l~e~ula~ Meeting
The Board of Appeals held a regular monthly meeting on Nonday evening,
Jauuary 12, 1981 in the Town Office Nesting Room. ~he following members
were present and voting: Frank Serio, Jr., Cha/rman; Rich~?d J. Trepanier,
Esq., Clerk; William J. Sullivan; Augustine Nickerson; and Associate Nember
N~urice Foulds. Associate Nem~ers Walter Soule and Ea~vmond Vivenzio, Esq.
were also present tonight.
Pressmen - John and S~lvia - variance request on Osgood Street
The clerk read the legal notice.
Attorney John J. Willis, Jr. represented the applicants. He showed the Board
the plan. When Mr. Frank Dushame broke the property several years ago, the
garage/cabana ended up too close to the lot line. ~he violation was discovered
recently when the plot plan was conducted during the sale of the house. If
the variance is not granted, the existing g~rage/oabana will have to be removed.
He f~her stated that a hardship would be incurred because the Pressman's use
and enjoy ~he structure in violatica and are in the process of fixing up the
premises, bu~ did not anticipate having %0 tear down the garage/cabana and
constrl~ot a new ogle.
He further testified that the variance request is for the life of the structure,
and when it becomes time to build a mew one, it will be constructed within the
requirements of the Zoning Wy-Law.
No opposition was voiced at %he hearing.
The clerk then read a letter from the Planning Board who recommended favorable

unanimously to grant the variance, with the condition that it be for the life of
the structure only.

Continued from December 8, 1980 -Mr. Sub, ch and Attorney John J. Willis, Jr.,
were present tonight. There was a questic~ on whether the Board would act tonight
because of Mr. Frizelle's absence. He sat at the public hearing, but if the
Board waits until February, the 75 day limit for making a decision will expire.
The Board reviewed the plans a~c~in, and upon a moticu made by Mr. Vivenzio and
seconded by Mr. Trepanier, it was voted unanimously to grant the variance with
the conditions that the garage located on the proposed lot line be removed and
that the variance is for a single family dwelling.

Other Business
The Board discussed incorporating a filing fee. The Chairman asked the
secretary to check with the Town Planner since she is in the process of
trying to da the same for the Planning Board. Also, the secretary will
get a ruling from Town Cou~sel on this.
