Information and Instructions
Massachusetts General Laws chapter 152 requires all employers to provide workers'compensation for their employees.
Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire,-
express or implied,oral or written."

of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152,§25C(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced-acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapter 152,§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority."
Applicants
Please fill out the workers' compensation affidavit completely,by checking the boxes that apply to your situation and,if
necessary,supply sub-contractors)name(s),address(es)and phone number(s)along with their certificate(s)of
insurance. Limited Liability Companies(LLC)or Limited Liability Partnerships(LLP)with no employees other than the
members or partners,are not required to carry workers'compensation insurance. If an LLC or LLP does have
employees,a policy is required. Be advised that this affidavit maybe submitted to the Department of Industrial
Accidents for confirmation of insurance coverage. Also be sure to sign and date the affidavit. The affidavit should
be returned to the city or town that the application for the permit or license is being requested,not the Department of
Industrial Accidents. Should you have any questions regarding the law or if you are required to obtain a workers'
compensation policy,please call the Department at the number listed below. Self-insured companies should enter their
self-insurance license number on the appropriate line.

Please be sure that the affidavit is complete and printed legibly. The Department has provided a space at the bottom
of the affidavit for you to fill out in the event the Office of Investigations has to contact you regarding the applicant.
Please be sure to fill in the permit/license number which will be used as a reference number. In addition,an applicant
that must submit multiple permit/license applications in any given year,need only submit one affidavit indicating current
policy information(if necessary)and under"Job Site Address"the applicant should write"all locations in (city or
town)."A copy of the affidavit that has been officially stamped or marked by the city or town may be provided to the
applicant as proof that a valid affidavit is on file for future permits or licenses. A new affidavit must be filled out each
year.Where a home owner or citizen is obtaining a license or permit not related to any business or commercial venture
(i.e.a dog license or permit to burn leaves etc.)said person is NOT required to complete this affidavit.

Duct Construction and Testing:
C] Building framing cavities are not used as supply ducts.
All joints and seams of air ducts,air handlers,filter boxes,and building cavities used as retum ducts are substantially airtight by means
of tapes,mastics,liquid sealants,gasketing or other approved closure systems.Tapes,mastics,and fasteners are rated UL 181A or
UL 181 B and are labeled according to the duct construction.Metal dud connections with equipment and/or fittings are mechanically
fastened.Crimp joints for round metal ducts have a contact lap of at least 1 1/2 inches and are fastened with a minimum of three
equally spaced sheet-metal screws.
Exceptions:
Joint and seams covered with spray polyurethane foam.
Where a partially inaccessible duct connection exists,mechanical fasteners can be equally spaced on the exposed portion of the
joint so as to prevent a hinge effect.
Continuously welded and locking-type longitudinal joints and seams on ducts operating at less than 2 in.w.g.(500 Pa).
Duct tightness test has been performed and meets one of the following test criteria:
(1)Postconstruction leakage to outdoors test:Less than or equal to 8 cfm per 100 ft2 of conditioned floor area.
(2)Postconstruction total leakage test(including air handier enclosure):Less than or equal to 12 cfm per 100 ft2 pressure differential of
0.1 inches w.g.
(3)Rough-in total leakage test with air handler installed:Less than or equal to 6 cfm per 100 ft2 of conditioned floor area when tested at
a pressure differential of 0.1 inches w.g.
(4)Rough-in total leakage test without air handler installed:Less than or equal to 4 cfm per 100 ft2 of conditioned floor area.
Heating and Cooling Equipment Sizing:
Additional requirements for equipment sizing are included by an inspection for compliance with the International Residential Code.
For systems serving multiple dwelling units documentation has been submitted demonstrating compliance with 2009 IECC Commercial
Building Mechanical and/or Service Water Heating(Sections 503 and 504).
Circulating Service Hot Water Systems:
Circulating service hot water pipes are insulated to R-2.
Circulating service hot water systems include an automatic or accessible manual switch to tum off the circulating pump when the
system is not in use.
Heating and Cooling Piping Insulation:
El HVAC piping conveying fluids above 105 degrees F or chilled fluids below 55 degrees F are insulated to R-3.
Swimming Pools:
E] Heated swimming pools have an on/off heater switch.
❑ Pool heaters operating on natural gas or LPG have an electronic pilot light.
Timer switches on pool heaters and pumps are present.
Exceptions:
Where public health standards require continuous pump operation.
Where pumps operate within solar-and/or waste-heat-recovery systems.
Lj Heated swimming pools have a cover on or at the water surface.For pools heated over 90 degrees F(32 degrees C)the cover has a
minimum insulation value of R-12.
Exceptions:
Covers are not required when 60%of the heating energy is from site-recovered energy or solar energy source.

