Special Meeting
The P~ BOARD held a special meeting on .~ eve~_4-~-, Deoamber 17,
1973 at 7:30 P.M. in the Tom Office ~,tl~g meeting roc~. The following mambers
were present and voting~ William Chep,;l~s, Chairmen; John J. Monteiro, Vice
Chairmen; Paul R. Lamprey~ Clerk~ Demald N. Keirstead and Fritz Ostharr.
This meeting was called to act on several plans submitted to the' Board as "~ot
Requiring Approval umder the Subdivision Control La~. There were 14 people
present for the meeting.
1. Osgood ~Alls proper~y. Atty. Clifford Elias presented plens to the Board as
not requiring approval of the Osgood ~ills property. These plans had ~eady been
approved by the Board of Appeals.
Mr. Xeirstead made a motio~ to endorse the plans as not requiring approval under
the Subdivision Control Law; Mr. Monteiro seconded the motion and the vote was unanimous.
Atty. Elias pointed out that the lot was created when that frontage was sufficient,
back in 1950, under the 1953 Zoning By-Law.
2. Trustees of Reservations, Land Conservation Trust. Atty. C~ford Elias also
represented these petitioners. The plens showed land between Stevens and Osgood
Streets that had previously belonged to Atty. Charles W. Trombly and was now being
sold to the Land Conservation Trust. This is the area that was part of the Stevens
Mill compromise.
Mr. Ostherr made a ~otion to endorse the plans as not requiring approval under the
Subdivision Control Law; Mr. Monteiro seconded the motion and the vote was umauimous.
3. Stevens Mill townhouses. Atty. Charles W. Tro~bly and Atty. Harold Horley, Jr.
presented amended plens to the Board showing 120 to~nhouses and lots. This plan is
part of a compromise reached between all parties concerned with the pe~_~-E court
cases. The Board of Appeals and ~,~d~-~ Inspector had agreed to the co~proaise
a~ now it was ~'necessary to get Planning Board approval in order to reach en
of-court sottlament.
Discussion was ~held as to the status of Harkaway Road. Mr. Chepulis still questioned
whether or not it was a subdivision, especially as to Harkaway Road. Mr. Lamprey
said the amended plens still show the odd-shaped lots end he still feels it is a
subdivision.
Mr. Ostharr made a motion to endorse the plans as not requiring approval u~der the
Subdivision ~ontrol Law; Mr. Monteiro secomded the motion and the vote was 3 - 2,
with Me-bors La~prey an~ Chepulis voting no.
It was noted that Lot ~102 needed to be corrected as to the extension of the lot lines.
Scott Giles, the engineer, was present and he said he mould take care of it first
thing in the morning, since the plans had to be recorded first before going to
court for 10:00 A.M., in Salam.
Nr. Keirstead brough% up about the dimensional regulations and use under the By-Law.
Atty. Trembly said he thinks the Board should take the action it took last time.
He feels that a ,recant court case (Bellows Farms) does not ehange anything on this
particular case.
Bldg. Inspector Poster pointed out that he would not issue a new b,,~l~4~g per, it;
that a b,,41~.g permit has been issued on this so that nothing new could apply now.
~. Ou~ Riehords land on Rte. l~J;. Mr. ~itche appeared before the Beard with plans
of a lot of land on part of the Guy Richards property on Rte. 11~, ~e St.
This particular lot is the one designated for the Capital Distributing Co., for
which a fhearing had been held by the Board of Appeals.
Mr. Keirstead sade a notion to endorse the pI~-~ as not requiring appreval under the
Subdivision Control Law; Mr. Monteir~ seconded the ~otion a~ the vote was ~-1, with
Mr. Ohepulis voting ne.
CO~¥ATION CO~ISSION'-
Mr. Chepulis read a letter fr~ the Oonservation Coat,sion regordi~ proposed
changes to the Zoning By-law, especially relative to earth removal permits.
Copies of earth removal guidelines received frem Essex County Conservation Commission
will be sent out to the Conservation Commission, Bldg. vespector and Board of
Appeals to came to the Jan. 7th meeting with any amendments to be accepted that night;
upon motion of Mr. Keirstoad. Mr. Ostherr seconded the motion and the vote
Mr. Ohepulis suggested that any changes to the Zoning By-Law be taken up at the
January ?th meeting, since the earrant for armual to~n ~eeting closes on Jan. l~th.
Town Meeting is on Saturday~ April 27th.
The aeeting adjourned at 9=00 P.M.
