The North Andover Board of Appeals held a public bearing(s) at Town Hall, at 120 Main Street,North
Andover,MA on'Tuesday,February 13,2018 at 7:30 PM,and previous hearings on October 10,2017,.
November 14,2017,December 1.2,2017,January 9,2018 and February 13,2018 respectively for the
application of David Cronin(hereinafter"Applicant")with respect to the property located at 234 Date
Street(Map 064.0 Parcel 0028),North Andover,MA 01845 in the R1 Zoning District(hereinafter
"Property").
The Applicant is requesting a variance pursuant to Section 4.136.3.c.ii.7 for construction of a second story
addition and expansion of an existing structure by more than fifty percent of the gross floor(GFA) of the
existing primary structure (allowed 50 percent, requested 68.9 percent, with relief of 18.9 percent) in the
R-1 Zoning District.
Legal notices were sent to all the certified abutters provided by the Town of North Andover,Assessors
Office, and were published in the Eagle-Tribune, a newspaper of general circulation in the'Town of North
Andover,on September 26,2017 and October 3,2017
The following plans and exhibits were submitted at the public hearing;
Plan of Land, Christopher Clocher,R.A. Architectural Designs dated 9/12/2017, Storm Water Report
dated December 12,2017.
The followingregular voting members were present,Ellen P.McIntyre,D.Paul Foch,Nathan Weinreich, t
Alexandria Jacobs and Ronn Faigen. The Board voted to close the public hearing. t
Upon a motion by Paul D, Foch, seconded by Ellen P. McIntyre to Grant the variance(s) pursuant to
Section 4.136.3.60 for expansion of an existing structure by more than fifty (50) percent of the gross
floor (GFA) of the existing primary structure (allowed 50 percent, requested 68.9 percent with relief of 1
18.9 percent) in the R-1 "Zoning District, with the condition that the applicant subunit drainage and
watershed special permit plans to the North Andover Board of Appeals for informational purposes
subsequent to the Planning Board approval.

The following members voted in favor of the variance(s)were: Ellen McIntyre,D.Paul Koch,Nathan
Weinreich,Alexandria Jacobs and Ronn Faigen, The Chairman declared approved votes 5-0 in favor and
the variance(s).
The Board finds that the Applicant has satisfied the provisions to allow for construction of a second story
addition and a variance pursuant to Section 4.136.3.e.ii.7 for expansion of gross floor (GFA) of an
existing primary structure by more than 50 percent(allowed 50 percent,requested 68.9 percent with relief
of 18.9 percent) in the R-1 Zoning District, all of which is pursuant to and in accordance with the Plan
and testimony at the public hearing.
Notes:
1. This decision shall not be in effect until a copy of this decision is recorded at the Essex County
Registry of Deeds,Northern District at the applicant's expense.
2. The granting of the Variance as requested by the applicant does not necessarily ensure the granting
of a building permit as the applicant must abide by all applicable local,state, and federal building
codes and regulations,prior to the issuance of a building permit as required by the Inspector of
Buildings.
3. If the rights authorized by the variance are not exercised I year of the date of the grant,it shall
lapse, and may be re-established after notice and a new hearing.
