This document is to address a requirement WRITTEN DOCUMENTATION of Section on
page 4 of 4 on the Variance application.
A. The particular use is existing as a Single Family Residential and remains as such.
B. The soil conditions, topography shall not be altered or affected.
C. The hardship is a pre-existing non conforming situation and with a growing family
needing more room to function properly.
D. The proposed addition will be small and consistent with conditions in the immediate
area.
E. The zoning is meant to protect the public health, safety conditions,traffic overcrowding
conditions do not derogate the purpose. This allows the family to maintain a level of housing
for the level of income .

2002 at 7:30 PM upon the application of Cornelius&Karen Casey, 10 Cabot Road,North Andover,MA
requesting a Variance from Section 7,Paragraphs 7.1,7.2,&7.3 and Table 2 for dimensional relief of front,
side and rear setbacks of an existing dwelling,and proposed addition,and left and rear setbacks for an
existing shed on a non-conforming lot;and for a Special Permit from Section 9,Paragraph 9.1 and
Paragraph 9.2 for the extension of pre-existing,non-conforming structures on a pre-existing,non-
conforming lot in the R-4 zoning district.
The following members were present: Robert P.Ford,Walter F.Soule,Ellen P.McIntyre,George M.
Earley and Joseph D.LaGrasse.
Upon a motion made by Joseph D.LaGrasse and 2nd by Walter F. Soule,the Board voted to GRANT a
dimensional'Variance for relief of front setback of 9.5 feet for the existing structure,left side setback of 5
feet and rear setback of 18 feet for the proposed addition;and left side setback of 11 feet and rear setback
of 28 feet for an existing shed;and a Special Permit from Section 9,Paragraph 9.1 and 9.2 for the
extension of pre-existing,non-conforming structures on a pre-existing,non-conforming lot as shown on the
Plan of Land by: Scott L. Giles,Registered Professional Land Surveyor,#13972,50 Deermeadow Road,
North Andover,MA 01845 revised 3/12/02 on the condition that the mylar be changed to Cabot Road and 4

on October 11,2001. This date starts the time period. The petition in its present form is unacceptable for
the Zoning Board of Appeals to render a decision,for the following reasons:
1. The legal notice,required by law,was not processed to the local newspaper,the Lawrence Eagle-
Tribune, for the November 13,2001 meeting.
2. Mr. Giles's request to continue cannot be granted because the legal notice cannot be read at the
November 13,2001 meeting which would start the legal public hearing. If the petition is not on
the agenda,how can it be continued?
3. The application as submitted is incomplete and has inaccuracies.
4. The shed location on the plot plan has not been addressed. It is in violation of the Zoning By-
Laws.
5. No plans for the requested addition have been submitted. They are necessary for the Zoning
Board of Appeals to render a decision.
6. We,therefore,request that the petitioner's agent,Mr. Giles,submit a new application starting the
process with the Town Clerk. This should include ten sets of plans by a registered professional for
the addition,and an updated plot plan should also be made. Instructions are on page 4 of the
application form. Then,the North Andover Zoning Board of Appeals can issue a new legal notice
for the agent to take to the Lawrence Eagle-Tribune.

I Center, 120R Main Street,North Andover, MA on Tuesday the 13th of November, 2001
at 7:30 PM to all parties interested in the appeal of Cornelius & Karen Casey, 10 Cabot
Street,North Andover requesting a Variance from Section 7, Paragraph 7.1, 7.2 Table 2
& 7.3 for dimensional relief of front, side and rear setback for proposed 12' x 20'additign
for a non-conforming lot, and for a Special Permit from Section 9 Paragraph 9.1 and
Paragraph 9.2 for a pre-existing, non-conforming use.
Said premises affected is property with frontage on Cabot within the 17-4 zoning district.
Plans are available for review at the office of the Building Department 27 Charles Street,
North Andover, MA Monday through Thursday from the hours of 9:00 AM to 2:00 PM.
