HomeMy WebLinkAbout1982-06-01June 1, 1982 Emergency Meetin§ The BOARD OF APPEALS held an emergency meeting on Tuesday evening, June 1, 1982 at 8:00 p.m. in the Town Office Meeting Room with the following members present and votin~ Frank Serio, Jr., Chairman~ Alfred E. Frizelle, Esq. Vice-Chairman~ William J. Sullivan~ Augustine W. Nickerson~ and Walter F. Soule. The purpose of the meeting was to render a decis~ion on the petition of Mass. Refusetech, Inc. seeking a variance for the stack on the proposed trash-to-energy plant on Holt Rd. The public hearing for this petition was held on May 18, 1982. Members Nickerson and Sullivan expressed concerns over pollu- tion and prevgnting problems in the future. Member Frizelle doesn't think pollution is a zoning matter~ DEQE and EPA have the powers to enforce restrictions. Chairman Serio read a letter from Carol Delano of the Methuen Town Council which was accepted and placed on file. MOTION: by Mr. Frizelle to grant the variance subject to the following conditions: Said stack shall at all times be operated in conformity with all rules and regulations, local, state,~and federal which regulates the emissions from said stack. In the event that emissions from said stack operates to the detriment of the public good, the operator thereof shall remedy any conditions which causes said emissions.
