Folks,
Attached is the Stormwater Review for 0 Great Pond Road—Dehullu. The plan shows a conservation zone which is
applicable to lots built after 1994. However,the notes on the plan state that the lot was created prior to 1984. The
notes also refer to an ANR plan created in 2001. The Planning Department has a copy of that plan and it does show
two
lots created from three lots. In my opinion that plan created two new lots, however the ZBA and the Zoning Code
Enforcement Officer need to make a final determination as to whether this lot was created after 1994 and whether the
Conservation Zone applies.

Dear Ms. Tym on and Board Members:
Per your request, I have conducted a technical review of the May, 2013 Watershed
Special Permit Application packet submitted by Dehullu Homes for the above-referenced
project. Included in the materials I received and reviewed were the following:
■ Watershed Special Permit Application, Map 35, Lot 4, Stephen Dehullu,
Petitioner.
■ Variance and Watershed Special Permit Site Plan (i sheet), Assessor's Map 35,
Parcel 4, prepared for Applicant Steve Dehullu by William G. Holt, PLS, RS, SE
and dated August 12, 2012.
My primary focus in this technical review is on the overall stormwater management
approach and design concepts used in the project, as well as its compliance with the
Town of North Andover's zoning requirements for Watershed Protection Districts, the
Massachusetts Department of Environmental Protection (DEP) Stormwater Management
Standards and Regulations, and the North Andover Wetlands Bylaw. It is my
understanding that a Notice of Intent (NOI) application for the project has been or will be
filed concurrently with the Conservation Commission, and that an application for a
variance has been filed with the Zoning Board of Appeals. My review is aimed at
assisting all three town boards in their respective reviews of the project.
The proposed project entails the construction of a single family home on an undeveloped
lot on the north side of Great Pond Road, portions of which are in the Watershed
Protection District as well as within the buffer zone of Lake Cochichewick and a locally
jurisdictional wetland. The project is entirely within the Zone A for the Lake
Cochichewick public water supply, defined by the Massachusetts Drinking Water
Regulations (310 CMR 22.02) as including the land area within a 400 foot lateral
distance from the upper boundary of the bank of a Class A surface water source. The lot
is presently wooded and undeveloped. Drainage from the property is in a southwesterly
direction,toward the isolated vegetated wetland and Lake Cochichewick.

The proposed project entails construction of a single family home with an attached
garage and deck, driveway, utilities and lawn, all of which is shown on the plan as being
within the Non-Disturbance Zone of the Watershed Protection District. A portion of the
lawn and driveway are also shown on the plan as being within the 100-ft Conservation
Zone.
My comments on the proposed plan are outlined below:
1. According to the plan, the subject property was created prior to October 24, 1994,
therefore the provisions in the Zoning Bylaw related to the Conservation Zone do
not apply.
2. The boundary of the Non-Disturbance Zone should include the 100-ft setback
from the locally jurisdictional wetland.
3. The project calls for construction of a new permanent structure within the Non-
Disturbance Zone which, according to Section 4.136(4)(C) of the Zoning Bylaw,
is an allowable use only by Special Permit and only after a variance has been
granted by the Zoning Board of Appeals. In an apparent incongruity, Section
4.136(4)(f) of the Bylaw calls for any special permit for a new permanent
structure to require that such a structure be constructed outside the Non-
Disturbance Buffer Zone.
4. The project also entails a change in topography or grade and vegetation removal
within the Non-Disturbance Zone; both of these activities are allowable only by
Special Permit.
5. Per the Special Permit Requirements of the Watershed Protection District, a
written certification by a Professional Engineer or qualified hydrologist or
hydrogeologist is needed, stating that there will not be any significant degradation of
the quality or quantity of water in or entering Lake Cochichewick.
6. The application also requires proof that there is no reasonable alternative outside of
the Non-Disturbance Zone for the proposed activities, this was not included in the
application materials I received.
7. The project proposes to use infiltration to manage stormwater runoff from the project,
however it is not clear whether the soils on site are suitable for infiltration as no soils
data was included with the application.
8. Design details are needed for the proposed stormwater management structures and
erosion controls.The plan refers to a detail on Sheet 3 but only Sheet 1 of 1 was filed.
9. It is not clear from the proposed grading that the driveway will drain to the infiltraton
trench.

