Regular Meeting
The PTA~NING BOARD held its regular meeting on Monday evening, November 4, 1974
at 7:30 P.M. in the To, n Office Meetin~ Room. The following members were present and
voting: William ChePulis, ChAirman; John Monteiro; William Salemme, Clerk~ and Paul
R. La~prey. ~ritz Ostherr arrived approximately at 8 P.M.
There were about 9 people present.
Mr. Monteiro made a motion'to approve the minutes of the September 26, 1974 and
Mr. ~mprey seconded the motion. The four members present'at that time voted unani-
mously in favor.
NOT RE~UtRIN~ APPROVAL:
1. PE~ERVANWINXLE, LAND]~SALEMST. AND~I]~PER ST~: Motion was made By
Mr. Monteiro to endorse the plan of land of Peter V~nWinkle as not requiring approval
under subdivision control law. Mr. T~mprey secondedand the vote was u~animous.
Note: ~he owner of the land is ~rner Bridges, father-in-law to Mr. YanWinkle.
2. ~EOR~E PARR, PORTION OF SA~ FOREST: Member Monteiro made a motion to endorse
the plan of Salem Forest as not requiring approval under subdivision contr.ol law
which was seconded By Mr. Lamprey. A discussion took place with ~ud Cyr regarding the
culvert on Lots 52 & 53. Mr. Cyr stated that he w~nts to get things ~ownp~t now,
on %he ~rainage, so we won't run into any trouble. No action was taken at the
meeting due to the 40' right of way and less than ~50 f~. frontage problems. Frank
Gelin~s, representing Mr. FArt, said that the dimension on frontage should read 7.79
and not 7.72 and, further, that it is a drafting error which can be changed subject to
the BOARD's approval.
Mr. ~elin~s also stated thatthe pu~-pose of the 40 i~t. right of way is that the power
company has asked Mr. F~rr for an easement to permit access to that long easement.
Mr. Ohepulis ~ues~%~x~dwhe~r it shOUld be a right of way or an easement. Mr. ~elinas
saXd that Mr. Farr's property line is also the back of that easement. Mr. Chepulis
brought up the fact that in c~se of subdivision in the back this would make an under-
sized point of entry. It w~s deciderS, hat it Would be called an easement. Mr. Ostherr
asked why rounded corner easemen%s/I6~ ther~if it is just going ~o be for th~
compa~ to use? The BOARD felt they could give strong suppor~ for what Mr.
to do in that area, but a solution h~s to come from Mr. Oyr and the o~ner. Mr. ~elinas
requested that the ~ sign the plan subject to his putting an easement on the plan
~tisfac%ory to the ~ighway S~eyor. Mr. Ostherr felt that the BOARD sh=uld sig~ the
plans tonigh~ ~n~when corrected, the plans should be returned. The previous statemen2
~S in the form of a motion which was seconded byMr. Monteiro. The motion did not
carry . The BOAP. D directed Mr. ~elinas to change the plans and then bring them in for
signatures. The vote w~sunanimous.
W~T~ I~JG~, PRE~OTT ST. ?O~HOUSE O0~P?.~: Read letters, which are on file, from
the Board of Public Works and the High~y ~urveyor. ~hese four lots (~, 2, 3 & 4) are
intended to front on Prescott ~. and technically could be considered as not being
purr of the subdivision, but the w~y the plan was presented, signed and approved these
four lots are legally included. ~r. O~therr made a motion to deny the applic~-t's
request for partial release on the ~o~house Complex for the following reasons:
1. without the rent of the complex they do not have the minimum area requiremen~
for a townhouse development'.
2. the way in which the plan was presented, signed and approved these four lots are
legally includedandare to be considered a integral part of the subdivision.

