Regular Meeting
The PLANNIN6BOARD heldt~eir regular meeting on Monday evening, October 6,
1969 at 7:30 P.M. in the Town Office Building with the followJ-ug members present
and voting: William Chepulis, Jr., Chairman; Robert J. Burke~ George B. Farley~
Charles W. Trombly~ Jr. and Donald N. Keirstead.
JOHN A. BROWN:
Mr. John A. Brown was present as requested by the Board. A discussion was
held about the Rte. 113+-125 Study Committee and Mr. Brown's thoughts on the matter.
Mr. Brown felt that traffic should be controlled; there should be adequate parking;
the land should be developed in depth rather than strip; should try to schedule
release of land - timing is important - at times when town is capable of developing.
There should be policy guidelines for future development. Alot of answers come up
in preliminary studies. He could start on the 114-125 study immediately and have
it ready for town meeting. He would be personally involved, attend meeting§, make
presentations~ etc.
Mr. Chepulis said the League of Women Voters will make the InitalHousing Study.
Mr. Brown said he has done extensive work in the area of cluster zonir~g.
The federal program was discussed. Mr. Brown said the government wants to make
programs for 2 years in order to better aid more communities. He said he will
prepare a contract for the Rte. 114-125 study - a work program can be worked out.
$2500 is available from the Planning Board to help with this study.
Mr. Farley made a motion to retaiu Mr. Brown immediately; Mr. Keirstead seconded
the motion and the vote was unanimous. Mr. Brown said he will have a report
within the next four months and will have progress reports.
MORNINGSIDESUBIDIVISION:
Ben Osgood was present. Letters were received from the Board of Public Works
and Highway Surveyor. Mr. Osgood said he would like a list from Mr. Nicetta as to
what he wants done and he wants a Planning Board member to go with him and Mr.
Nicetta to check the items.
Mr. Keirstead made a motion to refer the matter to the Subdivision Control Committee
and come up with something within the next 2 weeks; Mr. Trombly seconded the
motion and the vote was unanimous.
FLYNN SUBDIVISION:
Atty. John Lynch was present . A letter was received from the Fire Chief
with the recommendation that a man-made pond be put in the area for fire protection.
Atty. Lynch said they will extend the water system to the subdivision but will have
to go before town meeting to do so. This will be done before starting the sub-
division. If town meeting votes it down, they will do what the Fire Chief
suggests.
Mr. Keirstead said there is nothing in the Subdivision Control Law about providing
adequate water supply. He doesn't think the Board has any right to make a con-
dition as stated in the Fire Chief's letter. He made a motion to sustain the

the original decision; Mr. Burke seconded the motion and the vote was una~ous.
The conditions are as follows:
1. That the record owners of the subject land execute and record a "covenant
running with the land" within 20 days from the date of this decision, or otherwise
provide security for the construction of ways and the installation of municipal
services within said subdivision, all as provided by G.L.c. ~l, s. 81-U.
2. That all such construction and installations shall in all respects conform to
the governing rules and regulations of this Board.
3. That, as required by the North Andover Board of Health, no building or other
structure shall be built or placed upon lots as shown on said plan without the
prior consent of said Board of Health.
4. That water and sewer will be according to the rules and regulations of the
Board of Public Works.
5. That surface drains and street bounds must be installed, and additional catch
basins installed between lots 3 and & as requested by the Planning Board and
Highway Surveyor. The roads must be hot-topped and constructed all in accordance
with the requirements under the Subdivi. sion Rules and Regulations of the Planning
Board. Proper street signs must be installed. Sidewalks are to be installed on
one side of the roadway.
6. Must comply with the Board of Fire Engineers' requirements as to the fire
alarm system.
7. The developer must contact the state Department of Natural resources because
of the filling of the land that will be involved.
PLANNING CONSULTANTS:
Letters of thanks for the interviews will be sent to the remat=lug consultants
and notifying them that a choice of consultant has been made by the Planning Board.
BEN OSGOOD:
Mr. Osgood asked the Board if he could have his bank books to have interest
applied; change the necessary accounts and then return them %o the Board.
The meeting adjourned at 9:30 P.M.
