellen P.McIntyre,the Board voted to allow the petitioner to
WITHDRAW WITHOUT PREJUDICE. Voting in favor of the withdrawal: William J. Sullivan,Walter
F. Soule,Ellen McIntyre,Joseph D.LaGrasse,and Joe Edward Smith.
The Board finds that the applicant has re-designed the project to fit the Route 114(Turnpike Street)General
Business requirements.

Application for Variance for Construction of Retail Center
Route 114, North Andover
Dear Mr. Sullivan:
As you are aware, I represent Eaglewood Properties, LLC, the petitioner for a
variance for the construction of a retail center on Route 114 in North Andover. This
petition was originally heard by the North Andover Zoning Board of Appeals at their
meeting on August 12, 2003 and continued to September 9, 2003. At the original hearing
we received several comments from the Board and citizens of North Andover relative to
the layout and design of the proposed shopping,center. We have reviewed our plans have
amended our layout plan consistent with many of the comments and recommendations
presented at the August 12t`meeting. As-a result of the redesign of the shopping center,
we have moved the buildings off of the rear property line and provided sufficient truck
passageway in the rear of the property. The new layout plan complies with all setbacks
and dimensional controls of the Town of North Andover.
After further review with the Building Inspector for the Town of North Andover
and analysis of the layout plan, it has been determined that no other variances are required.
The applicant therefore withdraws both variance applications without prejudice.
Enclosed please find eight copies of the new layout plan.
Thank you for your anticipated consideration and cooperation.

Dear Mr. Sullivan:
I have reviewed the new site plan of Englewood Properties,LLC as prepared by Ian
Stephenson, C.E. #42628 of Vanasse Hangen Bruslin, Inc.,Dated: 9/03/03,Rev.i and am
of the following opinion.
• All buildings are within the front,rear and side setbacks as required by Table
1 of the Zoning By-law in the General Business District.
• Parking along Route 114 is in compliance pursuant to Page:FN 1,Paragraph
1,which states in part `fin all districts except Village Commercial,front
setbacks along Route 114 shall be a minimum of 100'. This sentence does not
stipulate any setback distance from Route 114 for parking.
As such, I am of the opinion that the entire project as shown ofthe site plan is in
compliance with setback requirements of the North Andover Zoning By-law and no
variances are required.