A permanent certificate is provided on or in the electrical distribution panel listing the predominant insulation R-values;window
U-factors;type and efficiency of space-conditioning and water heating equipment.The certificate does not cover or obstruct the visibility
of the circuit directory label,service disconnect label or other required labels.

1. PARTIES
This Agreement is made and entered into on November 19,2013 between P&R Boucher Builders,Ltd.
of 155 Broadway Road-Suite#10,Dracut,Massachusetts 01826(hereinafter referred to as the"Contractor")and
Jeffrey Wilson of 100 Colgate North Andover,MA(hereinafter referred to as the"Owner").
In consideration of the mutual promises and covenants contained herein,the Contractor and the Owner hereby agree as
follows:
2. GENERAL SCOPE OF WORK DESCRIPTION:
Construct a In—Law suite and screen porch and deck according to plans drawn by CWC Design,Inc.and the following
addenda,which are an integral part of this contract,are also included as noted:

3. GENERAL CONDITIONS FOR THE AGREEMENT ABOVE:
A. Contractor Responsibilities
• To supply all labor,materials,tools,equipment,construction.equipment and machinery necessary for the proper
execution and completion of the above described project unless otherwise noted in contract documents.
• Contractor will possess during this project public liability insurance covering damages up to$2,000,000 and all
workers on site will be covered by workers compensation insurance.
• Apply for the required building permits
• The Contractor shall supervise and direct the Work,using his best skill and attention and shall be solely responsible
for all construction means,methods,techniques,and procedures and for coordinating all portions of the work under
the Contract.
• Contractor will do all work necessary to construct the project as specified.All reasonable precautions will be taken to
protect the Owner's property.
• Contractor shall enforce strict discipline and good order among the Contractor's employees and other persons
carrying out the Agreement.The Contractor shall not permit employment of unfit persons or persons not skilled in
task assigned to them.
• The Contractor shall be responsible to the Owner for the acts and omissions of the Contractor's employees,
Subcontractors and their agents and employees,and other persons performing Work under a contract with the
Contractor.
• The Contractor shall keep the premises and surrounding area free from accumulation of waste materials or rubbish
caused by operations under the Agreement.At the completion of the Work,the Contractor shall remove from and
about the Project waste materials,rubbish,the Contractor's tools,construction equipment,machinery and surplus
materials.
• To advise the Owner promptly if concealed conditions are ascertained which require additional or different work,and
to proceed in such event in accordance with this agreement.
• Project photographs:During the course of the project photos will be taken.The Contractor may use his sets of photos
in his business as examples of specific types of projects.The Owner's name will not be released to any other parties
without the Owner's consent.
B. Owner Responsibilities
• To advise the Contractor of any condition of the property that they become aware of which affects the Contractor's
ability to perform.
• To secure storage areas for materials delivered to the work site.
• To select in a timely manner all allowance items,materials and colors required during the construction process.Once
any material has been approved by the Owner said material might not be able to be returned for credit if the Owner
subsequently changes their mind.
The appropriateness of all selections is the Owner's responsibility;designers,vendors,and sales people's opinions
are only opinions and they can not be held responsible for your satisfaction.Please be absolutely certain about
selections before ordering.

