HomeMy WebLinkAbout1967-10-30 Nonday - October 30,~ 1967 Special Meeting ~~ The Pla~ntng Board held a Special Meeting on Monday eve~tng, October 30, 1967 at ?:~0 P.M. at the North Andover High School A~torium. The following members were present and voting: William Chepulis, Jr., Chairman; Robert J. Burke, Vice Chairman; James M. Barman and George B. Farley. Howard Gtlw~ was unable to attend due to illness. T~is meeting was called in order to hold a hearing upon an Article in the Warrant for the Special Town Meeting to be held later in the eve-twg at 8:00 P.M. There were 16 people present for the hearing. Hr. Chepulis read the legal notice upon the proposal by Norman E. Lentz to amend the North Andover Zoning By-Law as follows: "To Aw~nd Section 4.?3 of the Zo~g By-Law by adding the following paragraph: When in or abutting a residential zone, the minimum lot area per dwelling unit shall be the larger of 3,500 square feet or 1/3 of the minimum lot area required for a single family d~lling or, if sewerage is not available, equal to the minimum lot area required for a single family dwelling,u Hr. Lentz gave a lengtby presentation of wh~ the Article should be adopted. Robert Gundal, Johnson St.~, also spoke in favor of the Article. ~ohn Shields, member of the Board of Appeals, spoke in opposition. Ne said the Board of Appeals had presented an Article to ~m~nd section 4.7 at a Special Town Meeting and the Planning Board had suggested waiting for a. regular Town Meeting and thinks this should be done in this case also. He sees no emergency at this tfm~ for the adoption of this article. He expls~ed how the Board of Appeals functions regarding special permits apartments and feels that the Board is capable of making of making decisions that are for the best interests of the town. Henry Lund, member of Board of Assessors, spoke in favor of apartments and said they had saved the life of the town. The town has realized $63,000 i~ taxes from apart- ment developments alone. He feels articles of this type should be taken up at a regular ~own Meeting when there are more people present to vote. Walter Green spoke in opposition to tbe Article also. John Walker, Sutton H~I Rd. was also opposed. Mr. Phelan, of the Board of Assessors, a~so spo~e in opposition to the Article. Mr. Barman made a motion .to take the petition under advisement. Hr. Burke seconded the motion and the vote was unanimous. The Board discussed and voted immediately on the petition since a recommendation had to be made to the Special Town Meeting which was being held in a matter of minutes. October 30, 1967 - cont. Mr. Burke made a motion to recommend striking the Article from the Warrant. Mr. Barman seconded the motion and the vote was unanimous; The Board felt that any Zoning articles or amendments to the Zoning By-Laws should he taken up at a regular Town Meeting and that more time should be allowed for the Board to study and consider such articles. As the ,article is presently written~ it would not be good for the Town and the present By-Laws are adequate. The meeting adjourned at 8:00 P.M. WO Chairm~n AD Clerk
