Dear Mr. Sullivan:
Enclosed please find the application and plans for development of 16 units of housing, 12
market rate and 4 affordable units under a Comprehensive Permit.
The land is owned by the applicant, Highview LLC and has received site approval from
MassHousing for funding under the Housing Starts Program, and under the New England
Fund. As part of that approval, MassHousing requested we address various issues, such
as compliance with the wetland requirements of the Conservation Commission, and with
the State Code Title 5. In that regard, we have respected the Commission 25' no disturb;
50' no build zone, and have provided detention and stormwater management on site so
we have a 0% increase in peak rate of runoff from the property. We will also service the
site with municipal sanitary sewer.
MassHousing also requested we review the project with the Fire Department. In that
regard we propose to install sprinklers in each unit, we have added hydrants to the plan.
We redesigned the unit to reduce the building height,provided a driveway greater than
18' wide to access units, and flattened the grading around the buildings. We also
specified(note 8 on the plan)that the west side of Building 3 be constructed with fire
resistant siding (Hardy Board).
MassHousing suggested we consider adding additional guest parking and we have
revised the plan increasing visitor parking to 5 spaces. We have also had Attorney Daniel
Hayes of Morris, Rossi and Hayes verify that Highview LLC has the fee in Marengo
Street to provide access to the development, and to allow watermain construction to go
forward in the right of way. Although we already have an Order of Conditions from the
North Andover Conservation Commission, we will propose an amendment or a new
filing be made to them. We have also specified on the plan that all non paved areas be
loamed and seeded to assure slope stabilization of the site be provided.

The Waverly Oaks Development is located on the west side of Waverly Road approximately
250 feet south of the intersection of Waverly Road with Hawthorne Place, about'/z mile
north of the intersection of Route 114 with Waverly Road.
The site consists of 61,104 square feet or 1.40 acres land area of which 534 square feet or
0.87 percent is wetland and the remaining area(99.13%)is upland. The site is not located in
a floodplain. The site is serviced with municipal water and sewer service. The site is
serviced with natural gas, telephone, electric, and cable TV utilities. The site is vacant
woods. The site slopes down from Waverly Road towards the rear portion of the property
approximately 18 feet in 50 feet, and then 6 feet in 100 feet. This rear area of the site,with
slopes of approximately 4-6 percent is extremely suitable for site development.
The soils are a moderately drained soil type, granular, suitable for house construction.
Waverly Road is a two way paved secondary collector roadway which transmits vehicles
from many residential developments and feeder streets between Route 114 and
Massachusetts Avenue.
The site is located within close proximity of complete shopping facilities, restaurants,
commercial facilities and transportation facilities on Route 114,near Route 495 in North
Andover and in Lawrence. The site is located within close proximity of elementary schools
as well as churches of all denominations. The site is serviced with public bus transportation.
■ The land use located to the north adjacent to the site is duplex multi-family, to the west of the
site single family, to the south of the site commercial (250,000 S.F. shopping center), and on
the east multi-family houses (Archdiocese of Boston housing cooperative). The area along
the south side of the site is zoned commercial. Therefore the existing land use of the project
area can be classified as residential and commercial.
The utilities have adequate capacity and the site has adequate capability and the roadways
have sufficient capacity to support the proposed development of Waverly Oaks.

DESCRIPTION OF AMENITIES &DENSITY
WAVERLY OAKS

The Waverly Oaks Development will consist of sixteen townhouse units in three buildings
with nineteen surface parking spaces and sixteen garage spaces. Three buildings include a
duplex, six unit and an eight unit townhouse building. A majority of the site(58.38%) will
remain as vacant open space.
The site will have municipal sewer and water,underground gas, telephone,electric, and cable
television service to each of the units. Each unit will have a garage and parking area in front
of the garage. Each unit is serviced from a main spine driveway which will be built from
Waverly Road into the site. The roadway will be fully paved and curbed.

The townhouse units are each three story finished with a basement,with exterior asphalt roof
shingles, vinyl or wood siding, and window shutters. Wood decks or patios will be
constructed at each unit. The interiors will each have two bedrooms, an attic, living and
eating area, linen and other closets, full and half baths, kitchen cabinets with a fully
applianced kitchen, garage and basement bonus room.

All of the units will have carpet, linoleum or tile, have gas forced hot air or hot water heat,
gas water heater and be fully wired for cable TV.
The affordable units will not be congregated in one area but will be interdispersed in the six
and eight unit building.