• To avoid interfering with the Contractor,any tradesperson,employees,subcontractors,independent contractors and
other workers herein referred to as the"Workers."
• Owner shall not contract with,authorize or permit,for any reason whatsoever,arty individual,other contractor or
subcontractor to perform,in whole or in part,any additions or changes to
plans and specifications unless authorized to do so by the Contractor,in writing.
• Owner will assume responsibility to remove from any and all work areas,all household and personal items,and store
those items away from the work areas during the entire duration of this job.Contractor will not be held liable for any
damage to any items not removed from the work area.
C. EXCLUSIONS
This agreement does not include labor or materials for the following work:
1.) PROJECT SPECIFIC EXCLUSIONS:
• Cost associated with the removal of excess fill from.the job site.
• Design lighting fixtures
• New Electrical Over head Service and drop
• Utility cost which are incurred during the normal operation of construction equipment
2.) STANDARD EXCLUSIONS: Unless specifically included in the"General Scope of Work"section,this Agreement does
not.include labor or materials for the following work.
• Termite work and dry rot:Contractor shall not be obligated to perform any work to correct damage caused by
termites,carpenter ants,or dry rot except if specified in Addendum A.
• Contractor shall not be required to provide any services hereunder which are related in any way to the identification,
inspection,testing,containment,removal,or handling in any way of containment's,asbestos and or toxic or
hazardous waste or subsurface conditions or latent conditions.To the maximum extent permitted by law,Owner
hereby agrees to indemnify,defend and hold harmless from any claims or liability arising out of or related to any
containment's,asbestos and/or toxic or hazardous waste encountered by the Contractor in the performance of its
duties hereunder.
• Matching materials:Contractor calls attention to the inherent impossibility of matching plaster,siding,paint,stucco,
concrete,etc.and while Contractor shall make every effort to match existing materials,texture,color and planes,
exact duplication is not promised.
• Removal and/or relocation of ledge,filled ground,rock,asphalt or any other material not
Suitable to construct on or not removable by ordinary backhoe equipment.Owner shall pay the additional cost
incurred by the Contractor as a result plus 25%Contractor's fee.
• The relocation or correction of existing septic tank,leach field,water lines or utility easements.
• The correction of substandard framing.Correction of existing out of plumb or out of level conditions of the existing
structure and the custom milling of any wood used in the project.
• Labor or materials required to repair or replace any Owner supplied materials.
• Surveying that may be required to establish accurate property boundaries for set back purposes.
• Repair of concealed underground utilities not located on the prints or physically staked out by Owner,which are
damaged during construction.

• Repair of damage to roadways,sidewalks or driveways that could occur when construction equipment and vehicles
are being used in the normal course of construction.
• Final construction cleaning.Contractor will leave the site in broom clean condition.
4. COMMENCEMENT AND SUBSTANTIAL COMPLETION OF WORK
Commencement of work:Week of November 2013: Unless the Contractor notifies the Owner otherwise,and
shall substantially complete the work in 14 to 16 weeks. Start may be affected by the approval date of the North Andover
Building Department.
The Owner hereby acknowledges and agrees that the scheduling dates are approximate and that delays that are unavoidable by the
Contractor,such as delays caused by Change Orders,inclement weather or other reasonable cause(s),shall not be considered a
violation of this Agreement.
In no event shall the Contractor begin work and order materials called for by this Agreement before the fourth business day
following the signing of this Agreement because of the Owner's right to cancel as set forth in Paragraph 23 of this Agreement.
5. EXPIRATION OF THIS AGREEMENT
This Agreement will expire 15 days after the date at the top of page one of this Agreement if not accepted in writing by Owner and
returned to Contractor within that time.
6. PAYMENT SCHEDULE AND PAYMENT TERMS
The Owners shall pay the Contractor for the performance of the work called for by this Agreement,subject to additions or deletions subsequently
agreed by a Change Order executed by both the Owner and the Contractor the sum of
$ 131,862.50 (One Hundred Thirty One Thousand Eight Hundred Sixty-Two and 50/100 Dollars)

IMPORTANT NOTICE REQUIRED BY LAW
No contract for residential(Home Improvement)contracting work shall require a down payment(advanced deposit)of
more than one-third of the total contract price or the total amount of all deposits or payments which the General
Contractor must make,in advance,to order and/or otherwise obtain delivery of special order materials and equipment,
whichever amount is greater.
7. FINAL CONTRACT PAYMENT
The final contract payment is due and payable upon"Substantial Completion'(not final completion)of all work under this
Agreement."Substantial Completion"is defined as being the point at which the Building/Work of improvement is suitable
for its intended use,or the issuance of an Occupancy Certificate,or the final building department approval from the town,city or
county building department,whichever occurs first.
The Contractor may not require payments to be made in advance of the times specified above for the reason that he deems himself
or the payments insecure.If,however,the Contractor deems himself to be insecure,the Contractor may,as a condition to
continuing the work called for by this Agreement,demand that the balance of the payments under this Agreement be placed in a
joint escrow account that requires the signature of both the Contractor and the Owner for withdrawal. If the Contractor deems
himself insecure with regard to future payments,the Contractor shall send written notice to the Owner demanding the
establishment of a joint escrow account.The Owner shall thereafter take any and all steps required to establish such escrow
account within five(5)business days of the Owner's receipt of such written notice from the Contractor.

