Special Meeting
The PLA~NI~ BOARD held a special meeting on Tuesday evening, October 17', '
1972 at 7:30 P.M. in the Town Office B,,~ld~-~ with the following members present
and voting.. Charles W. Trombly, Jr., Chai~m. an; Donald N. Xeiretead, Vice Ch.;
William Chepulis and John J. Monteiro. Fritz Ostherr was out of town a~d unable
to attend.
Mr. Keirstead made a motion to amemi the previous minutes using the word #positi°n"
~etead of "petition" with reference to the Jay Road problem; and to accept the
minutes with that correction. Mr. Monteire seconded the motion a~d the vote was
1,1~a,ni~ous.
PROPOSED S~'BDI~ISION OFF JOHNSON STR~'T:
Atty. John J. Willis requested that the Beard set a hearing date for the
proposed subdivision off Johnson Street for which he had already submitted preliminary
plans·
Mr. Monteiro made a motionto set Mo~day, November 20th as the hearingdate; Mr.
Keirstead seconded the motion and the vote was una,~meus.

Mr. ~,Ehes ~__-dMr. Callahanpresented further p]~-~ to the Board shewing the
to~nhouse development divided into lots with the required frontage. Mr. Callaham
said he showed the plans to the Bldg. Inspector who said he would like approval
from the Planning Board as to the roadway.
Mr. Keirstead said the only solution is to file the plans as a subdivision and
go through allof the procedures required as a subdivision. The road canbe
built with a covenant, utilities installed, etc. and then buildingpermits can be
issued. The clearest, simplest way is to file as a subdivision. He said if a
plan was approved without a subdivision hearing, they would he taking a chance on
whether or not they would get a building permit. ~hen the BY-law was dramnup, the
Board did not conceive that this type of a plan would he presented.
Mr. Hughes suggested that the By-law be ameaded. He said it would have been fairer
if the Board had told him from the start that a subdivision hearing weuld he necessary
instead of hevimgthis trouble fr~mmeetimgto meeti~g;
Mr. C-11-~-~ said building permits could be issued right away for the towmheuses
fronting on Prescott Street.
Mr. Hughes asked if there was any way to get a preliminary approval of this plan.
Mr. Callahan asked if the Board would approve the roadway and they would cove-aut
it Just as if it were under a subdivision. Mr. Xeiretead said the Boardoperates
under state statute and would have to do as is required. He said the Board could
approve the plans as a preliminary plan.
Mr. Callahan said there is adequate area andfrontage shown o~the plan for each
unit. Discussion was held on the installation of utilities, roadway, etc.

Mr. £eirstead made a motion to ~rent tentative approval of thig preliminary pla~
under the Subdivision Gontrol Law; Mr. Monteiro seconded the motion and the vote
Mr. Keirstead t~hen Lade 'a motion to set a hearing on the tentative plans for
November 20th subject to plans being received prior to that time. Nr. Monteiro
seconded the motion and the vote was unanimous.
CHESTE~ C. SULLIVAN - PLANS:
Mr. Sullivan presented corrected plans te the Board for signature as "Not
Requiring PI~--i-E Board Approval" for the Peterson land on Salem Street. After
thorough discussion, the Beard signed the plans.
Mr. Sullivan then presented preltmi~_=ry subdivision pla~s to ~he Board for the ·
development of the interior land on Salem Street. Discussion was held on these
plans.
Mr. Keirstead made a motion to grant tentative approval to the preliminary plan of
"Salem Gardens-. 'Mr. Nonteiro seconded the moticm a~d the wte was unanimous.
Mr. Keirstead then made a motion to set a hear~ on the tentative plan for
November 20th if proper plans are submitted prior to that time. Mr. Monteiro
seconded the motion and the vote was unanimous.
JAY ROAD:

