HomeMy WebLinkAbout1983-08-09August 9, 1983 Special Meeting The BOARD OF APPEALS held a Special Meeting on Tuesday evening, August 9, 1983 at 7:30 p.m. in the Town Office Meeting Room with the following members present and voting: Frank Serio, Jr., Chair- man; Alfred E. Frizelle, Esq., Vice Chairman; Richard J. Trepanier, Esq., Clerk; William J. Sullivan; and Augustine W. Nickerson. Associate Member Maurice S. Foulds was present. The purpose of the Special Meeting was to render decisions on the petitions heard on Monday, August 8, 1983. DECISIONS Letarte, Richard - Variance - Osgood Street Member Sullivan gave an explanation of the drainage and the water situation of the property. It starts at Royal Crest Estates and comes down to this site. MOTION: SECOND: VOTE : by Mr. Trepanier to deny the petition for a variance. by Mr. Nickerson Unanimous Zachary Realty - Variance - Dale Street (Lot 1) MOTION: by Mr. Nickerson to deny the request for the reason that the 25 foot no cut buffer zone is protecting the wetland abutting the tributary and no hardship was shown by the petitioner that would warrant this request. SECOND: by Mr. Trepanier VOTE : Unanimous Jayson Realty - Variance - Cotuit St. MOTION: by Mr. Trepanier to grant the variance. SECOND: by Mr. Frizelle VOTE : In favor - 3 (Serio, Frizelle, Trepanier) Opposed - 2 ~Sullivan, Nickerson) Motion fails to carry - petition is denied. S.B. Homes - Variance - Cotuit St. (Parcel E) MOTION: by Mr. Sullivan to deny the variance SECOND: by Mr. Nickerson VOTE : Unanimous - motion carries August 9, 1983 -2- Special Meeting S.B. Homes - Variance - Cotuit St. MOTION: SECOND: VOTE : (Parcel F) by Mr. Frizelle to deny the variance by Mr. Sullivan Unanimous - motion carries M. Ann Bush - Variance - Brewster St. MOTION: by Mr. Frizelle to grant the varinace as requested since the violation is inches. SECOND: by Mr. Trepanier VOTE : In favor - 4 (Serio, Frizelle, Trepanier, Nickerson) Opposed - 1 (Sullivan) Motion carries - variance granted. Hi,gins, George - Variance - Martin Avenue MOTION: by Mr. Frizelle to grant the variance as requested. SECOND: by Mr. Sullivan VOTE : Unanimous - motion carries. Kellerman, Dorothy - Variance - Heath Road MOTION: by Mr. Trepanier to grant the variance as requested. SECOND: by Mr. Frizelle VOTE : Unanimous - motion~carries. Ethun, Alan - Variance - Rock Road MOTION: by Mr. Trepanier to deny the request to waive the Rules and Regulations regarding plan requirements. SECOND: by Mr. Frizelle VOTE : Unanimous - motion carries MOTION: by Mr. Trepanier that no variance is necessary since the deck is not within 30 feet of the rear lot line, as in- terpreted by the Building Inspector. SECOND: by Mr. Frizelle VOTE : Unanimous - motion carries. August 9, 1983 -3- Special Meeting Redman, George Special Permit - Elm Street A letter from the Town Planner dated August 9, 1983 was read and placed on file. MOTION: by Mr. Trepanier to grant the Special Permit to create three (3) family units within the main house and that there be no apartment or living quarters in the barn or garage and that there be off-street parking for a minlmun of six (6) cars with appropriate screening so that the parking area cannot be seen from the street. SECOND: by Mr. Frizelle VOTE : Unanimous - motion carries. Willows - Special Permit - Willow St. MOTION: by Mr. Frizelle to grant the Special Permit as requested. SECOND: by Mr. Sullivan VOTE : Unanimous - motion carries. Hajek., .Da.v. id..- Variance - Carlton Lane MOTION: by Mr. Frizelle to grant the variance as requested. SECOND: by Mr. Trepanier VOTE : Unanimous - motion carries. Lodge, Russell - Variance and Special Permit - Tolland Road MOTION: by Mr. Frizelle to grant the variance and Special Permit to allow relief from the setback requirements for the dwelling located on Lot A and the formation of a 10,000 square foot lot on Berkeley Street shown as Lot B and deny the variance request to allow the continued existence of the garage located on the lot line of Lots A and B, subject to the conditions that the one story wood frame shed be razed prior to the issuance of a building permit and that the oae story garage one the lot line between Lots A and B be razed or moved to either lot with sufficient setbacks as required by the Zoning By Law prior to the issuance of a building permit and that the plans be revised to show that the structure will be razed or moved. SECOND: by Mr. Trepanier VOTE : Unanimous - motion carries. August 9, 1983 -4- Special Meeting Smerczinski, Frank - Variance - Turnpike S~. MOTION: SECOND: VOTE : Unanimous - motion carries. Thompson's Restaurant - Variance and Special Permit by Mr. Frizelle to grant the variance as requested. by Mr. Trepanier Andove r St. No action - decision will be rendered at a later date.