8. PUNCH LIST WORK
Prior to the completion of all work under this Agreement,Owner and Contractor will execute a Pre Completion Punch List of all
items to be corrected.This Punch List shall serve as the one list to be completed by the Contractor prior to completion of all work
under this Agreement.Any item,which may require adjustment or replacement after the initial.Punch List will be covered under
"Warranty"as set forth in Paragraph 13 in this Agreement.
9. HOLD BACK FROM FINAL PAYMENT FOR PUNCH LIST WORK
At the time of making the final payment,Owner may hold back 150%of the value of all Punch list work not completed,for
reasons beyond the control of the Contractor.Owner and Contractor will place a fair and reasonable value on each Punch list item
not completed.This 150%hold back for Punch list work assures that all Punch list work will be completed by Contractor in a
timely manner. Payment for completed Punch List items is due and payable upon submittal of invoice for those completed items,
even though the entire Punch List may not be completed.
10. INTEREST CHARGES
Interest in the amount of 2%per month will be charged on all late payments under this Agreement."Late Payments"are defined,
as any payment not received within 10 days of receipt of invoice from Contractor.
11. PERMITS AND LICENSES
The Contractor shall apply for and obtain all.necessary permits and licenses required from any State or Local authority or agency,
including but not limited to all building and construction permits.The Contractor shall not be held responsible for delays in the
commencement or the completion of the work called for by this Agreement due to the delay by any regulatory,permit granting or
inspectional agency,authority or individual in issuing or signing off on any permits or licenses.Contractor will pay the appropriate
cost for the permits and licenses,present the receipts to the Owner,and Owner shall reimburse the Contractor the cost.Note:The
permit and license fee is included in this Agreement.
Certain home improvement work(i.e..additions,garages,porches etc.)may require other permits including but not limited to
Variance and.Special.Permits under Zoning by-laws through the Board of Appeals,Board of Health Permits for expansion of
sewage disposal systems,Conservation.Commission for a Order of Conditions,etc.Such permits,which may require non—
construction related,engineering,technical or legal representation of the Owner,shall be the responsibility of the Owner. If Owner
request Contractor to coordinate or obtain any of these services,Contractor will perform this work on an hourly basis at the rate of
$60.00 per hour.
IMPORTANT NOTICE REQUIRED BY LAW
If the Owner obtains his/her own construction related permits for the work described and called for by this Agreement or
deals with unregistered contractors,the Owner is hereby advised that in the event of a dispute,judgment and nonpayment
of the Contractor,the Owner will not be entitled to make a claim to or collect from the guaranty fund established by
M.G.L. c. 142A
12. CHANGE ORDERS; ADDITIONAL WORK
This Agreement,including the cost for completion of the work as set forth in Paragraph 6 of this Agreement,is based solely on the
observations the Contractor was able to make with the structure in its current condition at the time this Agreement was executed.
The Owner acknowledges and agrees that in certain remodeling work,the demolition of portions of the preexisting structure may
reveal additional defects,conditions or the need for additional work which must be repaired,altered or carried out in order to
commence or to complete the work described under this Agreement. In such case,the Owner acknowledges and agrees that the
price and the scheduled date of commencement and/or completion may differ from the price and date of commencement or
completion of the work stated in this Agreement.Further,the Owner acknowledged and agrees that such variation shall not be
considered to be a violation of this Agreement.