10. The proposed utility lines should be run under the driveway to the maximum extent
possible in order to minimize the area of vegetation clearing, particularly in the area
closest to the lake.
11. The plan calls for the use of native vegetation where possible. As with other
projects in the Watershed Protection District the Planning Board may want to
request a Landscape Plan.
12. Both the limits of approved clearing and the restriction on lawn care products
should be permanently recorded on the deed to the property. The total impervious
area allowed within the Non-Disturbance Zone should also be permanently
restricted.
13. Architectural plans for the proposed housewere not included ded in the application
packet. It should be noted that runoff from metal roofs (or roofing elements)
cannot be infiltrated in a Zone A.
14. Ongoing maintenance of the proposed stormwater management structures should
be addressed.
15. A Construction Sequence aimed at minimizing the total area and duration of soil
disturbance should be provided.
I appreciate the opportunity to assist the North Andover Planning Board, Conservation
Commission, and Zoning Board of Appeals with the review of this project, and hope that

NARRATIVE
PROJECT PURPOSE: Notice of Intent for Signle Family Dwelling .
The site location is currently an existing building lot as depicted on Plan 914036 (North Essex Registry
of Deeds), and North Andover Assessor Map 35 Parcel 4, and is zoned for a single family residential
use. The lot was created prior to 1984, and has been owned by Kenneth and Sophie Haphey since
August 17, 1984 (see Bk 1853 Pg 336 in the N.E.R.D.) Planning and Zoning permits having been
applied for as required by the Watershed Protection District Overlay. The site is approximately 2.79
acres, and is largely wooded with a gentle to moderate slope along the front and rear portions of the lot
with a steep incline in the center. The lot is served by 175' of frontage on Great Pond Road, an
existing public roadway that has a paved surface. The lot will be serviced with municipal water, sewer,
electric and natural gas utilities that currently exist in Great Pond Road. Utility service connections and
construction of a driveway will need to be installed to service the proposed dwelling.
Site Description:
The subject parcel is entirely located within the Town of North Andover Watershed Protection Overlay
zone. As such the parcel is subject to the requirements set forth in Section 4.136 of the Town of North
Andover Zoning Bylaws. The subject parcel is not located in a Special Flood Hazard area as shown on
FEMA Flood Insurance Rate Map Community Panel No.250098 Panel 6C dated 7-3-2012.
The applicant proposes to constrict a single family dwelling with associated appurtenances as depicted
on the accompanying Site Design Plans. The proposed structure is located within the Non-distubance
area, as defined by Table 2 of Section 4.136 of the North Andover Zoning Bylaw. The lot was in
existence prior to 1994.
An application for a variance as required by Zoning Bylaw 4.136.3(c)ii(3)has been filed herewith.
An application for a Watershed Special Permit is currently before the Planning Board.
An application for a Notice of Intent is being submitted to the NA Conservation Commission.
The Bordering Vegetated Wetland(BVW) is separated from the site by Great Pond Road.

The driveway and utility connections will be Iocated within the 100 foot buffer as shown on the
` accompanying Site Design Plans. The house is located outside the 100 foot buffer to the BVW,but is
located within the 100' buffer to an Isolated Vegetated Wetland(1,874 s.f)which is not regulated by
MA DEP but does fall under the jurisdiction of the North Andover Conservation Bylaw since the IVW
is larger than. 1000 s.f. The house will be located beyond the 50'No-Build area established by the local
regulations.
Zoning Bylaw Section 10.31:

The subject property is located within a Zone R1 zoning district and currently is vacant.
The proposal meets all of the Zoning requirements for the underlying RI Zone, for frontage, area, and
setbacks. The attached site plan demonstrates a suitable use of land and building on this site.

- Proof of alternative to actions within the Non-disturbance and/or Non
Discharge Zones
Stephen Dehullu is purchasing the referenced property and wishes to construct a single family home on
the lot. Because of the topography of the lot,the best location for the proposed house is within the Non-
Disturbance Zone of the Watershed Protection District. Construction of the house in the location shown
on the attached plan,will disturb less area within the watershed and offers less potential for erosion
concerns during construction than the alternative of building outside of the Non-Disturbance Zone.
A review of Sheet 2 of the attached plans will clearly reveal that the desired location of the house is far
preferable to the alternative location. The proposed location will require clearing of 18,385 s.f. of land
while the alternative would require clearing of 31,158 s.f. of land. The driveway for the project as
proposed is 180 linear feet long and occupies 2,554 s.f.,while the alternative drive would be 553 11. in
length and occupy 6,609 s.f.. The total impervious area as proposed is 4552 s.f.,which is less than the
impervious area of 4850 s.f. that would be generated by a driveway servicing a dwelling located outside
of the non-disturbance zone
The alternative site location that has been shown is on the only relatively level or low slope area of the
property beyond the Non-disturbance zone. Locating a proposed house just outside the Non-disturbance
zone would place it in an area of steep slopes, which would require extensive cut and fills and the need
to construct extensive retaining walls and does not represent a realistic alternative to the current
proposal.
Erosion Control Plan:

On site sedimentation control will be placed at the limits of the proposed work area as depicted on the
project site plan,prior to any construction and remain until all site work is complete,the soil has been

stabilized and vegetative growth has been established.
On Site Construction Sequence:
1. Install sediment control devices as depicted on the project site plans;ie constriction entrance,
haybales/silt fence, silt sacks in nearby down gradient catch basins. Temporary sediment
basins as required. Have dewatering sediment bag on hand if needed.
2. Cut and remove trees, strip loam an subsoil as required and stock pile on site and protect with
erosion control measures;
