HomeMy WebLinkAbout1971-02-01Monday - February 1, 1971 Regular Meeting The PLANNIk~ BOARD held their regular meeting on Monday evening, February 1, 1971 at 7:00 P.M. in the Town Office Building with the following members present and voting: William Chepulis, Jr., Chairman; John J. Monteiro, Secretary; Charles W. Trombly, Jr., Vice Chairman; Robert J. Burke and Donald N. Keirstead. Others present were: George Rea, Mr. and Mrs. John McLay, Ben Osgood, Henry Fink, Fritz Ostherr, Joseph Guthrie, Nicholas Nicetta, Henry Green, John Coady, John Willis, Jay Burke and John Willis, Jr. HEARINGS FOR RE-ZONInG PROPOSALS: Hearing dates were set up as follows for re-zoning proposals as shown on the Annual Town Meeting warrant: Monday, February 22, 1971, 7:30 P.M.: Article 68: School Bldg. Committee proposal. · Article 69: Petition of Vincent J. McAloon Article 70: Petition of Gilbert Rea Monday, March Article Article 1, 1971, 7:30 P.M.: 71: Petition of Beverly Whipple 72: Petition ofBenja~i~ Osgood Mr. Tromblymade a motion to hold the hearings on the above dates; Mr. Keirstead seconded the motion and the vote was unanimous. DO~LASWILSON SUBDIVISION: A written request was received from Douglas Wilson for the partial release of the covenant as to lot~. The Board had previously voted not to release the covenant on the remair~g lots because the Highway Dept. had reported several items that should be completed before releasing the same. Mr. Keirstead made a motion to consider the request for the release of lot~6 and re-evaluate item#1of the report having to do with catch basins, in the spring, make anon-site survey with the Highway Surveyor and then make a report to the Planning Board no later than May 1st. Mr. Monteiro seconded the motion and the vote was unanimous. Mr. Trombly made a motion to approve the release of lot ~6 as a partial release of the covenant. Mr. Keirstead seconded the motion and the vote was unanimous. The necessary forms of release must be submitted to the Board for signature. Mr. Wilson will be so notified. JAYCEES "K~OW YOUR TOWN" PROJECT: A letter was received from the North Andover Jaycees explaining their project "Know Your Town" and inviting the Planning Board to participate. Mr. Monteiro made a motion to accept the invitation and participate and suggested that the main theme emphasize the concept plan for the master plan for next year. Mr. Keiretead seconded the motion and the vote was unanimous. February l, 1971 (cont.) REPORT FROM JOHN BROWN: John Brown sent copies of material he submitted to the Dept. of Community Affairs to the Planning Board. One copy was a requisition for payment from the DCA for work performed i~ the amount of $1,530. Exhibit "A" showed a summary of the work items completed as of January 11, 1971 and a short report of what has been done since the last report. (To date, he has been paid approx. $13,~OO from the DCA). CENTRAL MERRIMACK V.~.L~--~ REGIONAL PLANNING DISTRICT COMMISSION: Notices and minutes of meetings held by the CMVRPDC were received'by the Board. John Monteire is the present chairman of that Commission and gave a b~ief report of their activities especielly as to the water and sewer contract and relative to the article submitted by the Planning Board as the Commission's request to provide North Andover's share for the sewerage study. He said they are holding the meetings in Newburyport this year. They are changing the name of the Comm. to shorten it and are getting new quarters in Lawrence. He said the Commission would like the Board's comments on the Open Space and Land Use sur~eys. This will be discussed further at the April Meeting. ME~TING WITH JOHN BROWN: At 8:00 P.M. the Board and several members of the PlaB-~g Advisory Committee met with John Brown to discuss the suggested regulatory controls for four new zoning by-law business districts and two new light industrial districts. A lengthy discussion was held relative to the special permits as suggested by Mr. Brown. The PAC felt they should be taken out completely and allow those certain uses in the various districts. Mr. Brown feels that special permits keep a tighter control than the present General Business and still does not prohibit certain uses. The Board of Appeals almost has to grant special permits, they don't have too much lee-way. There should be a mandatory referral of special permits to the Planning Board. The PAC felt that amusements should be specified as "indoor" places of amusement to rule out roller coasters and that type of amusement. Gas stations and restaurants were discussed at great length. Mr. Brown feels that restaurants should be under special permits for tighter control. A vote was taken among those present as to whether or not they favored special permits and the majority were ag~t requiring special permits. Mr. Brown said specific business areas will be recommended later in the master plan. In the meantime developers could come in for _shy of the districts. Jay Burke said that the areas have to be restrictive - if not, the Town Meeting will turn them down. Mr. Brown said he does not ~ke taking out special permits - he w~l try to come up with some restrictions for Phase II - he will not be happy taking out special permits. During Phase II he will have an overall land-use plan and then will recommend some specific zordmg changes. Another lengthy discussion was held relative to restaurants and gas stations. was suggested to define Business II by sub-sections, for example: Business II-A to include the allowed uses Business II-B to include gas stations and all other uses Business II-C to include restaurants " " " " Business II-~ to ~11ow A, B & C It February 1, 1971 (cont.) By defining the business II district in this way it would do away with special permits. When an area is zoned it would have to be requested specifically Business II-A, II-Bt etc. Everyone seemed to feel this was a good idea and Mr. Brown said he would study this further. Mr. Brown said he doesn't want to allow carwashes at this time, but they should be under Lt. Industry and not a business district. He said he is tryd-~g to create a certain pattern - not a jumble. He doesn't want small areas on Rte. 11~; some things may be allowed on Rte. 125 that would not be allowed on Rte. 114. They could remove the 100 foot setback requirement from Rte. 125 and study it later; but leave it on Rte. 111:. They can ~11ow new car dealers inclu~ing the incidental sale of used cars in Business III and Lt. Industry II. Carwashes, heliport and manufacturing can be ~1 lowed under Lt. Ind. II.