If additional defects,conditions or the need for additional work is discovered once the work has commenced,the Contractor will
stop work and will point out these unforeseen defects,conditions or the need for additional work to the Owner so that the Owner
and the Contractor can review the work which must be done to remedy or complete these unforeseen defects or conditions.Before
work will start again,the Owner and the Contractor shall agree as to any additional cost for such work and the length of any delay
in the completion date as a result of the same.Once the scope,cost and time to complete such additional work is determined,the
Owner and Contractor shall execute a Change Order indicating the work to be done,the cost for same and the length or delay in
completion associated with the same.
The Owner may order changes in the work to be completed pursuant to this Agreement.If the Contractor agrees to perform such
additional work,a Change Order will be executed by both the Contractor and the Owner setting forth the cost of such change and
any delay in the completion of the work called for by this Agreement as a result of such change.If the actual cost associated with
the additional work can not be determined in advance,Owner agrees to pay for such Change Order on a time and materials basis
along with any subcontractor additional cost.The rates charged for time and materials shall be$60.00 per hour for Contractor and
Lead Carpenter,$52.00 per hour for other employees.
Materials shall be charged at cost plus 25%. A 25%Contractor profit and overhead shall be charged on all subcontractor
additional cost.
Any alterations or deviations from the work to be completed pursuant to this Agreement involving extra cost of materials or labor
will be commenced only upon execution of a written Change Order executed by both the Owner and the Contractor.No variations,
alterations,deviations,deletions or extra work can be or will be made unless both the Owner and the Contractor specifically agree
in writing.
The Contractors profit and overhead and supervisory labor will not be credited back to Owner with any deductive Change Orders
(work deleted from this Agreement by Owner.)
Payment for the work called for by the Change Order shall be due and payable upon commencement of the work set forth or
required by the Change Order,unless otherwise stated in the Change Order.
13.WARRANTY
The Contractor provides a limited warranty on all Contractor and Sub—Contractor supplied labor and materials used in this project
for a period of one-year following substantial completion of all work.
Work covered by this Agreement is warranted following substantial completion and provided final payment is received in full
within ten(10)days from final billing.
No warranty is provided by Contractor on any materials furnished by the Owner for installation.No warranty is provided on any
existing materials,including but not limited to,those that are moved and/or reinstalled by the Contractor within the dwelling
(including any warranty that existing/used materials will not be damaged during the removal and installation process).One year
after substantial completion of the project,the Owner's sole remedies(for materials and labor)on all materials that is covered by a
manufacture's warranty is strictly with the manufacturer,not with the Contractor.
Repair of the following items is specifically EXCLUDED from Contractor's warranty:damages resulting from lack of Owner
maintenance,damages resulting from Owner abuse or ordinary wear and tear,deviations that arise such as minor cracking of
concrete,stucco and plaster,minor stress fractures in drywall due to the curing of lumber,warping and deflection of wood,
shrinking/cracking of grouts and caulking and fading of paints and finishes exposed to sunlight.
All warranties for equipment supplied by the Contractor under this Agreement shall be those given by the manufacturers of such
equipment,which shall be and are hereby passed through directly to the Owner.Under such manufacturer warranties,the Owner
may be required to register or mail in a warranty card or other evidence of ownership and use of such equipment in order to
activate such warranties.The Owner's failure to mail in or register such documentation,which failure voids the manufacturer's
warranty,shall not create any responsibility for the Contractor to warranty such equipment.
The express warranties contained herein are in lieu of all other warranties,express or implied,including any warranties of
merchantability,habitability,or fitness for a particular use or purpose.This Limited Warranty excludes consequential and
incidental damages and limits the duration of implied warranties to the fullest extent permissible under State and Federal
law.

