HomeMy WebLinkAbout1988-10-05 The Board of Appeals held a Special Meeting on Wednesday evening, October 5,
1988 at 7:30 p.m. in the Town Building Library. The following members were present
and voting: William Sullivan, Acting Chairman, Augustine Nickerson, Clerk, Raymond
Vivenzio, Anna O'Connor and Louis Rissin.

Mr. Robert Nicetta spoke for the petitioner regarding a building on the lot
across from Hodges lot. There was a question of height of the building at 40+
feet. Mr. Nicetta showed the new plans to the Board and the building is now
31 feet in height. Mrs. Christenson's house is on Belmont Street and is now lower
than the Daigle structure. The plans are drawn to scale per Mr. Nicetta. Ail
new plans were shown to the Board. The building will consist of six (6) units,
3 - 1-bedroom units and 3 - 2-bedroom units. Outside measurements are the same
as the original plans. Parking will be included with the 7 Hodges Street site,
15 spaces there already. The petitioner intends to lease the three 1-bedroom
units to the elderly and they will apply for government permission. The Housing
Authority would police this, making sure that only elderly or Seciton 8 occupy
these units.
Board discussed the possibility of Morton Street entrance being one-way. The
petitioner needs three (3) variances, lot line, side line and area size. Mr. Daigle
has agreed to put greens in and as many as will fit in. He also stated that a
lot of work had been done by Scott Stocking and Robert Nicetta in helping him to
solve some of his problems..
No one spoke in favor or in opposition to this petition from the audience.
Mr. Vivenzio asked if the units could be make smaller and Mr. Daigle said that
it would make the units unconfortable. The bedrooms are 12' x 10'. Making the
building 10' shorter would not have a great affect on the inside dimensions.
Motion made by Mr. Vivenzio and seconded by Mr. Nickerson to take the matter
under advisement. Vote was unanimous.

Upon a unanimous vote, this decision was continued to the October 11, 1988 meeting.
Mr. Sullivan asked that Mr. Frizelle be called to see if he could attend this
meeting. If he is unable to attend, Mr. Sullivan wants to know and he will talk
to Mr. Frizelle about his thoughts on the decision and if he wants anything changed
before the Board signs it.

Upon a motion made by Ms. O'Connor and seconded by Mr. Nickerson, the Board voted,
unanimously, to GRANT the Special Permit as requested. (Sullivan, Nickerson, O'Connor,
Vivenzio and Rissin).

The Board held a discussion and the neighbors for and against this petition were
named. Mr. Marcotte .objected to the height of the garage. The petitioner was
asked if he would want the pool without the garage and he said that he would con-
sider it. They would need a setback variance for the pool if it was not 10' from
the lot line. The old garage is 14' from the lot line and the new garage would be
only 7' from the lot line. Ms. O'Connor asked if they did not have a garage, could
they put in a parking lot. Mr. Ritchie said no, it would cut into the hill and it
would spoil the looks of the land.
The Board has to look at the whole picture as far as the neighborhood. The garage
can not be put nearer to the Ritchie house because of the safety factor. Mr.
Sullivan stated that he is in favor of the pool but not the garage and the rest of
the Board feels the same way. The characteristics of the neighborhood would be
changed if all these variances were allowed. The neighbors would not object to
the pool if the equipment were enclosed.
The Board wants to split the petition requirement by granting only a variance for
the pool. Mr. Rissin asked if Mr. Ritchie would reconsider rebuilding the old
garage anyway and Mr. Ritchie said yes. Mr. Sullivan asked if Mr. Ritchie would
enclose the pool equipment, and Mr. Ritchie said yes.
Upon a motion made by Mr. Rissin and seconded by Mr. Nickerson, the Board voted,
unanimously, to DENY the variance for construction of a new expanded garage and
voted, unanimously, to GRANT the variance for construction of a swimming pool
subject to the following conditions:
The pool filter be moved from the right rear of the garage
to the left rear of existing garage and encloded to prevent
any excessive noise.
2. A rock drain be installed between the pool and the fence to
ensure splash water does not drain on abutters' property.
3. Work on pool to be done only in the daylight hours.

Upon a motion made by Mr. Vivenzio and seconded by Hr. Rissin, the Board voted,
unanimously, to GRANT the variances and Special Permit as requested subject to
the following conditions:
1. Three(3) designated units to be used by only elderly as defined
by Federal Housing guidelines.
2. Copy of leases be given to the Building Inspector from the
peitioner or any future owners of this property, prior to
issuance of occupancy permits.
3. No exist or entrance on Morton Street.
4. Landscape all areas around parking lot, except for the egress
and exit.
5. Revise plans to show either hedges or trees and other changes re-
quested and that revised plans be received by the ~oard within 30 days.
