The PLANNING BOARD held thei~ regular meeting on Monday evening, March 1, 1965
at 7:30 P.M. in the To~n Building. The followi~g members were present and voting$
James M. Barman, Chairman; Robert J. Burke, Secretary; Howard Gilman~ George
Farley and William Chepulis. .
Carl Porter, Stevens Street, appeared before the Board requesting information regarding
a right of way through his land to a back lot. The Board ~eferred h~m to the Board of
Appeals.
The Board proceeded to discuss the hear~gs held o~ last Th~rsda~ evening, Feb. 25t~
ANGUS REALTY, II~.
It was noted that the letter from ~he. Conservation Commission objecting to the re-
zoning was signed by Mr. Chepulis.
Mr. Banyan asked h~m if he wanted to disq,,~lify h~eelf since he signed the letter.
Mr. Chepulis said he ~uld not disqualify himself - he doesa't think he bas to.
Mr. Gilman made a motion to GRA~T the request and recom,~nd approval. Mr. Burke
seconded the motion. Four members voted yes and Mr. Chepulis voted no.
The reasons for approval are as follows: 1. This is exten~-g an existing business area.
2. This area is used for business at the present

Mr. Gilman made a motion to reeo,~end APPROVAL of the

Mr. Burke seconded
The reasons for approval are as follows:
1. It is net detrimental to the health and welfare of the neighborhood.
2. The origina2 planning was going to have this a business area but since the
owner is going to make a development of it, we feel that the original
reco,~endations of the Fl~nn~,~ Consultant are still proper and therefore
recommend that it be re-zoned.
3. It will be a proper business location.
3. AMEED~NTS TO ZONING-BY-LAW:
The Board members discussed the amendments to the Zonizg By-Law concerning regulation
of swimming pools. They all felt these regulations were needed.
Mr. Farley made a motion to recow~end acceptance of tB~ --~ndments end additions as
presented. Mr. Burke seconded the motion and the vote was ,m~-~m~us.
The reasons for approval are as fo~ ]o~:
1. Those regulations are absolutely necessary for the health and welfare of the
town of North Andover.

2. The Board considers this a proper zoning matter.
3. At present, there is nothing in the By-Laws to cover the regulation of
pools.