14. WORK STOPPAGE,TERMINATION OF CONTRACT FOR DEFAULT
The Contractor shall have the right to stop all work called for by this Agreement and has the right to keep the project idle if
payments are not made to the Contractor in accordance with the Payment Schedule set for in Paragraph 6 of this Agreement,if
payments are not made to the Contractor pursuant to a Change Order as set forth in Paragraph 12 of this Agreement,or if Owner
repeatedly fails or refuses to furnish the Contractor with access to the job site and/or product selections or information necessary
to complete the Contractor's work.The Contractor may stop work and terminate this Agreement if the Owner fails to pay the
Contractor any sum due pursuant to this Agreement within 10 days after the date fixed for payment.
If work is stopped due to any of the above reasons(or for any other material.breach of contract by Owner)and Owner has failed to
take any significant steps to cure his/her default,then the Contractor may,without prejudicing any other remedies the Contractor
may have,give written notice of termination of the Agreement to Owner and demand payment for all completed work and
materials ordered through the date of work stoppage,and any other loss sustained by Contractor,including Contractors profit and
overhead on the balance of the incomplete work under this Agreement.Thereafter,Contractor is relieved from all other contractual
duties,including all Punch List and Warranty work.
15. INSURANCE
The Contractor shall purchase and maintain insurance for the protection from claims under worker's compensation acts,claims for
damages because of bodily injury and from claims for damages to the property which arise or are the result of the Contractor's
work.
The Owner shall notify his/her insurance agent of the execution of this Agreement and to obtain any necessary Riders to his/her
current coverage to cover the Owner's interest and liabilities during the construction process.
16.RESOLUTION OF DISPUTES
The Contractor and the Owner hereby mutually agree in advance that in the event the Contractor has a dispute
concerning this Agreement,that the Contractor may submit such dispute to a private arbitration service which has been
approved by the Secretary of the Executive Office of Consumer Affairs and Business Regulations,and the Owner shall be
required to submit to such arbitration as provided in M.G.L.c. 142A

The signatures of the parties above apply only to the Agreement of the Parties to Alternative Dispute Settlement Initiated
by the Contractor.The Owner,under provisions of said chapter 142A,may initiate alternative dispute settlement even
where that section is not separately signed by the parties.
17. MATERIALS BECOME PROPERTY OF OWNER
The Contractor will continue to own all materials delivered to the Owner's premises for use and installation in connection with the
work to be performed by this Agreement until paid for by the Owner.When the Contractor shall have received payment for such
materials,such materials shall become the property of the Owners.Any surplus materials that have been provided for and paid for
by the contractor remain the property of the contractor,unless otherwise mutually agreed upon by both Owner and Contractor

18. MISCELLANEOUS
RADON NOTICE&LEAD BASED PAINT NOTICE&DISCLAIMER:The United States Environmental.Protection
Agency has expressed concern over the presence of naturally occurring radon gas in homes,and the presence of lead based
products in homes constructed prior to 1978.Prolonged exposure to high levels of indoor radiation,lead based contaminants
or its progeny may affect the health of occupants.Contractor has made no investigation to determine whether there is radon
gas,lead based products or other environmental hazards in the home or affecting premises,although such conditions may
exist.Contractor makes no representation or warranty as to the presence or lack of radon,lead based products or other
hazardous environmental condition,or as to the effect of these or any such condition on the premises or its occupants.
LIENS&ASSESSMENTS: Unless specifically included in this Agreement,Contractor shall not be held responsible for any
bond,liens or assessments on the existing real estate,nor sewer or utility assessments not yet a lien on said property.There is
no lien,nor security interest on the residence as a consequence of this Agreement.
TOILET FACILITIES&UTILITIES:Contractor will provide temporary toilet facilities for this project.Electric,water and
other utilities shall be furnished by the Owner at no expense to Contractor.
SIGN: Contractor is authorized to display his sign on the job premises until completion of work.
19. INDEMNIFICATION
The Contractor shall hold the Owner harmless from any and all damages and claims that may arise by reason of any negligence on
the part of the Contractor,his agents or employees,in the performance of this Agreement;and in case any action is brought against
the Owner by reason of the Contractor's negligence in the performance of this Agreement,the Contractor shall assume full
responsibility for the defense thereof,and upon failure to do so on proper notice,the Owner reserves the right to defend such
action and to charge all cost thereof to the Contractor.
20. ENTIRE AGREEMENT
This Agreement contains and represents the entire agreement between the parties hereto.Owners certify that they have read the
entire contents of this Agreement and acknowledge receipt of a copy of it.It is expressly agreed that this is the only Contract/
Agreement between Owner and Contractor and no verbal agreement of any kind shall be binding on the parties.
21. GOVERNING LAW
This Agreement is governed by the laws of the Commonwealth of Massachusetts and shall be executed in duplicate.The parties
acknowledge that the form,substance,content and notices contained in this Agreement are intended to comply with Massachusetts
General Law chapter 142A,and regulations promulgated thereunder.In the event of any instance of non-compliance,only such
portion shall be invalid and the remainder of this Agreement shall remain in full force and effect.in addition,any such portion not
in compliance shall be read and interpreted so as to have its intended meaning to the maximum extent allowed under such law and
applicable regulations.
22.NOTICE
All notices under this Agreement must be in writing.Any notice given by either party pursuant to this Agreement shall be
deemed to be served,if the same is delivered personally or certified mail,return receipt requested,to the other party at the
address written in this Agreement.
23. RIGHT TO CANCEL
The Owner has the right to cancel this Agreement if the Owner has signed this Agreement at a place other than the place of
business of the Contractor(which may be his main office or a branch thereof),provided that the Owner notifies the Contractor in
writing,at his main office or branch by certified mail,return receipt requested,by telegram sent or by personal delivery,not latter
than midnight of the third business day following the signing of this Agreement.Attached hereto is the Notice of Cancellation,
which the Owner may use to cancel this Agreement as provided herein.

