Zonin~ Hearings
The PLANNING BOARD held hearings on Monday evening, April 15, 197~, at
7:30 P.H. in the Fire Station meeting room. The following members were present
and voting: William Ohopulis, Chairman; William Salemme, Clerk; John J. Monteiro
and Paul R. Lamprey. Mr. Ostherr was out of the country and unable to attedd;
however, the meeting was tape recorded so that Mr. Ostherr would be aware of the
proceedings upon his return, thus enabling him to vote on the petitions;
There were over ~0 people present.
1. THOMAS J. FLATLE~: Re. zoning.
Mr. Sal_-m~e read the legal notice upon the application of Thomas J. Flatley
who petitioned ~to re-zone a parcel of land containing approx. 27 acres, from
Residence ~ District to Residence 5 District.
Atty. John J. Willis represented the petitioner, who was also present. He ex-
plained that Mr. Flatleyhadpurchased this ~fromMr. Melamedabout 3Years
ago, at which time townhouses were allowedinthis particular district. Mr.
Flatley is a developer of multi-family dwellings and he had intended to develop
the area with townhouses. Towahouses were then removed from the R-~ district
so that new he is requesting the zoning change in order to develop his land..
They have talked with the people in the area and they generally agree with the
proposal. He said that the character of the area has changed from single family
dwellings. Mr. Flatleyhas done a good Job with the apartments that have been
built and everything has been done as he promised. He explained that the apart-
merit development returned in excess o~ $~00,000 in taxes ~o the town - $302,000
in real estate taxes and excise taxes for about the 900 cars in the development.
This development would require no town services, such as plowing, rubbish and
garbage collections, road maintenance, etc. The only services required would be
police and fire protection. This would be equivalent to another Western Electric.
There is a drainage problem in the area. Camp, Dresser & McKee has made a
drainage study for Mr. Flatleywhich they feel will solve the problem. Theywill
have holding ponds and approx. 6% of the area would be coveredwith buil~-gs,
drives, etc. Their alternative would be to develop the area will allowed duplex
homes which would mean72 lotswith l~units and roads a~M services that the
town would maintain. However, Mr. Flatleydoes not want to develop it that way.
He will try to meet any requests of the people and the Board.
Jack Judge, the architect, eXPlstued the development. He said alot of the existing
tree cover would be left. The apartment b,,tl~i-Es would be set up in clusters.
There would be a 2~acre retention pond with aeration Jets; the water could be used
for irrigation. There would be a clubhouse and swimming pool. There would be 172
units in the development.
Russell Lodge, 19 Tolland Rd., questioned the number of children in the apartments.
end asked for clarification on the dollar amount of taxes.
Mrs. Slade, Bradford Bt., questioned the legality of prohibiting chtldren in rentals
of apartments.

Mrs. Viola Hart, representing Mrs. P~rker, Andover St., an immediate abutter,
was concerned about the width of the street and the existing drainage problem
which directly affects her property.
Mr. Fla~ley spoke and discussed the dr~t~age problem with the abutters and
said he was alsovery concerned and felt that his pro~sal would solve the
problem. He is willing to c°mm~t a covenant, or whatever, to the town.
Jud ;ane, the engineer, exp~ed how they would solve the dr~e~eproblem
as shown on the plans displayed.
Lengthy discussion was held on the drainage.
Mr. Colby, rep. from Camp, Dresser & McXee, stated that the report is official
as far as the company is concerned and is subject to change. Mr. Chepulis said
that the developer would be required to go before the CoD~ervation Commission
with their proposal.
Traffic was discussed and Mr. Kane stated that the State has made a traffic study
of the arcs. Mr. Flatley said he ~rill have a traffic study made and the report
will be given to the town.
Mr. Ghep,,l~ stated that the Board would like all theinformationpossible in
order to make a decision for Town Meeting on April 27th.
Several abutters were concerned about the access ways from the development and
did not want any access on their streets~ Mrs. Lewis, Prospect Terrace, Maurice
Lynch and-Mrs. ~l~iott, BerkelyRd.~ Atty. Willis said the only access will be
the road onto Andover Street a~ that the emergency will be through the existing
Royal Crest apartment development only. He will submitthis in writing to the
Board; and he w~ file a covenant with the Registry of Deeds to protect the
people .
Mr. Monteiro made a motion to take the petition under advisemant; Mr, Lamprey
seconded the motion and the vote was unanimous.
2. HEARI~= Grace Moscbetto and others - Re-zoning.
Mr. Salemme read the legal notice upon the petition of Grace Moschatto and
others to re-zone the present Industrial "S" District on Osgood Street, across
from Western Electric, to ~Business "3" District. ~
Mrs. Grace Moschetto explained that she would like to have her property rezoned
because she has a flower and gift shop and is running a business in an industrial
zone; she doesn't have anything else in mind for the property.
Mr. Peter Malcolm, a real estate broker, said he s~bmitted the originalpetition.
He said it would be advantageious for the owners and abutters to have the land
zoned for its best use and not have several businesses scattered under special
permits.

John Roche, Osgood St., said his lend is involved and he would rather have it
zoned, for business. He would not went a' lumber yard or a bus terminal - he
wents to keep out large industry.
Mr. Malcolm said that if the area is rezoned, the Moschetto family wouldgive
6.2 acres to the town, which is located to the rear of the property.
Saracussa, a member of.the family, o~ns a vacent lot on Bradford St. which would
provide access to the 6.2 acres.
Speaking in opposition were: NormenLentz, Bradford Street~ Leo Pei~ier, Bred-
ford Street; Mrs. Stapleton, Bradford Street; end Joseph Lyons, representing
~esternElectric. Mr. Lyons felt it would be detrimental to the town to rezone
to business use a~M it would create a traffic hazard.
Mr. Monteir0 made a motion to take the petition under edvisement; Mr. Lamprey
seconded the motion. 3 members voted yes and Member Salemme abstR~ued from
voting because he is employed by MesternElectric.
3. HEARING: Earth Removal Section.
Mr. Salemme read the legal notice to emend the Zoning By-Law to remove the
existing earth removal section end insert a completely revised section.
Very lengthy discussion was held on this. Gilbert Rea, en earth removal operator,
was very concerned about the restrictions in the proposed by-law. Bldg. Inspector
Charles Foster was also concerned over ma~v ef the sections since he is the
enforcing officer. He felt more study should he, made since some of the Planning
Board members have not studied it thoroughly. Mr. Monteiro agreed ~ithMr. Foster.
Mr. Lamprey said hewould like to have any amendments submitted inwriting, he
doesn't want to drop the proposal. Mrs. Pat Trembly cen't see why amy further
study is needed..Mr. Monteiro submitted several Suggestions in writing.
Mr; Lampraymade a motion to take the petition under advisement; Mr. Monteiro
seconded the motion and the vote was unanimous.
~; HEARINg: Several amendments.
Mr. Salemme read the legal notice which Listed several amendments to the
Zoning By-Law. The Board went over each item separately amddiscussed them.
These amendments would elarify several sections of the By-law. Mr. Salemme
made a motion to take the petition under edvisement; Mr. Monteiro seconded the
motion and the vote was unanimous.
A special meeting wALl be held on Tuesday, April 23rd, at 7~30 P.M.
