Special Meeting
The I:'LANNINO :BOARD held a Special Meeting on Satur~lay, February 8, 1975, at 9 A.M.
in the Town Office Meeting Room. The following members were present and voting:
William Ohepulis, Chairman; Fritz Osthsrr, Vice-Chairman; Paul R. Lamprey, William N.
Saleratus, Clerk; and John J. Monteiro.
Visitors included the Messers. Chas. 'Eostandin, ~eorge Costo~is, Douglass Cann, Kenneth
Korb, Esq., Andrew DiFranoesco~ Nelson Neckers, all members of Thomas 0onstruotion Co.

Mr. Costonis introduced Atty. [orb as an able young ~n regarding zoning laws. Mr. Eorb
took over tr~ stating that the problem they faced was to try to create something to solve
a particular problem and at the same time not create spot zoning. For lack of a better
name I have called it an "Environmental C~ntrol District", he said. They are proposing
5 changes to the present zc~g by-law, a copy of which is on file. The virtue of this
particular zone is so we will know what and where it is located. They are attempting to
preserve R-2 zoning and then create cluster dwellings with a Special Permit.
Master control will Be place, obviously by the Board of Appeals, in an overall ]~_ud trust
which will be owned By each of the condominium groups, (they will pay for the mainten~
ance, etc. They have tried to stay re~so~ably close to R-~ d~ensions. Setbacks-
oanno% put any structure within 200 ft. of the Lake.
"Original lot# refers to the whole parcel; "portion lote reffers to the individual oli~oters.
According to Mr. ~[orb, to create portion lots means orsating a subdivision essentially.
They are using the Board of Appeals and special permit the same as a sut~iivision. Mr.
Chepulis asked, supposing this is on the books as a by-law what are the mechanical steps
to be taken? Atty. Eorb stated, the developer must go to both bodies in order to have
approval of both. Effectively, he must go to the Planning 2card first to get subdivision
approval and then go to the Board of Appeals for granting of the special permit.
Fritz Ostherr took exception with ~ (c) - would like to see 150 ft. portion lots; Paul
Lamprey would rather see it remain 100 ft.

Article before it gets in the ~arrant, etc. Mr. Cos%onis said they really need ~
per acre due to the concessions that they are pl~ing to make. If the sewer was there
he would take 1 per acre, he said. Charles Foster, Building Inspector, thought that one
problem at Town Meeting might Be the proximity of the development to the Lake. Could the
200 f~. buffer be modified? Eorb said ~ha2 ~he demensional controls are the mi~im~un
they can live with, The actual buildings will be no closer than 200 ft. and the roadway
will be pro~ably ~00 ft. away, per Costonis and Xorb. Mr. Costonis stated that they are
going to subdivide the property and take advantage of the Lake frontage if they have to.
It was decided that a definition of #original# and "portion" lots should be' included in
the Article.
Mr. Cyr suggested instead of a retention pond, having the Town get an easement for surface
drainage.

SANITARY LAND FILL FEASIBILITY STUDY COMMITTEE:
Discussion took place as to whether or not we should have a separate Indu~l zone
which allows the Sanitary Landfill use per Ben Osgood. BUd Cyr staid, we do not have to
rush this article through Tow~ Meeting, but we should a~quire the land soon. The BUild-
ing Inspector felt that it would be practical to put the zouing article in at this Town
Meeting ale~g with the aoq~uisition of the land. Mr. Osgood ~uggested calling it I-3
a~d then working on the regulations. This will have to be operated under the State
BOard of Health rules.
For Town Neeting - 2 articles: 1 ) District and its regulations and 2) appropriation of
~ands.
SOENICR~S~:
The article, signed by residents of Great Pond Rd., submitted to the Beard. This was
done by a m~jority vote of the Scenic ROads Committee. The Committee felt the statute
of ~he Commonwealth was more appropriate than the suggestion of the Highway ~urveyor.
Mr. Oyr, Highway Surveyor, submitted his "Criteria for Scenic Reads" to the BOARD and
stated that he feels it will accomplish the same end as under the Scenic ROads Act.
Mr. Ostherr suggested dissolving the Committee and putting it back in the hands of the
PLANNING BOARD with advice from Mr. Cyr. Mr. Cyr objects to the S~ate legislation because
of belief in Nome Rule and does not w~nt to come under the jurisdiction of the PLANNING
BOARD or the Selectmen so that he cannot be pressured by any group.
Mr. L_~prey made a motion to dissolve the Scenic ROads Committee and have the PLANNING
B~W~D assume the duties of that Committee. Mr. Salemme seconded the motion. Mr. Ostherr
s~ated that, if the motion carries, the group can remain as a Committee but not under
the auspices of the PLANNING BOARD. The result of the vote on the motion was unanimous.
A motion was then made by Mr. Ostherr stating that if the Article carries at Town Meeting,
the PLANNING BOARD should have an article ready designating the PLANNING BOARD as the
controlling body. 'Mr. Nonteiro seconded. The members discussed and concluded that before
the BGARD adopts any regulations it will hold a public hearing. Mr. Ostherr withdrew his
motien.
IN ZONINg:
m~de a motion that the PLANNING BOARD set up an article for Town Warrant to
Town will vote to accept ~looA Plain Zoning and report to HUD. Mr. Salemme
seconded and the vote was unanimous.
BOAED O~ APPEALS EEARINGS:
The BOARD received notification of hearings by applicants Narold and ~urmmo Fergusen and
Arthur S. ~undeklian. The members voted unanimously, upon motion of Mr. Lmmprey and
second by Mr. Monteiro, to acknowledge receipt with no comment.