Nothing had bee~ received from Town Counsel/relative to the Jay Road drainage
problem.
Mr. £eirstead said we should write to Town Counsel asking for whateve~ commm-_ication
he has received and notifying us. He said he had talked with Town Counsel by
telephone and was told that it was cleared with Mr. Shields and that Town Counsel
is drafting the necessary legal papers to get the $2400. The money is in a 90-day
account and not available until January. Mr. Keirste~d suggested that no action be
taken on th1~ te-lght because the petitioners have gone before other town bodies
to get this. If not successful in gettimg the money, the Selectmen suggested that
Mr. Nicetta expend his money and then be reimbursed. Mr. Nicetta indicated he
would not do as the Selectmen asked. Everyone can wait until town meeting and ask
for acceptance of the road and additio_-__~l money for completion of the. job .but there
may be a legal problem on whether the town can do an~thtng on a private read. The
real problem is that the catch basins .are full of dirt and cannot take the water.
Mr. Monteiro feels this is an emergency. The Board should take the $2400 and use it.
The street could not be accepted if it is p~t in proper condition. Mr. Chepulis said
that in an emergency the money could probably be taken out of a 90-day account.
Mr. Kelrstead said if we did get the money, the catch basins can get cleaned. The
law says the pln,~.g Board can administer this money for the road.
Mr. Monteiro made a me'tion that we expedite the receipt of the $2400. Mr. Keirstead
suggested that we ask Town Counsel to see if we can get the money immediately.

~rs. Eleanor Cahill, Chairman of the Advisory Board, came to the meetiagamd said
that the AdvisoryBoard refused the transfer of funds for Jay ~oad aa had Been
requested by the Selectmen.
Several of the Jay Boad residents then came to the meeting. Mr. Collins, Jay Rd.,
said he had talked with the bank authorities and they said it was impossible
get the funds immediately; the funds are only given to an individaul ia dire aeed.
Mr. Eeirstead suggested to them that the catch basins be cleaned out and that would
take care of the major part of their problem for the time being.
The Board received two quotes for the printing of 500 copies of the ZonimgBy-
Law. Avco Printing- $261.00 and Advanced Bepreductions - $58~.00
Mr. Montoiro suggested that Advanced Reproductions be awarded the printing because
it is a local concern, for convemience when printing amemdments, etc.
Mr. Keirstead made a motion to order ~00 copies of the Zoning By-Law from Advanced
Eeproductions; Mr. Monteiro seconded the metic~ aud the vote was u~animo-us. There
wiLl be a charge of $1.OOper copy.
CHESTNUT COURT SUBDM$ION:
Mr. Keirstead referred to the lots on Jay Burke's subdivision because he
thought they had been released. Mr. Trombly explained that the lots were not
released but that permission was given for building permits.
Mr. geirstead said that the covenant states that nothing can be built until lots
are released. He would like the Board to pursue a policy that when a lot is
released that the roadway is built ia front of that lot end that no b,,~l~t~ per-
mit is issued. There could be a two-year time limit on ftmt~-g the roadway.
The Board should also account for inflation when stating amounts of Bends. We
should start this policy now. The Board agreed.
The Board reviewed the matter of signinE plans not recp,t~ng Planning Board
approval, Mr. Montoiro said he doesn"t think people should ge to the members
homes to have plans signed. This should be done at a meeting and all plans
reviewed by the Board before they are signed. The plans sbmuld have Board
approval.
Mr. Chepulismade a motion that all plans "Not Re~,~,?ing Planning BoardAppr~val"
under the Subdivision Control Law should be brought before a Pl~mm~"gB~ard meeting
and acted upon by the Board ~Ith the Board giving authorization to sign the plans
in the usual manner.
Mr. Keiretead seconded the motion and the vote was un~m~mous.

~eOrge Barker, James Chempyand John Callahanpresented plans of along-term
project they had developed fo~ Mr. Barker's land and the area adjacent ~o'it o~
Osg~Od street, Bar,er Street and Bradford Street.
L~gthy discussion was held. The plans shewed areas zoned for commercial use,
office park, industrial zone and R-4 z~ne. The divisions follow established li~es
of ownership. They would like to create aa industrial park area. ~r. Ke~rstead
noted that the Board had considered a convenience business in that area at some
time. They discussed cluster zoning and reaching agreements with abutters on
certa~- areas. This project, would be over a period of 20 years or more. .They
were also concerned about utilities.
This project will be discussed again at some future time.