24. COMPLETION OF THE AGREEMENT FOR EXECUTION
The owner is hereby advised that he/she should not sign this contract unless and until all blank spaces and sections have
been filled in or marked as void,deleted or not applicable,and until all exhibits and related or referenced documents that
are incorporated herein are attached heretofore.
You are entitled to a copy of the contract at the time you sign.Keep it to protect your legal rights.

ADDENDUM "A"

The following are complete specifications,to the best of the contractors' ability,for the project as noted. Please also
refer to the construction plans for dimensions as well structural and related information.Any changes to these
specifications should be noted in writing.
EXTERIOR DEMOLITION
• Prepare the existing site for excavation by removing the wood fence and the landscape elements to
allow for excavation.
• Remove the existing screen porch structure and remove any necessary siding on the existing garage.
• Remove any existing exterior finishes necessary to complete the designed intent.
EXCAVATION
• Excavate the necessary amounts of soil to place the footings of the addition at 48"below the proposed finished
grade to provide frost protection.
• Soil conditions which require the Contractor to excavate to additional depth in order to provide stable soil for
the placement of the footings will incur additional costs relative to the time required of the excavating
contractor, Contractors' supervision,removal of unsuitable fill,and importing of additional materials if
needed.
• Upon completion of the foundation, including damp proofing and inspection&approval by the local building
department,the Contractor will backfill the foundation with materials which were excavated from the site. If
the soil is contaminated,or deemed unsuitable to re-use,the Contractor will advise the Owner and import
clean fill to be used as backfill.This will result in an additional cost for the Owner and shall be addressed as a
Change Order.
• All suitable excess fill will be removed from the existing site,which additional cost is to be determined.
• Any contaminated or unsuitable material which must be removed from the site will incur an additional cost
and be addressed as a change order.
FOUNDATION/CONCRETE
• Provide proper 10"x 20"concrete footings(minimum 3,000PSI compressive strength)and 10"poured
concrete(minimum 3,000PSI compressive strength)foundation walls.Details and key-outs to be as on plans.
• Pour,place and finish concrete(minimum 3,000PSI compressive strength)for the crawl space floor.
• NOTE: Even properly poured and cured concrete is susceptible to cracking,and this is not considered a defect
unless it is impacting the performance of the concrete or allowing water into the home.
• Apply damp proof foundation coating on the addition below finished grade.
• Saw cut existing foundation wall to provide access to the existing basement area.
FLOOR FRAMING
• The floor system for the addition will be 2 x 8 floor joists with a maximum spacing of 16"on center.
• Main support beam will be built up dimensional lumber supported on notated Lally columns in the crawl
space,
• Sub floor will be 3/4"tongue&groove"Advantech"engineered sub floor,glued&nailed to the floor joists.
• The intent is for the floor level of the existing kitchen to be flush with the new addition floor.