The Town of North Andover has zoned this area Residential 4 which permits 6.96 units
per acre. Three times this allowed density is 20.90 units per acre. The proposed
development density is 1.1.42 units/acre or 1.6 times that permitted by the Town of North
Andover.

and project eligibility application for development of Waverly Oaks in North Andover,
Massachusetts.
The proposed housing development consists of 16—two bedroom townhouse homes on 1.4

acres of land on Waverly Road in North Andover,Massachusetts. Four of the total sixteen
' units will be affordable consisting of sixteen affordable. The existing zoning permits
duplexes on lots of 12,500 square feet or 6.96 units per acre. This proposed density is 11.42
units per acre. The development will be serviced with Municipal water, sewer,underground
drainage,telephone and electric services. The units will contain 16 garages for parking and
with the surface spaces,there are 2.18 parking spaces per unit.
' The developer has met with the North Andover Community Development Director to discuss
the proposed development. There is no local housing partnership committee. We intend to
meet with other community officials over the upcoming weeks to further solidify support for

development of Waverly Oaks in North Andover,Massachusetts.
In that regard,I am pleased to transmit to you herein a copy of the application and
exhibits.
The site is located on Waverly Road adjacent to the DeMoulas/Market Basket Shopping
Center and near Hawthorne Place. The project involves development of sixteen two
bedroom townhouses with a"garage under"in each unit,all located in three buildings.
Four of the units will be affordable while twelve of the units will be market rate for sale
condominium units. The units will be serviced with Town sewer and water service.
The site has been designed to comply with the Town of North Andover Conservation
Commission Regulations of a 25'no disturb and 50' no build setback. The Commission
previously issued an Order of Conditions to construct two duplexes in about the same
area as this proposed development.
We have built other units in North Andover and are very excited about development of
this project in the Town.

dated October 8,2003,the developer and I have met and offer the following comments:
1. Concerning g meetin with Heidi Griffin:
a) The developer currently has the fee in the land on the opposite side of
Merrengo Street and before he conveys it he will reserve the fee in the
entire right of way to this parcel.
Further,the area of Merrengo Street is 9,096 square feet or 0.21 acres. If
the area of Merrengo Street is subtracted from the entire parcel,the
remaining area will be 52,008 square feet,resulting in a density of 13.4
units per acre,still less than three times that permitted under the R-4 Zone
for this site,which is 20.90 units per acre.
b) There is opportunity to provide additional guest parking on site—we will
add additional guest spaces prior to application to the Zoning Board of
Appeals.
c) The preliminary site plans depict the finish grading proposed at the site;a
swale will be added behind the 8 unit building to assure no runoff onto
the abutting property owner.

2. Con ming additional Community Development comments:
a) The plan depicts the location of proposed erosion control,stormwater
infiltration,detention and other drainage devices. The requirements for
40B are that the developer submit a plan which depicts a"preliminary
stormwater drainage plan"—that has been submitted. Further,the
developer is aware that a filing with the local Conservation Commission
is required;it should be noted the project design complies with the local
wetland by-law(25'no disturb and 50' no build zone).
b) When the plan is filed with the Conservation Commission slope
' stabilization will be addressed,however,the plan submitted shows.no
slope in excess of 2:1 which is permitted by the Conservation
W. Commission.
' 3. Concerning Fire Chief comments:
a) The developer will provide fire sprinklers when required by code and will
consider them in non code required buildings.
b) The driveways are proposed to be paved 14'wide leaving—even if a car
(7' wide)is parked seven feet for the Fire Department to access each unit;
a 24'wide paved driveway is adequate fire lane access to the front of
each building and is being provided; further the non-paved area in front
of each building will be lawn,with no obstruction to the exitlentrance of
the building.
c The fire lane width(driveway)is proposed to be 24' wide.

d) The building architect will comply with all building code requirements
concerning access/egress.
e) The developer will add two additional fire hydrants prior to submission to
the Zoning Board of Appeals.
fj The developer will use fire resistant siding or will keep a 15' clear
setback from tall woods(trees).

Relative to the subject and the project eligibility application of September 11,2003 and my
correspondence to Ann Good of MassHousing dated November 11, 2003 please be advised
of the following:
1. The site on which this project is located is currently zoned R-4 by the Town of
North Andover which permits duplex housing on lot sizes of 12,500 square feet.
This relates to a density of 6.96 units per acre.
' 2. Applying the MassHousing rule of 4 x allowed zoning,27.87 units per acre
would be permissible on this site.
3. Given the site size of 1.4 acres, 39 units would be permissible on this site given
the above rule.
' 4. The proposed density is 11.42 units per acre,which is 1.6 x underlying zone
density. Therefore the proposed density complies with the MassHousing
requirements.
5. The land located immediately to the north of this site is developed with duplex
' homes on lot sizes of 12,500 square feet.
6. The land located immediately to the west of this site is developed with single
family homes on lots of 12,500 square feet,or 3.4 units per acre, and when
multiplied by 4 is a density of 13.94 units per acre.

' 7. The land immediately to the south of this site is developed as a commercial
shopping plaza. Residential uses are not permitted but the building and
' pavement coverage on that site is approximately 75%. The shopping center
building size is approximately 250,000 square feet with approximately 1100
parking spaces. That use is more intense than this adjacent residential density.
I have enclosed a copy of the zoning map which depicts the site,the adjacent business zoning
and the underlying R-4 zone.
' It is my opinion that the proposed development complies with the MassHousing density
guidelines or rules.
