Hearings
The PLANNING. BOARD held a special meeting and hearings on Tuesday evening,
February 25, 1969 at 7:30 P.M. in the Town Office Building. The following members
were present and voting: William Chepulis, Jr., Chairman; George B. Farley~
Robert J. Burke; James M. Barman and Charles W. Trembly, Jr.
There were 30 people present for the hearings of the evening.
Mr. Chepulis read a letter from the Selectmen relative to the "Route ll& Study
Committee".
Mr. Chepulis read a letter from Atty. Victor Hatem withdrawing the petition of
Ben Osgood.
HEARING: Emil Camuso - Turnpike Street - Rezoning.
William Chepulis read the legal notice of the proposal of Emil Camuso to
change from Rural Residence and Country Residence to General Business a parcel of
land on Turnpike Street bounded by Hillside Road and Andover By-Pass containing
between 7 and 8 acres.
Atty. James H. Eaton, III represented Mr. and Mrs. Camuso, who were also present.
He stated they have an option to purchase the land. The petitioners own and
operate the DuBarry Dress Shop in Lawrence and would like to operate the business
in North Andover. There would be six other stores in the shopping comples which
would be compatible with the dress shop business; they would he small retail
establishments. This complex would increase the tax revenue to the town without
being a tax burden. They plan 2 exits and 2 entrances on Route 11%. There would
net be a traffic burden. A large area will be left natural so that there will be
a buffer zone between the church~ area. The Fellowship Church has a lOO-foot
buffer there now; there would be no interference with the church. This shopping
complex is the best~se for this particular area since it is an isolated spot and
locked by roads~.i~ parcel contains 7½
acres.
Mr. Chepulis asked if permission has been granted by the state for access. Mr.
Eaton said not officially yet, just proposed.
It was brought out that this same parcel of land was zoned for business in 1957
and through misrepresentation by the petitioner at that time was re-zoned back to
residential by the Planning Board.
Mrs. C~muso explained that the only types of shops would be pertaining to "Ladies".
They have outgrown their present location in Lawrence; there would be a dress and
bridal shop, millinery, beauty shop, etc.
Mr. Cushing asked how firm this commitment would be or could they change their
mind and have the same thing happen again.
Atty. Eaton explained that this could be done with any type of zoning. The
Camusos live in the area and this is their bread and butter and they would not do
wrong by the community. He believes they are very sincere~
There was further discussion relative to rezonimg an~ uses of land.

The following persons were opposed to the re-zoning:
Leo Pomerleau, Mr. and Mrs. Serio, Mr. Callahan, Mrs. Walley, Mr. Cushing, Atty.
Lynch representing Rev. Stringer of the Fellowship Church.
There was further discussion. Mr. Burke made a motion to take the petition under
advisement. Mr. Farley seconded the motion and the vote was unanimous.
HEARING: Louis J. Kmiec - Re-zoning:
Mr. Chepulis read the legal notice upon a proposal to rezone a parcel of land
on Turnpike Street from Rural Residential to General Business; this parcel is
bounded by land of Haverty and Canty and contains approx. 30,000 square feet.
Mr. Kmiec showed drawings of the real estate office he plans on building on this
parcel if it is rezoned. He has a permit from state for a drive way. The building
would set back 75 feet from the road.
Mr. Cushing opposed the petition because he is concerned about the rezoning on
Turnpike Street.
Henry Fink was in favor of the rezoning saying it would be an asset to the area
and this land abuts land already zoned for business (Totem Pole).
~lr. Farley made a motion to take the petition under advisement. Mr. Barman
seconded the motion and the vote was unanimous.
HEARING: George A. Rea - Re-zoning:
Mr. Chepulis read the legal notice upon a proposal by George Rea to rezone a
parcel of land on Turnpike Street from Rural Residential to General Business.
The area is bounded by Mill Street and other land of Rea to Chestnut Street and
contains approx. 5~acres.
Atty. Donald F. Smith represented Mr. and Mrs. Rea who stated they have lived in
North Andover all of their lives (over 80 years) and would now like to do something
with their land, which is not suitable for residential development. He has no
particular business in mind. Mr. Rea said he has no further use for the l~ud since
he has retired from farming and wants a good business to come in.
There was no opposition and no one else spoke.
Mr. Burke made a motion to take the petition under advisement. Mr. Barman seconded
the motion and the vote was unanimous.
Mr. Bannan then made a motion to discuss and vote on the hearings of the evening
after the next set of hearings has been held and act on all of them at the same
time. Mr. Farley seconded the motion and the vote was unanimous.
