Regular Meeting
The BOARD OF APPEALS held a regular monthly meeting on Monday evening, November 10,
1980 at 7:30 p.m. in the Town Office Meeting Room. The following members were
present and voting: Prank Serio, Jr., Chairman; Richard Trepanier, Clerk; and
Associate members Walter Soule; ~urice Folds; and Raymond Vivenzio.
PUBLIC HEARINGS:
John and Grace Subatch - Request for a v~rianoe on Thorndike Road
The clerk read the legal notice.
Mr. Subatch spoke. He is requesting the variance for security purposes for
himself and his f~mily. He stated that he has a lien on the property because
he did not have the funds to keep and maintain his household.
He further stated that the lot consists of frontage on two streets - Thorndike
and Irving, with 100' frontage on both streets. He has been paying taxes on
the property for eight years. He feels that the land would be best utilized
if he could sub-divide it into two lots: A and ~, nd build a duplez on Lot A.
The following abutters voiced '%o objection" to the variance: Mrs. Ernest
Roberts, 15 Brightwood Avenue, who owns an empty lot near the property in question
and Mr. Steven Gallant, 36 Perley Road.
At this point, the clerk r~d letters from the Building Inspector and the Planning
Board.
The following spoke in opposition to the variance: Mr. and Mrs. Ernest Kress,
5 Irving Road; Mr. Edward Scanlon, 41Perley Road; Mr. Phillip Watson, 33 Perley Rd.,
Mrs. Andrew Heinze, 66 Throndike Rd.; and Mr. Carl Wagoner, 15 Columbia Road.
Mr. Kress voiced concern about having too many houses in t~e area. He feels that
the Board may be setting a precedent by granting the variance to the 3ubatch's and
that more of his neighbors could do the same thing. He then presented letters
from three other neighbors (Hilda Peterson, 16 Irving Rd.; Mr. and Mrs. Felix
Benullo, 30 Troy Road; and~r, and Mrs. Peter Peluso, 2 Irving Rd.), all eXPressing
opposition.
Mr. Scanlon also voiced concern over the possibility of too much conjection in the
area. He remembers a fire in the neighborhood which created many problems because
of low pressure and also said that the Highway Department has difficulty bringing
their trucks down the streets in the winter. He further stated that this area
was changed from '~usiness" to "Village" zoning approximately 15 years a~o, and
the m~jority of people have been there for some time. They arenot a neighborhood
of complainers, they just like things the way they are.
~&r. Watson cited a duplex at the bottom of Perley Road, but said it is a former
business, and nobody objected because the building was existing at the time it
became a duplex. He is objected to any further construction of multi-family homes.
Mr. Serio asked the abutters about their feelings on a single family home, and
Mr. Scanlon voiced opposition.

Mrs. Heinze then spoke. She counted 42 children who play in the area and she
is very concerned about their safety should more homes be constructed, thereby
bringing more children into the neighborhood, as well as more traffic.
Mr. Vivenzio then told Mr. Subatch that he would have to tie in a hardship
in requesting the v~riance along with his personal hardship.
Mr. Subatch responded that if granted, this is a form of security; if denied,
it is security he will not have.
Mr. Watson questioned the hardship and said people with hardships don't build
houses.
Mr. Subatch said he is not trying to harm the neighborhood. He is just looking
out for the security and welfare of his f~mily. He has lived there for eight
years and does not feel that building a new home will derogate from the neighborhood.
He needs the income from the proposed building for his f~mily.
Motion: by Mr. Foulds to take the matter under advisement.
Second: by Mr. Vivenzio.
Vote: Unanimous in favor of the motion.

Mr. Foulds walked the property with the abutters. They do not have any
problem with lights shining into their homes frc~ traffic through the park.
The only problem they have is people cutting through the one-way and the Board
agreed that it is a police matter.
Motion: by Mr. Fc~lds to amend condition ~ to read: =starling at M~rblehead
and Williams Street corner and proceeding to the Northwest corner for eight (8)
parking spaces as indicated on the pl~u."
Second: by Mr. Soule.
Vote: Unanimous in favor of the motion.
Other Business:
Letters from the Town Planner and Building Inspector were read and placed on file.