Mr. Monteiro seconded the motion and the vote was unanimous.
GLADYSEANE, 48 BAY STATE. ROAD: The request is for the addition of a dormer to an
existing garage. David Eane, the applicant's son, was present. Mr. ChepHlis
stated that he doesn't feel the PLANNING BOARD can do this unless there is a compel-
ling reason. Mr. ~a~e said'the Building Inspector would give him a building permit
only if the BOARD gave their approval. He also, said that he wants it for his own use.
Mr. Monteiro made a motion to approve the addition to a garage at 48 Day ~tate Rd. and
Mr. Lamprey seconded. A discussion followed in which Mr. ~a-e said that the floor plan
of the garage is 1200 f~.; there is fire coding sheet rook in there now and it already
is heated. The BOARD noted that it puts two dwellings on one lot and Member ChePUlis
said he would have a technical objection if the land was recorded a~ one lotl Actually
it is four small lots. Mr. Monteiro felt that it would benefit and not hurt the town.
Ifane stated that the abutters do not have any objections. If he were to add a dormer
'to the house it would be a greater expense. The BOARD then temporarily tabled the
matter until Mr. Foster returned from a~other meeting.
RALEIGH TAVERN NORTH: There was a question as tb hOW much bond w~ hold on this.
We actually hold $3,000 on North and $10,000 on South for which a release was requested
on September 24, 1974.

that what Mr. 0sgood wanted was to get it completed. Mr. Osgood was under the impres-
sion that only cleaning up North to get it ready for uPcoming Town Meeting. Mr. Osgood
stated t~t his request is for $5,000 of the $10,000 on South which included minor
clean-up, stone bounds and miscellaneous items. Request department recommendations on
Raleigh Tavern South to Be submitted for the NovemberlS, 1974 meeting.
GLADYSEANE- cont. from above: The BuildingIuspector state[ that it is a three-
stall garage which needs dormers and a means of egress. The petitioner intends to
use the m~jority of the second floor to which there is one existing stairway. Mater
and sewerage has to come into the property. Mr. Ostherr questioned whether or not it
would be impractical to put the garage on a separate lot for paper purposes. Mr; Foster
said there would be no objection to this. Mr. Chepulis suggested adding a breezeway
which was an agreeable solution. Mr. Monteiro made a motion that Mrs. Eane be allowed
hdrmw her request without prejudice. Mr. Lamprey seconded the motion and the

LETTER FRON SELECTMEN REFLOOD CONTROL: A discussion took place in which Nr. Ostherr
suggested that we prepare, for the Town, the resolution called for in the letter. We
really only need one resolution and an operating document to be ready for Town Meeting
action. Send a letter to the Board of Selectmen acknowledging their letter and advising
we are doing this.
LETTER ~RC~ REP. HARRINGTON RE BIKE PATHS, RECRF~TION~ ETC.: Mr. Monteiro stated that
the MVPC will take this up at the nex~ meeting and commended Mr. H~rring~on for the
fine amount of informmtion he has presented. The BOARD accepted the letter.
I~Iq~ALRE~"~EWOFRU~.~..~ANDREGULATIONS:
Mr. Ostherrmade a motion ~hat the PLANNING BOARD approve the revised Rules and Regula-
tions to the Subdivision of Land and set a date of Dec. 1, 19~4 for their adoption.
Mr. Monteiro seconded and the vote was unanimous.

MISCELLANEOUS MATTERS:

A letter w~s read from Brian ~i%zpatrick of Great Pond Rd. regarding Campion Nall's
possible sale. Mr. Mon%eiro sta%ed that he had called New York City and the Boston
Archdiocese amd did not receive.~muoh information except that there is an option to
busby some outfit in Wakefield, mnd hewould hope fha% the BOARD would take some
leadership in this direction as to the Town taking it over by eminent dommin or over
an extended time basis. He is vehemem~opposed to it going for a development~ and
suggests a committee to come up with something. A copy of the le%ter ~as sent to the
Conservation Commission and the Bi-centennial Committee. Also, a letter of acknowledg-
ment is to be sent to Mr. l~itzp~r~iok noting wh~t we have done in the w~y of referral.
A slight discussion wms held on the notice of Air Quality Lectures to be held by the
Essex Goun%y Nealth Association.
Mr. Oyr, Eighway Surveyor, requested presence at any meetings which involve changes in
road designs, etc.
The meeting adjourned at 10:30 P.M.