• Exterior walls will constructed with 2 x 6 kiln dried lumber with '/2"OSB plywood sheathing on the exterior of
the wall assembly.Maximum stud spacing to be 16"on center.
• The interior partition walls will be constructed with 2 x 4 kiln dried lumber.All wall studs will have a
maximum spacing of 16"on center.
• Reference the Construction plans for the layout and proposed framing.
ROOF FRAMING
• Roof will be a gable style roof with a flat interior ceiling.
• Roof framing will be 2 x 8 rafters with a maximum spacing of 16"on center.The roof sheathing will be 1/2"
CDX exterior grade plywood.
• Construction and structural details will be as noted on the accompanying plans.
• Install 1 x 3 wood strapping on the under side of the ceiling joist to prepare to receive 1/2"gypsum blue board.
• Frame the roof eaves and gable ends to resemble the existing house.
ROOFING
• The roofing will be"GAF"or equal 30 year architectural asphalt/fiberglass shingles including#15 felt
roofing underlayment. Selections to be made from Contractor's samples.
• Ice and water shield at the eaves and valleys.
• "Cobra"shingle over roll ridge venting and white aluminum drip and rake edge are included.
DECK/PORCH
• The new deck and porch will be framed with pressure treated lumber.
• The deck surface will be 5/4"x 6"composite decking by Weatherbest or equal.
• Supply and install RDI"Titan Pro Rail"white vinyl railings and balusters at the perimeter as required due to
the elevation.
• Supply and install screen panels and screen door on the porch.
SIDING& TRIM
• Siding will be Certainteed or equal vinyl siding with a double 4"exposure. Selections to be made from
contractor's sources.An exact match is not guaranteed.
• The scope of the vinyl siding work is of the new addition and portions of the affected garage structure.
• Wrap the trim and moldings with white aluminum coil stock.
• Soffits will be triple 4"ventilated soffit panels.
• Install Tyvek or similar air infiltration barrier on the exterior walls of the addition.
WINDOWS
• Supply and install Harvey Industries `Vicon"white vinyl tilt wash windows with High performance Low E
glass. Full insect screens and white hardware. 6 over 6 grille pattern with the grilles between the glass.
• Window sizes per the plans.Large windows suitable to meet Massachusetts egress code.
DOORS
• Supply and install a Therma Tru French Wood Hinged unit in the sitting room.
• Supply and install a Therma Tru six panel fire door between the garage and the living space.
• Re install the existing overhead garage doors and operators.
PLUMBING
• Supply and install PVC drain lines and a vent line to service one tub shower unit,one toilet and one lavatory
basin,one kitchen sink and one laundry hook up.

INTERIOR TRIM
• The interior finish work will consist of the installation of raised panel molded hollow core doors and jambs
with 2-1/2"colonial casing applied. Schlage `Plymouth"style passage sets in a brass finish.
• The door schedule includes swing passage doors and bi—fold type door at the laundry closet.
• The windows shall receive a traditional stool cap and be trimmed with 2-1/2"colonial casing.
• The base board trims with consist of a 3-1/2"one piece base.
• The closets will receive birch plywood shelving and wood closet rod and supports.
• Install a disappearing stair to provide access to the attic space above.
KITCHEN and BATHROOM CABINETS

FLOORING
• Supply and install pre finished 3/4"x 3"natural red oak hardwood flooring over#15 felt underlayment in the
entry, sitting room and the bedroom and closets.
• Supply and install an underlayment suitable to receive ceramic tile flooring.Install ceramic type tile and grout
on the bathroom floor.The the material allowance is$385.00.
PAINTING
• The interior painting will consist of caulking spackling of nail holes and finish sanding.
• Install primer and one coat of semi gloss latex paint to the wood work and primer and one finish coat egg shell
to the walls.
• One color on the walls and one color on the trims.
• Additional colors require additional work and clean up and will be addressed with the painting contractor if
additional colors are desired.
SPECIALTIES—MISC.
• Contractor will provide all necessary supervision and coordination and labor to complete the designed intent.
• Install the laundry appliances and ventilate the dryer and the bathroom exhaust fan to the outdoors.
• Install owner supplied bathroom accessories.
• All fencing shall be put back in place if disturbed.
CLEAN UP
• All construction debris will be removed from the job site to an approved location,or placed into on site roll off
trash containers.(30 cubic yard size).
• Work site to be left clean and orderly in a"broom clean"condition on a daily basis.Construction materials
will be left on site as needed and maintained in an orderly manner.
• Contractor will provide and install poly/plastic screening to control.construction dust to the best of
Contractor's ability.The owner must understand that this will not contain all the dust which will be generated
from this type of remodel,and should expect dust to circulate around the remainder of the home to some
extent.
EXCLUSIONS
• Finished landscaping of the disturbed area.
• Gutters and down spouts
