HomeMy WebLinkAbout1982-09-20September 20, 1982 Regular Meeting The BOARD OF APPEALS held a regular monthly meeting on Monday evening, September 20, 1982 at 7:30 p.m. in the Town Office Meeting Room with the following members present and voting: Frank Serio, Jr., Chairman, Alfred E. Frizelle, Esq., Vice- Chairman, Richard J. Trepanier, Esq., Clerk, Augustine W. Nick- erson, and Raymond A. Vivenzio, Esq. Members William J. Sullivan, Maurice S. Foulds, and Walter F. Soule were present but not sitting on the public hearings. PUBLIC HEARINGS Louis ~agoli - Variance - Inqlewood Street The Clerk read the legal notice. Mr. Napoli's son was present and made the following points: - He wishes to divide one lot into two lots to enable him to construct a new dwelling which would front on Jetwood Street. - The variance is needed for the area and setback requirements. -His father has owned his two-family dwelling since 1957. The proposed dwelling would be a single family dwelling. No one spoke in favor or opposition to the petition. A letter from the Building Inspector dated 9/20/82 was read and placed on file. . MOTION: by Mr. Frizelle to take the matter under advisement. SECOND: by Mr. Trepanier VOTE : Unanimous motion carries. Richard Jensen Variance Faulkner Road The Clerk read the legal notice. Mr. Peter Romano, buyer of the property spoke for the applicant and made the following points: The variance is needed to allow the dwelling to remain without the required setbacks. - The conveyance'is being held up by the bank due to the violation. - The dwelling has existed for many years on the parcel. September 20, 1982 -2~ Regular Meeting jensen continued No one spoke in favor or opposition to the petition and no letters were submitted. Some of the neighbors were present at the public hearing seeking' an explanation of the requested variance and Chairman Serio ex- plained that there are many parcels of land with existin9 dwellings in North Andover which do not meet the current requirements of the Zoning By Laws. Since plot plans have been required by the lending institutions, these violations are being discovered and a variance running with the land is necessary to obtain mortgages. MOTION: by Mr. Frizelle to grant the variance as requested. SECOND: by Mr. Nickerson VOTE : Unanimous - motion carries. DECISIONS Nanc~ Melillo Variance - Marblehead Street Sitting: Serio, Frizelle, Nickerson, Foulds, Soule The petitioner has failed to submit corrected plans to the Board after several requests. MOTION: by Mr. Frizelle to deny the variance request because the petitioner failed to provide the necessary evidence for the Board to render a decision. SECOND: by Mr. Nickerson VOTE : Unanimous - motion carries. Louis Napoli Variance In~lewood Street MOTION: by Mr. Frizelle to grant the variance as requested. SECOND: by Mr. Vivenzio VOTE : Unanimous-motion carries. OTHER BUSINESS Minutes 1981 June 8, July 13, July 21,.August 10, September 15, October 13, December 14, December 17. 1982 - January 11, February 8, MarCh 8, April 12, May 10, May 18, June 1, June I4, June 28, July 12, Aug. 9.
