SECOND: by Mr. Soule DISCUSSION - Mr. Vivenzio brought up the history of this hill and Mills Hill. He stated that there are some members who feel that in order to be consistent, they cannot vote in favor of this petition. If it is granted, one by one it becomes a big complex. We are now in a position that every extension is minimal. This is the second extension. He will vote to be consistent as he has in the past. VOTE : In favor - 4 (Trepanier, Sullivan, Soule, Foulds) Opposed - 1 (Vivenzio) Motion carries - petition granted. Poutenis - Special Permit - Waverly Road MOTION: by Mr. Soule to grant the Special Permit as requested. SECOND: by Mr. Trepanier VOTE : Unanimous - motion carries OTHER BUSINESS Attorney Harold Morley addressed the Board. He has a problem with a Special Permit that the Board of Appeals granted to Gil Rea for earth removal. When the sewer pumping station was installed he gave some people an option and he now wants to ex~ersize the option. The roadway is tied into the Special Permit for gravel excavation. The existing roadway is underneath the proposed building. It becomes a problem of relocating the roadway. He does not use the road because he has a right to use the existing street. He wants to make sure that the permit to excavate is not fouled up. The Board suggested that Mr. Rea petition for a renewal of his Special Permit as soon as possible so they can review the situation. A letter from Attorney N. DeNitto was read and placed on file (dated 12/7/84). The letter concerns 100 Flagship Drive. The meeting adjourned at 9:00 p.m. Frank Serio, Jr., ~airman Jean White, Secretary k December 10, 1984 Regular Meeting The BOARD OF APPEALS held a regular monthly meeting on Monday evening, December 10, 1984 at 7:30 p.m. in the Town Office Meeting Room with the followi'ng members present and voting: Frank Serio, Jr., Chairman; Richard J. Trepanier, Esq., Clerk; William J. Sullivan; and Associate Members Walter F. Soule and Maurice S. Foulds. Member Raymond Vivenzio arrived later in the meeting to vote on the petition of NYNEX (Boston Hill). Building Inspector Charles Foster was present. DISCUSSION WITH MR. AND MRS. BLAIN - BELMONT STREET Fire Chief William Dolan reported that he received a call from Mr. and Mrs. Blain concerning the refrigeration business on Belmont Street. Their concern is with a truck making deliveries. He investigated the situation and reported that it is not a IO-wheeler as Mrs. Blain stated. He called the police department and spoke to Lt. Stanley who stated that any truck can stop and make deliveries. The owner also said it is not a 10-wheeler and that they come in via Sutton Street. Mrs. Blain stated that the building in question is owned by Mr. William Boddy and was the subject of a recent variance decision. The problem is with the company renting the building. They have occupied it approximately two months. The tru~k she sees is very large. Chief Dolan added that according to Lt. Stanley, they are within their rights. Chairman Serio stated that it appears that this matter does not belong before the Board of Appeals. Concerning the same property. Mrs. Blain stated that she left the last Board of Appeals meeting early and did not have an opportunity to address the Board. It concerns the buffer where the trains are. The buffer is beside the elderly complex and she wants it buffered more. The attorney for Mr. Boddy said it was a small dump and that they did everybody a favor by cleaning it up. She feels that it was not a dump - there were 100 trees and a pile of bricks. They took down all the trees. The Board told Mrs. Blain that they would look into the situation. PUBLIC HEARING Poutenis, Alvan and Jennie - Special Permit - Waverly Road The Clerk read the legal notice. Attorney John J. Willis, representing Mr, and Mrs. Poutenis, made the following presentation: - The applicants were before the Board approximately two years ago, at which time the dwelling was a duplex. December 10, 1984 -2- Regular Meeting Poutenis - continued - They were granted a Special Permit to convert the dwelling to three units and they reconstructed the parking area to accommodate a third unit. - Their children are older and they are considering purchasing another house. - They would like to renovate the second floor the same as the first floor, resulting in four units. - They would construct a covered staircase. - The conversion would not adversely affect the exterior. - The location is appropriate and has access from Morris Street. - Waverly Road is heavily traveled and there are several multi-family dwellings in the area. - The parking requirements will be met and access and egress will again be from Morris Street. No one spoke in favor or opposition to the petition. MOTION: by Mr. Foulds to take the petition under advisement. SECOND: by Mr. Trepanier VOTE : Unanimous - motion carries DECISIONS New England Telephone - Variance - Turnpike Street A letter from Mr. George Gagon, dated 12/10/84, requesting that the petition be withdrawn without prejudice was read and placed on file. MOTION: by Mr. Sullivan to allow the petition of New England Telephone for a variance at 1459 Turnpike Street be withdrawn without prejudice. SECOND: by Mr. Soule VOTE : Unanimous - motion carries.
