Regular M~et~-~ & Hearings
The P~a~,.tag Board held their regular meeting on ltonda~ evening, June 3,
1968 at 7.'30 P.M. in the Town Office Building meeting ro~ The following
members were present and voting: WilLiam Chepulis, Jr., Clmtrsani Robert J.
Burke, Vice Cheir~s_._-; William B. Dully, Jr., Secretary; J_~m~s M. Bsanan and
George B. Farley.
There were 25 people present for the hearings.'
BEARING: Old N. A. Realty Trust (BenJ~w~- 0sgood).
Mr. Dufl~ ~ead the legal notice in the application of 01d N.A. Realty Txmst
for a subdivision of land off Farnma Street.
BenJ~w~- 0sgood and Atty. Victor Hate~ were present.
Atty. Harem explained the definitive plans to those present and said that they
were drawn up as discussed with the Board at the last meeting. The subdivision
goes beyond the road requirements of North Audover sad conforms in all respects
to all the requirements of the town of North Andover.
They have not reaeived any requirements frol the Board of Health yet; but .11
lots need percolation tests and get approvals _t-dividually from the Board of
Health. Developer has taken some of his own tests.
Member Dully said he is oonoer~d about passing on subdivision developments
without receiving a~ information from the Board of Health. The Board has no
~n~ormation as to soil conditions, water table, etc.
Chair,~ Chepulis explained that the Board of Health does have their own rules'
and regulations and after a hearing have 45 days to ~ke recommendations. Be
said if the developer doesn't make tests beforeb--d it is his risk.
A discussion was held regarding the Board of Health, septic t*-~s, etc.
Member Duff~ said he will ahe~sin from voting wntil recommendations are received
fr~ the Board of Health. He also spoke about the condition of the roads in that
area, access f~c~ Farnu~ Street, etc.
Mr. Osgood said Farn~ Street was in terrible condition and that he has proposed
to the Highway DepOt and Board of Public Works to put in a water line and
will put an article in the warrant fo~ $16,000 contributing toward the expenses
of the town. The ~as Company will run the gas main and Oagood has offered to
supply the engineering. He will cooperate with the various departments of the
town to w~de a good roadway. Will benefit at least 16 houses ~n Farnum St.
The development comprises approx. 48 lots. He thinks they will lose about 5
lots due to poor percolation tests.
A discussion wes held with several abutters regarding water table in area, the ·
Hatch Act ami Dept. of Natural Resources.
Mr. Barman made a motion to t~ke the petition under advisement. Mr. Burke
seconded the motion and the vote was un--us.

HEARING: Caffray Realty ~-rust.

~r. Goodwin explained that the subdivision contains 4 lots. Two of the front
lots on Johnson Street can he made without Planning Board approval, and could
connect ~o the sewer. The 2 rear lots are too iow to connect to the sewer
and would have to be serviced by a 6~ water line and hydrant. The water would
drain on Caffrayta own land.
Several abutters asked questions of Mr. Goodwin-regarding drainage, ets. Letters
were read from the Board of Public Works and the High~ay Department with their
speoificetions and reeo~w~endations.
Atty. John J. Willis represented ~r. and Mrs. Irving Howes, 1~w~diate abutters,
who were also present, and ~ere concerned with drainage. Mr. and Mrs. Beek~ith,
Mr. Seeehe, Dr. Armitage, Mr. Donova~, all abutters, were concerned with drainage,
the change of the character of the area, traffic problems, fire hazards, etc.
Mr. Baxmau made a motion to take the petition under advisement. Mr. Burke seconded
the motion and the vote was unanimous.
OHARLES T. MATSES:
Atty. Willis presented a request to the Planning Board to release $1500 being
held on the Matses subdivision. A letter will he sent to James Maker, To~
Treasurer to release the bond to Atty. Willis. The Board signed the necessary
plans for the Matses subdivision.
JO~ J. SHIELDS:
A letter ~s received from John Shields ~,~orming the Board that all of the
utilities are installed in his subdivision off Rea Street and would like to be
advised as tc the amount of Bond required by the Board.
A letter was received from the Highway Department regarding the Campanelli
prel~nary subdivision plans, with reeowm~ndations. The letter will be filed
until further plans are received.
MORNINGSIDE:
A letter was received fromthe Highly Dept., copies ofwhichwere sent to
the Selectmen and Ben Osgood, regarding the hot-top on Morningside subdivision
not being adequate.
The letter will he filed and considered when a request for a release of bond is
